  1. Can you guys please specify if you are applying as a spouse or simply 5 yrs rule ?!


    I had my interview 2 months ago. I passed the civil test and I was told that I will receive a letter with list of additional paperwork I need to send them and after that I will have my oath ceremony.

    Never got anything from them. I called and still nothing happening. ....

    Online status : Request for Evidence

    On August 26, ( day of my interview ) we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested.


    Anyone has similar experience? ??? Don't know what to do. ...

    Did you apply as spouse or 5 yrs rule ?

  2. Vacation dates ? Employmente dates ? Hmmm oh boy I really need to take a look again at this form because time ago, I took a quick look at it and I dont remember such questions.

    I think estimates are ok. In fact, when you fill up the "change adress" form online (requirement when you change address) there is even a message saying its ok to be an estimate.

    I think as long as you dont go overboard with it it should be ok.

  3. I had two interviews not one.

    They called us for a second one because of the living situation.

    We went to the second interview with all the proof of how we have been living and plane tickets and how I visit Vegas regularly and that wasn't a problem, and that's how I got my 10yr GC.

    So I was only surprised during my n400 interview, when he asked the same questions from the second interview.

    I'm not taking any actions, nor will I, its too late now. The elections are done and over. So they can take their time, I only wanted to vote. I just hope this is finalized before 2016 pres. election, I already see people from this forum who have been waiting a year+ just odd

    Exactly man. I meant that usually THERE IS NO INTERVIEW to remove conditions (thats what I have heard and experienced myself).

    Please, keep me updated on your case because Im very curious about it. Yes, agree this whole thing is very odd since I have heard that the N400 process usually doesnt even bring marriage history up since it has been already proven as a bonafide (otherwise the person would not be able to remove conditions, right ?).

    What else did they ask in the interview overall man ?

  4. Another detail caught my attention on your posting, my friend.

    Usually, there are NO interviews with the couple in order to remove conditions and it seems like you and your ex wife had one interview, right ?!. Thats odd. maybe, for some reason, your file have been "red flagged" since day one ?

    See, the officer was clearly concern on why you were married but not "living together" as matter of fact, he asked you to write down for "how long you were living together" which shouldnt be even a question for A MARRIED COUPLE!

    Anyways, If I were you, I would not push too much man. Wait maybe 6 month or so and then take it from there. They will either approve your application when you less expect OR they will deny your application and give you a reason why they did so which will give you the tools to proof otherwise.

    I wouldnt do anything right now.

  5. "The first things come first" and granting citizenship to a permanent resident is NOT PRIORITY for USCIS at this moment, sorry but its true. In the end of the day, you can still work, travel and "live your life" which is different from people who are ajusting status and need their authorization to work and travel (and that is USCIS priority).

    I have read a lot of posting where the person has to wait for a long time for "that decision" or to take the oath. As I have heard the USC process is also very simple and "fast" as I also believe there are officers with different point of views, work mentality, etc.

    In a normal world, USC is a very straight forward process based on a very clear criteria and when someone applies for citizenship (following the criteria of course) I personally dont see how someone can have it denied.

    However, when red flags may help the delay of a process. Living away from spouse does not look good, lets face it.

  6. Your immigration status is a mess my friend, sorry. However, having 2 kids with your US spouse will definetely play a huge roll for you. USCIS will take that in consideration and let you come back to take care of your family !!

    I dont know but they might ask you to re apply for you GC once again ?! Maybe yes or maybe they will just forgive you. I have no idea. One thing Im sure is that they will take in consideration the need you have of being close to your children

  7. Actually I only responded about this matter because you incorrectly stated that the OP MUST wait for the decree before filing. You then in another post, went on to state a completely false statement of having ROC approved while divorce is pending being a "horrible mistake". I am simply ensuring that people know the complete truth, not phallacies.

    The OP will be fine as long as they have evidence of relationship. Relationships fail, sad but true, and USCIS understands that.

    Yes, you are right about "divorce pending" during i751 process not being a problem.

  8. Nahh .. dont stress ok ? In order to USCIS to simply deny your i751 "just because" its unlikely. USCIS is a very fair governmental department who will look deep in evidences. As I read an article about an attorney saying that nowdays, the law "favorite" the immigrant much more than years ago (well, as you can see the whole immigration bill and amnesty for ilegals) so they will have to find smth HORRIBLE in order to simply send you back home !

    Besides, Im sorry to say that, does german ppl even need a visa to come to US ? Sorry but EVERYBODY I have seen that got their i751 approved in like 2 or 3 months (normal its 6 month) are ironicaly from countries who does not need visas to come to US !!

  9. Yes you can be married and file by yourself, but only for the abuse waiver. You can file as a divorced person before filing for divorce, or while divorce is pending... but you will of course need the decree to actually get approved.

    Being approved while divorce is pending isn't against the rules, espeically if the GC is approved without interview. If you interview you need to be honest and the IO will change your application to a divorce waiver petition.

    If your divorce is final and your GC is approved based on a joint petition, that's not great. You need to contact USCIS/make an infopass and advise them your divorce is now final. It shouldn't be that big of a deal because ultimately your divorce waiver and joint petition are based on bonafide marriage but you may get into trouble for not advising them ASAP.

    Your last paragraph is wrong... I think maybe you made a typo? It's not a "horrible mistake" to get I-751 approved while the divorce is still pending, it's perfectly fine. That is possible if filed with a joint petition and the USC didn't withdraw their support. There's no way to get I-751 approved on a divorce waiver petition with a divorce still pending.

    Dude, bont be silly and lets focus on the damn topic, all right ?! Try to help the OP instead of trying to show you know at all. If you read the TOPIC and the OPs question you will realize you are talking about smth thats nothing to do with the TOPIC.

    Any marriage where the applciant file for divorce right after filling for i715 is aready suspicious to USCIS, as it should be suspicious.

    For you OP, if you CAN, if its possible for you to be done with your marriage (divorced) before i751 approved than do it. You can do whatever VANESSA/TONY is saying (which they are right too) but avoid it. Otherwise you gonna look like someone who is using the system to get USCIS benefits, be careful. Be real and be truth. Read the i751 form all over and you gonna understand that you should file as married or not. One thing I can assure you (you can search yourself if you want) if you file as married and get divorced during the process you must contact USCIS otherwise it might cause you problems OP.

    Also OP, regardless on what ppl tell you here, go see an attorney and ask for advise do you know why ? because USCIS approve/deny cases based on that particular case and NOT AS A CRITERIA.

    I know someone, who was married for less than 8 month, got GC conditional, had NOTHING to show bonafide and removed conditions very easily in 6 month with NO INTERVIEW. As I heard of others, on the same case, who went through a lot of stress to remove conditions.

  10. Incorrect. This is very dangerous advice.

    The I-751 needs to be filed either after divorce is final, OR during the 90 day period, whichever is first.

    So if the divorce is not final and the window opens, the OP needs to file the waiver without the decree (waiting until about a month until expiration of the GC to give themselves the most time). They will get RFE'd for the decree and there is a process they will go through if they don't have it in time but it will not result in deportation.

    That is pretty obvious that it should be "either after divorce is final OR during the 90 day period !! I didnt think OP wouldnt know that, sorry.

    However, based on the topic, we do not know when OP is filling for divorce, which state, etc. If OP can have the divorce finalized BEFORE filling for i751 it will creat less stress on the case.

    Also, I dont even know that you can "be married" and file with a waiver, not sure. Can you ? I think applying for waiver apply only when applicant is divorced or divorce filled.

    Also, a lot of ppl make the horrible mistake of getting i751 approved awhile divorce is STILL PENDING which will only create problems in the future.

  11. Ppl filling for i751 jointly, please DO NOT FREAK OUT bout RFE !! Seriously ok ?

    Happened to me .. I sent all the paper work possible and after 6 month they still sent me an RFE .. we called USCIS (level 2) and he said it was to "update" your info and bonafide paper work.

    Think ... even IF you sent smth not enough, what they gonna do ? schedule an face to face interview with the couple, thats all.

    Just send whatever you got and make sure they are RECENT even if it is smth you aready sent i.e: they got a banck statement 8 month old, now they wanna see that same bank statement being like 1 month old.

    I sent a letter with my RFE teliing flat out "I lost my bank statements, I dont have it, etc" ... got my i751 approved anyways.

  12. Dont worry. I went through the same thing with a RFE. I did not know whatelse to send since there wasnt anything else to send. So my wife (the citizen) called the USCIS, asked to talk to level 2 (somebody higher up) and the guy said straight up "this is just to refresh/update information" he also said to her "if you guys are still married, you shoudnt have any problem sending us new stuff" ... bottom line ... depending on how late they star to work on your file, they might ask "updated" paper work, thats all.

    Just send whatever you got as long as they are RECENT !!

  13. I'm writing this on behalf of my wife who is in USA originally from a K-1 visa. We've finally gotten to our 2 year anniversary where we need to process the I-751.

    We originally mailed the application to Vermont and received the NOA1 on February 22nd, and went to the Biometrics appoinment in mid-March. Since then, we have not heard anything from USCIS about our application, and as of today, the case status just shows that the application was received on February 22nd. We've tried calling USCIS about the situation, and they say it's only been received, and according to their case status website, they're finished applications from December 21, 2011.

    We visited this site and were alarmed that applications going to Vermont that were submitted after us were already over and done with, with positive results. Our case is not hard, we had all the documents that was requested, yet we haven't been called for interviews yet, and our letters of reference haven't been contacted either.

    Should my wife be worried about this?

    i went throught the same in CSC and didnt get it how ppl applied after me and were already approved like 3 month before myself including a friend who filled under a waiver.

    Good luck with ur USCIS officer, thats all.
