  1. My EAD/AP was suspended until after they received the response to an RFE. The RFE letter stated that processing of the I-485 and EAD would be suspended until the USCIS received and processed the RFE response. I received my EAD pretty soon after they received the RFE response though. I would wait until you have everything together, especially the tax stuff, make sure you submit full tax transcripts from your co sponsor!

  2. Thank you for your response. My question is, aside from a letter from USCIS stating possible interview waiver, will I know when my case is forwarded to the local field office for adjudication if that's the route USCIS goes? Our petition for AOS has been submitted and accepted since September 24th. I've noticed that other September filers are ahead of me regardless of which path is taken. Some interview waivers have been processed, and some local field office interviews have been done. I'm just trying to gauge what's going to happen. As of today, the Cleveland field office is working on April 29th, 2013 for the I485. Whether or not we get an interview waiver, it looks like a long wait.

    I received the interview waiver letter in August. I didn't receive anything until October when I received an RFE for a new G-325a, I noticed it was addressed from my local office, the only indication that my case had been transferred from the NBC to the local office. Had I not received the RFE, I assume I would not have received any further communication from USCIS until my case was either approved/denied which according to the interview waiver letter, it said do not expect to hear from us for at least 6 months. Fortunately after responding to the RFE, may case was immediately approved, so no 6 month wait!!

  3. Finally got our approval/card production emails yesterday....I am so relieved and happy!!! Only thing is, of all our applications, mine, and my 3 children's, they have approved mine and 2 of my children's but not my youngest sons application??? All I can think is that somehow his application has been separated from the rest of ours, maybe somewhere between the NBC and them being sent to our local Helena office for processing. I called USCIS yesterday and have put in a service request, gosh I hope they find it soon and get his card out to us too, then we can really relax and enjoy our 2 years USCIS free.

    We were one of the interview waiver cases, received the waiver letter in August. So grateful that we haven't had to wait as long as we were expecting too!!

  4. Filed in April, received waiver letter in August....still waiting, hopefully will get Nhung's good luck!!

    Uugh....just got an email for an RFE for my case, strangely not for my 3 children though. Already had an RFE back in May, responded to that, what more could they possibly want. Now I have to sweat it out until I get the letter Grrrr.

    My local office is also Helena, so hopefully that means, like Nhung, if I get the RFE back to them immediately our cards will go into production as well. Fingers crossed!!!

  5. Hi there, I'm waiting too. Filed April, Biometrics May, RFE May (sent response straight back) Got a letter in August telling me I'm one of the potential interview waiver cases....a positive thing if it saves me a 4 hour drive east to Helena, but a negative thing if I have to wait until at least February before I hear anything again. Looks like processing in Helena is about 5 months? And you are so right, why on earth is Helena processing so slowly compared to bigger cities. I did an early walk in for our Biometrics and there was no one there, they were super nice and it wasn't a problem at all. Who knows??? Hopefully the next few months will go quick, especially when the snow hits the ground and the mountains open up!!

  6. It seems the information provided on the US Embassy website has changed since I did my K1 last year. It does not mention fingerprints, just a police check, but I would stay on the safe side and get the fingerprint check done as you are sure to be asked for it in your Packet 3. I would email the Consulate in Sydney sydneyiv@state.gov and ask them, they usually respond within a couple of days. Make sure you include in your email to them your full name contact details and case number.

    I would call and get your case number and book your medical, no telling how long you will have to wait for an appointment. I did mine in Sydney, not sure how long things take in Victoria. I would also get onto your Police Certificate too, better to be prepared than to wait.

    As far as the I-134 goes. You will need your Father in laws Birth Certificate or copies of his Passport Biographical page in order to verify his status as a US Citizen. You will also need his Tax Transcripts for the most recent tax year and evidence of his employment in the form of a letter from his employer or pay slips for at least 6 months verifying his employment status and income. If you just provide the I-134 with no supporting evidence you will receive an RFE requesting this information, the I-134 on it's own isn't sufficient.

  8. Congratulations!!! That's fantastic news, what a relief for you!

    I sent off my AOS package in April, responded to an RFE in May/June and received a letter of possible interview waiver in August.

    So you didn't get an interview or the interview waiver letter? Just straight to the Greencard?..... That's awesome!

    Man I hope I get mine soon and I can sit back and have a break from USCIS too.

We sent out our AOS package in April, had Biometrics in May and received an RFE, which we responded to straight away, received EAD in June and got a letter a couple of weeks ago saying that my case has been identified as a potential interview waiver case and to not expect to hear anything further for 6 months. So I am assuming those who receive the waiver will get the same letter I did and those that get an interview will receive the interview schedule letter.

  10. Hi there, I received a letter the other day notifying me that our cases (AOS from K1 and K2) may be waived for the interview. Back in May we received an RFE, which we responded to and they received on the 22nd of May. They haven't requested any further information for that RFE, so is it safe to assume that they were satisfied with our response and now we just have to wait for the 6 months or more to receive our GC and hopefully no more RFE's?

    Typically, do people who receive the interview waiver letter have their interview waived or have some people received that letter and then later been scheduled an interview, as the letter says it is potential interview waiver, not guaranteed... just curious about the outcome for those people who have received the same letter.

  11. I'm kind of in the same boat. I received an RFE for my AOS and had to send back more evidence for the I-864. My EAD was put on hold until the RFE response was received by USCIS. Shortly after they received my RFE response, I received my EAD card in the mail. I am yet to hear back as to whether the RFE response I sent was satisfactory, it is still sitting on response review and just outside of the 60 days they say they will contact me with a response. I called USCIS to find out more info, but all they could say was my application is within processing times and I can assume that the RFE response was accepted as they haven't requested further information. So now I guess I just have to wait and find out whether my GC is processed at the Benefits Centre or transferred to my local office, who are currently working on cases from December 2012.

    I think if they have approved your AP then you will probably get the EAD combo. Good Luck!

  12. Thank God urs had a happy ending idk if mine will tho. Question, what color package did u recieve it in? Bcuz when I called usps they r asking me the size if tha package n also the color bcuz they dont kno exactly wat they r looking for

    It's just a white priority mail flat rate mailing envelope, about 4" by 6" with a red border across the top and across the bottom and a large square clear plastic window showing my address. I hope they find it for you, Good Luck!!! Came from Corbin KY if that helps?

  13. Usps lost my ead! So I can imagine how u feel! I was soooo looking forward to getting a job right now but now I gotta wait. I mean I got a tracking number n all so that means my package should b well accounted for n they still manage to lose it

    Uugh....USPS. I was tracking my EAD since it was posted on the 13th, due for delivery yesterday. At 3pm, nothing in the mail box, I checked the USPS tracking again and it said delivered 2.30pm....what the!!! After hearing the stories here about lost Greencards I though GREAT, they've lost my card. We live on a farm, so all the mailbox's from other properties are side by side on a larger road at the end of our road. I checked the other boxes but nothing. After about an hour, my daughter who had been helping down at the main farm house arrived with mail in her hand. USPS had delivered my EAD to the wrong house, even though we have very clearly marked numbers on our boxes, but thank God to the main farm house on our property, but really USPS, how hard is it to put a clearly addressed mail item in the right mail box!!!

    I hope all of you out there who are victims of USPS ineptitude get your cards soon!! I think it is unacceptable that we should be excepted to pay for replacement cards and lawyers etc when we are not the ones at fault. I am just so grateful that my story had a happy ending, I hope everyone else's does too!

  14. Got an email on the 7th of June notifying me that my card was in production. Got another email today, exactly the same thing....hmmm. Hopefully this just means it has been sent?? I hope so as I have a new job that I am supposed to start in a few days and I am hoping to get my card soon. Anyone else had this happen to them? How long did it take you to get your card in hand after receiving the "card in production" email?

  15. How do you know that they put the EAD application on hold? As far as I know those applications are processed separately.

    When I received the RFE's, my 3 children received one for their I-485's and I received 1 for my I-485, but in the letter it also referred to my I-765 and it's separate case number and said that until the RFE response review was received, processing for the I-765 would be put on hold. Can't remember the exact wording as I had to send the RFE letter back with the RFE response. So I am hoping that they were satisfied with what was supplied in the RFE and will go ahead and approve my GC too.....fingers crossed!!!

  16. Hi guys, I've just received the email from USCIS saying my EAD is in production....woohoo!!

    on April 19th I received an RFE in regard to the I-485, requesting more evidence to support income and 2012 tax transcript. They put the processing of my EAD on hold until they received the RFE response. We sent in the RFE response, which they received on the 22nd of May, including tax transcripts and 6 months pay stubs and a new employment letter. Is it safe to say that the RFE response was sufficient, given they have now approved the EAD, and that they will approve the GC?

  17. Hello all;

    Today we recieved an RFE for my step son's AOS. We fied all the documents required for the AOS for wife and him together. She has her interview May 9. The RFE says I need to "submit a completed and signed Form I-864" etc, etc. The RFE is addresed to my step son (7 years old). He was included on the RFE that was sent with the AOS package. I had updated that from the originals package with the I129f. I will prepare a new updated package, but I had thought the one sent in with the wife (K1) was all that was reqired? Could they have seperated her and his packages and this is why or should I have sent in two copies, one with each application? i only asking these to make others applications a little easier.

    Yes you should have sent in 2 copies, one for your wife and one for your step-son. Your step son would have needed his own I-864. I have 3 children and was required to send in 4 separate I-485 AOS packages each with their own I-864 and supporting evidence. Each person has their own case, receipt number and alien number. The I-864 you send in will be the same as your wife's. Just send in with the RFE a copy of the I-864 with all the supporting evidence.
