  1. If the petitioning sponsor is your husband then yes. That being said, if using assets, they usually want to see you comfortably over, not just scraping by.

    Yes, it is my husband. We have a difference of a little over $1000 between earnings and guidelines. Our assets and savings equal just shy of $40,000. Do you think we'll be ok? I have also included in my cover letter that I receive $2400 per month in child support from my ex-husband, there was nowhere on the I-864 to include that....I figured it couldn't hurt if the CSO reads that and considers it in their decision.

  2. They won't count the one car because to lose it would be a hardship on you, as you wouldn't have transportation. The motorcycles should work. You should go with current value if they are paid in full, or what you could bet back after sell them if you are still making payments.

    Thanks for your reply. We have 2 cars, my husbands and the one we bought for me when we arrived. They are paid in full as are the motorcycles. So we will go by current market price. What would I need to provide, besides the titles for proof of ownership, as evidence of the current value....do they need evidence, will a print out of the web page from Blue Book or NADA be sufficient?

  3. Read the instructions. If you missed that, then you probably missed a lot of other things and will get RFE.

    Why do people feel the need to be hostile???

    This is a stressful process and VJ is supposed to be a place where we can come and receive answers and not feel judged or be made to feel stupid.

    It would be great if people could limit their "advice" to just that, and leave out the personal comments.

    Los Angeles (downtown) July 2012. NO

    Pomona- long wait. Successful

    Santa Ana -Walked in 2 times in June 2012. No questions asked. The friendly security guards even told me I could go inside to fill out the form for my wife but will have to wait outside afterwards.

    San Marcos - Walked in at a little after 2pm and we're 2nd in line. Showed Appointment Notice and passport. Entire process only took 15 minutes and didn't have to pay parking fee (inside a small shopping center)

    San Marcos - Walked in right after I got apt letter, went 20 min before closing, was the only one there, didn't give any reason, was in and out in 7 min, free ample parking space.

    COLORADO

    Denver, Co- went in 2 days early because I couldn't get the day off of work to take hubby on exact date and we had no issues

    Aurora, CO - Went 10 days early. Reason: I was in the area and had lots of meetings on appointment day. Successful. I arrived at 8 am and saw that lots of people were waiting. Left, did some chores, and came back at 9:15. Finished biometrics in 10 minutes.

    FLORIDA

    Miami - June 2012 - Gave no reason. Showed up 2 weeks before - was in and out in 5 minutes.

    Oakland Park - Feb 2013 - Gave no reason, 2 weeks before appointment, succsessful in 10 minutes.

    GEORGIA

    Atlanta - No reason Officer had us wait outside until the earliest appts went in (about 15 minutes). Yes.

    Atlanta - Our appt was for 6/13 went in 5/25 and we were successful with no questions. The office just wrote on our form Walk-in.

    Atlanta - Appointment for 04/26/13. Did a walk-in at 3PM 04/17/13 successfully. Reason was husband is working on appointment day. No question of reason though.

    INDIANA

    Michigan City - January 2012 - No reason needed - Yes to successful walk-in(asked about it, I was there the same day as appointment)

    IOWA

    Des Moines - April 2010 - Husbands erratic work schedule meant rescheduling wouldn't help because there was still no guarantee the new date would work - Successful

    Des Moines - March 2011 - To get it over with - Successful (advised they were being more strict but letting them proceed due to no-one else being there)

    LOUISIANA

    Metairie - Unsuccessful. You must arrive on the correct day at the exact time of your appointment, or they will not see you. Tried for AOS, ROC and N-400. Two friends have also tried it and been refused.

    MARYLAND

    Baltimore - April/2013, told guard I will have oral surgery couple days before appointment & will be very swollen/bruised, she asked for supporting documents which I provided. Denied walk in. Was told I could come the day of if I was feeling well enough or after appointment date but not before.

    Wheaton - told Security guard I was not going to be in State on the day. Yes

    Wheaton - July 2012, asked why could not make appointment, said attending wedding. Successful(out in 10 minutes).

    MINNESOTA

    Duluth - successful

    Minneapolis-May 2012- NO because one of the computers was down

    St Paul - No reason asked or given. Successful

    MISSOURI

    St. Louis - No problems, no questions asked, Successful

    MONTANA

    Helena - My appointment was at 3pm on April 23rd and for some reason they scheduled my children for the next day at 9am, 10am and 11am. It was a 4 hour drive from where I live and I arrived a little after 1pm. We had a hotel room booked for the night and we didn't feel like kicking around town to kill time before the appointment so I asked if we could be seen right away. No problem he said and he showed us in. They were all so friendly so I asked, would it be OK to do the kids now too rather than wait for their 3 separate appointments tomorrow, they said happy to which was great as it meant we could get on the road first thing the next day and head home. All up it took about 45 mins to process all of us. I hope we get an interview at the Helena office instead of at the NBC. The office is very quiet and the staff super friendly.

    NEBRASKA

    Omaha - 3/22/2012- appointment was for Apr 5. No questions. Successful

    NEW HAMPSHIRE

    Manchester, NH - Did routine security check and showed I-797 to guy at the window who said the decision would be the department's whether to take early appointment or not. Lady gave me lecture on how to change appt, if not able to make it and said they need to stop early walk-ins as they schedule staff based on # of persons per appt, They were very nice and respectful and did it anyway. Asked for ID and marriage certificate, said if I didn't have that then they would not have been able to do the bio. Asked why I wanted it done, told the truth...it was anxiety....

    NEW JERSEY

    Hackensack - The guard asked me what I was doing there on 8/20/12 when my schedule was 8/30/12. I told him my sister will be having her baby and I will fly to Rochester on 8/25/12 to be with her. The guard let me talk with the manager and the manager checked my roundtrip ticket. The walk-in attempt was SUCCESSFUL.

    NEW YORK

    Holtsville, NY (Long Island) 5/22/12 No reason asked. YES

    Manhattan, NY, 01/15/2013, Couldn't get to Philadelphia, Walk in Successful

    OHIO

    Cleveland- no questions. Successful.

  5. The USCIS made a mistake with my sons birthday too. I have 3 kids and whoever was typing in all the details of their birth dates made a mistake and put his birthday the same as my daughters birthday. I called the USCIS customer service number on the NOA1 and the guy I spoke to made the correction over the phone. Didn't request that I send in anything and I haven't received anything from them. Had our Biometrics last week and everything was correct in their system.

  6. It does and I am sure you are fine. I am guessing they would have given you a RFE for the DS3025 at the same time as your 485 so you should be good to go.

    You will sort out the I485 stuff too. From what I have read things start to move a little faster now that they have your file so you should have your GC in no time!!

    Thanks David. I know things will work out, just gotta jump through a few more hoops. It is good to know someone is looking at my file. Fingers crossed we will have an interview at the Helena Office and not get an interview waiver and have it processed at the NBC....seems those are taking a looong time. We went to Helena, 4 hours away, on Tuesday for our Biometrics. The office was dead quiet and the staff there were SUPER nice! They had scheduled mine on Tuesday and the kids for 9am, 10am and 11am wednesday, but they did us all together when we arrived on Tuesday, so that was great. We were in and out in about 45mins for all 4 of us.

  7. Do you only have one MMR shot on there or 2? The 864 is the worst. I find the aff of support to be the most difficult of all the forms to complete!

    In Australia I went to my GP and had a blood test done. The results showed I had immunity to Rubella and Measles but not Mumps so I had him give me the MMR shot. I wasn't aware of, nor had a second shot. I can't tell you what my DS-3025 actually has on it, as I (hopefully not stupidly) sent the original DS-3025 with my I-485 and failed to keep photocopies. I am guessing it would only say 1 shot, as that is all I have had.

    It looks like Dr. Waks prepared yours the same as he did mine, like I said, it seems to have been accepted by USCIS at this stage.

  8. Is your family 5? 2 adults and 3 dependents?

    Is 35K enough for 5 people?

    If yes, then skip all of your I-864a stuff.

    If not, then to solve the tax issue, you can submit a letter outlining why you weren't required to file a tax return (you weren't in the US). I suspect you didn't send any letter or anything the first time.

    Also, for your husband, make sure it is a complete tax return with all the schedules and extras, and get a new letter from the employer and also send paystubs.

    Thank you for your response. The guidelines for a family of 5 are $34,462 so he earns about $1000 above that. Should I resubmit with the RFE a new I-864 without any of my income stuff? Will they accept a new I-864 to add to my I-485 or do I have to submit the whole AOS package again?

    I guess I got confused with the process for submitting an I-864a. I wanted to include the child support because it increased our household income by over 30,000. It said on the I-864 instructions that I needed to submit the I-864a because I have dependants, but they processed my income alone as not meeting the poverty guidelines, instead of seeing our two incomes combined.

  9. Hi guys. Today I received an RFE for my AOS. I have called USCIS, but they were no help, basically just read the guidelines on the RFE.

    My husband provided his I-864 showing his income of $35,880 which was backed up with a letter from his Employer. We also included myself on the I-864 because I receive an income of $31,200 from my ex husband in child support. I also had to submit an I-864a because I have 3 dependants.

    They are now asking for my husband to provide more evidence of his employment, which is fine and we only submitted tax returns for 2009, 2010 and 2011 because he hadn't filed his 2012 tax return yet. He has done that now, so we can provide that. My concern though is that his 2012 return does not reflect his annual income as he has only been in his current position since October 2012. So his total gross income for 2012 was less than $5,000 as he didn't work for the remainder of 2012 as he was living with and caring for his Grandparents.

    They have also requested for the I-864 and I-864a that I submit a tax return. However, being the immigrant who only arrived in December 2012 I have not worked and not been legally able to do so, thus the reason I am applying for the I-485 and I-765, so why on earth would they ask me to submit tax returns.

    I am so worried that I won'y be able to respond to the RFE with all the information they are requesting. In regard to the request for me to supply tax returns, is it enough that I write them a letter explaining that I am not required to file a US tax return?

    UUgh, this is so complicated. My husband has a very stable and secure job now with an income that meets the poverty guidelines, unfortunately that job is only 6 months old. The information we submitted in regard to his Employment in the I-134 is exactly the same as what we have submitted for the I-864, but now it is not enough??

    Should we not have included my child support in our AOS package and left out the I864a and the listing of my income on the I-864? and if so is it possible to resubmit these forms without the extra information?

  10. Your assets would be included on your wife's I-864. No need to fill out an I-864A. Check the form instructions for including income/assets of the intending immigrant.

    I was of the understanding that the intending immigrant had to submit an I-864a if they were using their income/assets. I checked 8 (a) on the form "relationship to sponsor....I am the intending immigrant and also the sponsor's spouse". I submitted my AOS about a month ago and included an I-864a as well as my husbands I-864....??

    Just read the fine print in the instructions. I completed an I-864a because I am an intending immigrant with dependants. I didn't realise though that the form isn't required if your Sponsor meets the income requirements. My husband does meet the requirements, but I wanted to "beef up" our case just in case by including my income as well....I hope this doesn't mean we will get an RFE for providing a form that wasn't required.

    I dont have any number behind my I-94 but I got my A# from my NOA2.

    On the I485 it asks for my nonimmigrant visa number. I have 2 numbers on my visa stamp. My control number (all digits) and then a red number that begins with the letter F. Anyone have an idea on which one they are looking for when they ask for my nonimmigrant visa number??

    Hey there, man you're on fire, you just arrived and you're already onto your AOS :) The red number starting with F is your Visa number.

  12. Sorry just to cut into the subject now that you mentioned the SS card..... you were already married when you applied? did they give you any hassels?

    Yep, I went in and applied for my SSN on the 11th of March, got married on the 12th and received my SS card in the mail on the 14th of March, just a few days later. Some people apply for theirs after they marry in case they change their name. I have kept my maiden name so that didn't matter to me.

  13. We put an email in to his doctor requesting a copy, we are just concerned now with how long it will take to get it as his I-94 expires May 12th. The USCIS people aren't very helpful on the phone but I think we would have to schedule an appointment to extend his stay if it comes to that.

    Don't worry about the expiration of the I-94. You are required to get married within 90 days of your arrival to the USA ie before the I-94 expires. You are not required to adjust status before the expiration of your I-94. It is best to submit your AOS paperwork as soon as possible, but some people don't do it for months. It is best to get the AOS started before your medical is 12 months old though, as this would require you to re do the medical here. I arrived 12/30/2012. Got married 03/12/2013 and sent off the AOS paperwork first week of April....my I-94 expired on 03/29/2013. One thing I would do now, if you haven't already, is apply for your SSN, as this needs to be done at least 2 weeks before your I- 94 expires. I was able to go down to my SS office and apply in person, I received my card just a few days after that. If you don't do it before your I-94 expires, you will be unable to apply for one until you get your GC as until then you are considered out of status and not eligible for a SSN. You don't need to apply to extend his stay....you have plenty of time :)

    Hopefully your Dr will be happy to send you the DS-3025, I'm not positive, but I am guessing that USCIS may want an original one. If the Dr sends it from Australia, post is usually around 9-10 days.

    My husband and I are working on our I-485 Adjustment of Status package and have become stuck on the i-693. He had his medical examination in Australia 5 months ago and the only vaccine required was for the flu. The DS-3025 was filled out however he never received a copy (I think it is in the yellow envelope that comes with the Visa? This was surrendered to immigration at POE) How do we go about doing the vaccination information on the i-693 for our i-485 or is it not required as they already have his medical examination and vaccination information? Any help would be greatly appreciated.

    Where did you do your medical in Australia? Could you possibly contact them and ask them to send you a copy of the DS-3025? Dr Waks did my Medical in Sydney and he was great and really helpful, he gave me a copy of the DS-3025 on the day of the Medical, as well as including one for the Embassy. Hopefully getting another one from your Dr is an option if they still have a copy of it. Good Luck!

    Just regarding the above. We received an RFE for us to send away my husband's federal tax return for 2012 (he had not completed this prior to us sending in the documents so we sent away W2s)

    Our interview is scheduled for USCIS office 5 hours away on Tuesday the 23rd of April which is less than a week away!

    I'll be sending this off asap but what's the likelihood of us attending the interview only to have them say they havn't received the document required and send us away? Obviously with us having to take a 5 hour trip to get to the office, this is not desirable! I'll definitely be bringing a copy of the RFE and the required document but will this suffice?

    Wow, congratulations on getting your interview date so soon. We sent our AOS off in April, NOA1 April 4th....I hope they schedule our interview soon too. Thing is, we didn't include my husbands 2012 tax return either as he filed his tax's on Monday, guessing we'll probably get an RFE too. Have to drive to Helena, MT (5 hours away) next Tuesday for our Biometrics.

  16. When did he file your AOS? Did he also file for EAD? ..I file for both late Jan, got my EAD card couple of weeks ago and haven't heard anything about my AOS interview. The good thing is I can work now.

    We filed on the 27th of March and received our NOA1 on the 4th of April....really hoping I get my EAD soon, I'm itching to start work!!

    I dont know if there are any stats regarding AOS success rates, but even if there were they would be immaterial in your case.

    Each case of AOS is analyzed on its own merits. If there were anything in your closet that might prevent you from proceeding with AOS it would have surfaced during the K-1 process.

    The fear most have when dealing with the USCIS is completely unfounded. You would not be denied AOS for mundane reasons. Your relationship is real. Your marriage is real. The truth has a distinctive ring and the USCIS agents are trained to listen and identify it. Most of what you will need to present for AOS, other than the legal documentation - marriage certificate, etc - are the things that you normally have or accumulate when you have a husband/wife and kids. Relax, don't lose sleep over it and enjoy your family.

    Here is to hoping that it goes smoothly and quickly!

  17. Hi there, I am curious about the history of AOS approvals. We gratefully sailed through the K1 process relatively quickly, thanks I think, to some meticulous preparation and submission of all our paperwork....there was a lot as we were applying for myself and 3 children.

    We have been here since December 30, 2012 and have really settled in to our new life here in the US over the last 3 months or so. My now husband has adjusted amazingly to his role as a new Father for my children, we have invested money into settling in and creating a home with the purchase of a car for myself and the kids, furniture, new bikes for the kids and they are all settled into their new school since the end of Christmas break....I guess what I am saying/asking here is, I can't imagine having to tear ourselves away from this new life here if our AOS was denied. I am hoping that I was as thorough with our AOS paperwork as we were with the K1 paperwork and that we will be approved.....we would be devastated beyond words or comprehension if, after all this and the coming months of waiting for word from USCIS, we received a denial.

    Does anyone have any stats on the approvals/denials of AOS?
