  1. Last I had an interview with the Fiancee but, it was denied through the his lawyer made some error. It had to do with question for the tourist visa with his ex. The consulate made a suggestion that we should get married in his country and then apply for the marriage visa which is much cheaper. So we agree to do but, now he opened a business in his country and he want to stay there with me as husband wife for a few years then apply for the marriage visa. Which I am fine with living in his country for two or three years but, my problem is. The main reason fro the fiancee visa is because I wanted my mother to meet him. My father have security clearance because he is military so he can go to his country to meet him but, my mom do not have a passport. If he go and apply for a tourist visa so come to united states for 2 or 3 days so he can meet my family will that affect the marriage visa that we will apply for. I read where they say you can only apply 3 times. He applied for a tourist with his ex but, the broke up so he just did not got to the consulate. The I apply with him now the tourist vist will make 3 visa. If it is going to be a problem I will just marry him and my mom have to wait but, I really want her to meet him before we married. Can anyone give me advice.

    This quote has nothing to do with her question. Whether she american or indian or indian born. She filed for i130 and now she wants a divorce she just want to know what to do but, the status of citizenship in or out the US do not make any impact on her filing or unfiling for the visa.

  3. Wow that really stinks. Have you explained to your supervisor of the circumstances of why you will need those days off?not sure if your company allows this but even if it means taking those to days as a leave no pay? I know it sucks not to get paid but atleast they may grant it to you? so sorry wish I could be of better help.

    Yeah I told them.. I am new so I do not have any vacation time so that is why I was willing to trade but, they laid off so many people for the christmas bonus that now, he won't let me take off. I do not want to be one of those people that they let go but, I want to be here with my fiance because they said it is suicide if the other one do not attend.. oh my I will contact them and find out about rescheduling because, I will hate to do this all over again, I can't take being away from him much longer.

From what I have read from another member doing this, what the Embassy requested they do is send a notarized letter with their fiance stating why they could not attend and that they would allow for an open interview at a later date. But you have to attend. So I suggest you contact the Embassy right away by email as it will take them 2 business days to get back with you. Too bad they won't let you trade days I sure would trade with ya...LOL...but seriously contact them asap. I would even trying calling as well. Best of luck to you!

  5. So This what's up. When I found out the day of my interview, I went to my supervisor and ask him if I can have that day and day before off and I am schedule 3 days before and two days afterwards off. So all I need is those two days. The day of the interview and the day before. (I work 12 hour shift manufacturing, so you know long hours, less days). He said yes if I can get someone to come in to replace me. (because during the christmas and new year's holiday we can not request days off because the company shut down on the 24, 25,26 and 27.) So I was like cool. I booked my plane, reserved my hotel, reserved a rental and paid for my parking space at the airport. So I got ready to go to work today. I called my fiance to remind him I will see him in two weeks , just because I am excited. I get to work to come and find out the guy that is suppose to cover me those today got fired yesterday and my surpervisor said that I have to work. I asked around seeing if someone will cover me but nothing. So I can call out because he already know and plus it's my job that will be providing the income for my fiance and his kids and myself, I can not just not show up to the interview nor cancel. The worst of them all is that the interview is 10 days away. Can you schedule interviews and if yes, is my reason even a good reason for them to reschedule? How long do I have to wait this time if they do decide to rechudle. I waited so long now.

  6. You don't need the packet to get all of the forms ready. If he does not receive the packet 2 weeks before the interview, he can go to the Consulate and pick it up.

    Okay thanks.. I will go online and fill out the Visa form for him.. I know he have to wait for the packet to do the medical but, how many days in advance do he have to pay the bank for the visa. The interview date is Dec. 11 I am going to his city on the 8th. I was thinking of filling the forms and bringing them with me on the 8th when I get there and he go to Banco Poplar then like the day before the interview (monday) is that enough time to pay for the visa?

  7. You can fill it out for her safe it and email it to her to print out or print out and take it with you for her to sign when you go back for the interview.

    The department of the state gave me my interview date and time but, they have not send my fiance the packet 4 nor have I received the hard copy of the interview date.can I still go online and fill out his DS-156 form or do he have to wait for him to received the official packet?

  8. My husband REFUSED to get the flu shot during his Medical (for K-1) that he had last December. We submitted our AOS app in May, and it's still pending at CSC. UGH I hate worrying about that stupid flu shot! I don't want an RFE cuz of it! I wish he would have just gotten one when he could have for free! :/ :bonk:

    You will not get a RFE for a flu shot. He just have to take the physical. He can get his shots when he come to the united states. It's just much cheaper if he had the shots in his country then the US but, you will be fine. As long as the physical pass.

  9. Hey, I'm in the same situation. My husband just got layed off his job and I have been paying for everything and today he told me he has to pay 350$ at the medical office and I got soo pissed cause Ive been telling him for months to be prepared financially and I can't understand how he had no $$ saved. I've given up soo much for this relationship and my interview is in about 2 weeks but I feel drained-financial and emotionally!! I love him but is it worth it and everyone is soo negative telling me that he'll just come and leave me :( I guess within time well know :)..

    Wow, I feel. I get people saying that too but, I have one good friend she is Dominican and she married an american man. She tell me all the time that all Dominican men are not bad and once he come to the united states things will get better. The only problem I have is I am a workaholic. I work at a manufacturing coming making medical supplies so I work 12 hours a night but, Get a rotation of 3 to 4 days off and my days off I tend to always find myself back at work. Theonly thing she keep saying over and over when he get here try not to work to much because he will start to get lonely and that's when the probvlems happen but, other then she is very supportive.

    What an awesome advice. I totally agree with Todd and Jess. You are not alone. Waiting is really tough, and the more you think about when your petition will be adjudicated, the slower the result. And it will just give you more stress. I've felt the same way with you, but I realized that if it is our time, then it will come. So be positive, relax and enjoy yourself while waiting for your petition to be approved. After all, it will arrive the least you expect. :)

  10. I agree that it's a frustrating experience but I beleive it's also a learning experience.

    The best advice that I can give you is what I do. I try to separate the conversations. So today we might go over the immigration stuff then the next few days are all focused on ourselves. I just listen to her and whenever the conversation strays to immigration then we both remind ourselves that this call is not about that but about us as a couple. Frankly I think too many folks on VJ (well at least in the effects forum) loose sight of that. So try to focus on yourselves once in a while and let the process do its thing.

    Thanks that is some great advice. I really lost focus on things but, I will try to put more focus on the relationship on less on the visa. I do not want to loose him on something so petty.

    u are not alone in this! im in the same situation! i told my fiance the same thing...that the reason we argue so much is because of the long distance thing. and yea, i mean IM the one picking fights mostly too :'(

    but we keep telling each other that the distance is NOT going to win!!!

    just be patient and take it ONE DAY AT A TIME! it helps me out, anyway.

    just remember though, u are not the only one going through this! and u are soooo close!! keep being strong!! i just started MY process and have a long way to go... :/

  11. Oh my I can not wait until we have this interview and we get married because this long distance is straining. When I met him I was laid off my job, so I attend cosmetology school and I work in the salon part time and because I had all this extra time and extra money I was able to him every 3 months and everything was perfect but, then I got a new job and with this new job I am not able to take anytime off because I haven't worked long enough to gain vacation time so, I started seeing him once a year usually in January well, now I moved to a new city close to my job and put in more overtime, trying to prepare for the interview and pay bills, and missing him so much that now I stress more then ever. We argue all the time on the phone. Well, not all the time but, more then we ever have and we say we argue. I really mean I start the argument. He know longer have internet so we are reduce to phone conversations which is very hard because I so use to the webcam chat. With all this I hate what I have become because I feel so alone in this situation. It's only 6 more weeks to go but it feels like a year. Wow, I just wanted to vent that's all. lol.

  12. It's an error. The visa specialist (should know this by now). In Dom. Rep. there is no Packet 3, just Packet 4. You receiving a duplicate packet won't matter much, since it's going to probably arrive after the interview is held ;) Just go to the Embassy's website and read the REQUIRED DOCUMENTS section. It's nearly identical to the packet 4 the beneficiary in Dom. Rep. will receive.

I just got off the phone with the Santo Domingo Consulate and she have received the letter but, she said that I have to wait for Packet 3 that will be sent to me the American resident and that I have to follow the directions before they set an interview date. She said it will take anywhere between 30 days to 90 for the packet to be sent and that I should keep calling once or twice a week for any update. My question is I was told that the Dominican consulate do not send out a packet 3 and I was wondering what do the packet 3 consist of?

  14. The process is a little bit different in the Dominican Republic. They don't have a Packet 3. They schedule the interview right away, then send a letter (Packet 4) with information about what you need to do before the interview and what needs to be brought to the interview.

    Wow really I didn't know that.. I so I call them immediately to see the interview date. I thought I had to wait for the packet 3 before the interview.. hanks..

  16. Thats the standard letter. They do not talk about the intetview. Give NVC time to process your information. Then call them to check if they have issued you a case number. That case number is what you will use in reference to your case when it reaches your consulate.

    Im on my phone so I cant see what country your dealing with, but usually once the consulate reserves your case they will send the beneficary packet three. Which includes the instructions on what is needed for interview. They are the ones that will be sending you communication about interview

    QueenE is right,I have as well received the same noa2 notice wait about 2 weeks and then call NVC to give you the case number.when they finish with

    the case you will get another notice informing you that they have forwarded the case to the Dominican consulate.follow the flow chart for the k1 visas it explains everything. Good luck in your journey.

  17. Okay guys I have another question on this NOA2. Now question is only for people that received their NOA2 and already in the got their K1 Visa. if you have not got the K1 visa please do not reply. I need accurate information.

    I received my second notice of action but, this is very confusing. This letter do not mention the interview at all. Instead it talks about the visa. This is what the letter say:

    The above petition has been approved, and forward to the listed consulate. Please contact the consulate with any questions about visa issuance, or if you would like them to forward the petition to a different consulate. The petitioner can also file form I-824. Application for Action on an approved application or petition to request that we notify another consulate of the petition approval for visa processing purposes. THIS FORM IN NOT A VISA AND MAY NOT BE USED IN PLACE OF A VISA.

    When the person this petition is for enters the U.S. based on this visa, he or she will be admitted for ninety (90) days in order to marry the petitioner, and based

    on that marriage file for adjustment to permanent status on Form I-485. The form to apply for adjustment can be obtained at any local USCIS office or USCIS form center. Please attach a copy of this notice to the adjustment application when you file it.

    If the petitioner and the fiance(e) do not marry within these 90 days, status will expire, and he or she will be in violation of the Immigration and Nationality ACT if he or she does not depart. An extension cannot be granted. It is requested that the petitioner inform his or her local USCIS office if he or she determines that the marriage will not take place within the 90 day period. Please attach a copy of this notice to any correspondent about this case.

    On your NOA2 have the same message on it because my mom read it and it seems like that they sent the application to the consulate and not the NVC and that I may not have to have an interview but, just pay for the visa and the medical and all the stuff that is suppose to pay before coming to the US. I called the NVC and they said they have not received the NOA2. I just want to know if you guys NOA2 was identical to what I have.

  18. Whatever he did its now been processed, sometimes men feels a little nagged or pushed & they tell

    a little lie to avoid more arguments,... he could have lied OK that was not a good thing, but

    what about if he was low on funds or not made up his mind 100% to go thru with this? I would have not

    made a big deal out of this unless I myself is not that sure he's 100% on board, OP should just talk it

    over say," honey I felt uncomfortable even though its a small matter because I dont know if U walked it in

    to speed up the process or U did not follow proper instructions, so from now on just let me have info

    and copies on this journey"....no one can say he lied no one knows.

    I agree with you 100%. Everyone is making an issue or something so small. I was reading the feed back and some of these comments is making matters worse. That is the bad thing about asking questions on forums becuase people never give you a true answer. May be they do not understand the question. A K1 visa is a very expensive visa it's all about money. The foreign visa do not understand because alot time it's the American visa that have to pay all the money. So I gree with you 100%. Like I said previous if she love him then be happy that she got the NOA1 and just wait patiently for the the next phase.

    here's the story.

    my fiance said he submitted our K1 petition in this March 14th (exactly 6 months ago)

    and we didn't get any notification, so I asked him to call USCIS to figure out our case number.

    and he finally recieved the email from them with the case number two weeks ago.

    and when I typed our case number, NOA1 date was Augst 23th!!

    here's my questions.

    1)Did anything like this happened to anyone here? (you applied a long time ago but NOA1 date on the case status was messed up for some reason.)?

    2)what did you do to make it fixed?

    if this kind of things have never happenned to anyone here on this forum,

    I assume my fiance is not telling me the truth about the day he said he submitted...

    I've been waiting for 6 months now and I was so shocked to find out about this recently.

    any reply will be appreciated.

    Usually it talk about 3 weeks to received the NOA1. As for you receiving the NOA1 in August. He may not have send it out the day he toldd you maybe cause financial reason or something and he had to be ready. I do agree he should've told you the truth but If you marrying him out of love then be happy that you received the NOA1. That let you know he did send it. It may not be on the day he told you but he did. So be patient and wait for the next step and do not stress on something like when he send it.
