In theory, the Philippines should not issue you a new passport in your maiden name - if you have an older one since before you were married, that could be used until it expires - but they should ask you upon renewal whether your status changed, in which case you would present your marriage certificate and they would issue you a new passport with your married name. It would probably considered fraud to not report your change in married status.

i beg to dis agree. yes i do have a passport in my maiden before. when i go to chicago and told me that i need to change my maiden last name to my now married last name they wont accept my marriage certificate, and they want me to report my marriage and they need his sign and photo (ex husband), and if i dont report my maiden will be still my last name in PI Passport, if ut is fraud they will for sure tell me what to do. i also put in my post that i will be filing divorce next year, and i dont want to put my self in a no brainer situation. i dont want to get divorce here and need to annulled my married in the PI and that will cost my $3000 if i report my married now just to get my married name in my PI passport, then get a divorce next year and will get back my maiden name again. and i guess we have the right to used whatever name we wanted to used. thanks for the input though...

    I don't give advice.

fact - you can change your name to (almost) any name you wish to use at Naturalization (before oath taking).  You want to go through life using your EX husband's last name that is up to you.  Confused why you aren't doing this when you could be using your maiden name again... and thus all passports and IDs will have the same name, less confusion at immigration when entering or exiting a country .. and so forth.

You marriage was never recorded in the Philippines.. thus no way to use any other name but your maiden name in the Philippines whether it be for a passport or dual citizenship.

thank you for the input. all my ID's, SSN, Credit card are in my Married name. my Philippine passport is the only one that's in my maiden name. and i will be traveling to Philippines this november and be there for 5 moths and i wanted to have a dual citizenship. because they said that if you are US Citizen visiting to Philippines they only give you a very limited time and need to renew your visa all the time while you are there.

    Hello Hank

its me again. you are saying that i can used my maiden name when i am applying for my Philippine Passport?

i will be naturalize this weekend and i do believe that my Naturalization certificate will be in my married name ( technically i am still married, we are separated 8 years, and will going to file divorce soon when i have money). as i am saying i will be naturalized next weekend using my married name (ex. Marilou Garcia Phillips) and this is the name that i am going to used when i applied for US Passport. I will going to applied Dual Citizenship the next day after i naturalize and i wanted to use my Maiden name (Marilou Policarpio Garcia this is the name that's in my passport). Question is, Can i used my maiden name when i applied for Philippine passport? the reason why i ask is i dont to be facing the same problem of my friend who got married using the last name of her first husband in her Certificate of naturalization and in both passport (US and Philippines). and she also reported her 1st marriage in the Philippines. now she is applying for dual citizenship and wanted to used her 2nd husbands last name (divorced the 1st husband and now had a US passport using 2nd husband's last name). they told her that she need to annulled her 1st marriage that is been reported, before they let her have to apply for dual citizenship and have a Philippine Passport.

i really need advice in this situation.

    thanks

Article 370 does not control what name a Filipina can have after marriage. It's only advisory. If you'll notice, Article 370 states: "A married woman may use:" For example, upon marriage, a woman may use her maiden name. Case law has settled this issue.

Also, RA 8239 does not address the issue.

Do you know of anyone who has one legal name in the U.S. and a different legal name in the Philippines?

In my case that is what i am going to do after my Oath taking. take note i am separated in mu US husband for 8 years now not divorce yet but soon will file a divorce, and i filed 5 years in my naturalization.

i will give an example: Marilou Reyes Garcia is my maiden name (Philippine passport as well). Marilou Garcia Phillips is my married name, and also name i am using in my SSN, DL, Green card, Credit card. now at time of my interview IO ask me if i wanted to change my name, and it is because i dont want to go to a process of changing my name to all my ID's i said NO! :bonk: which is that is a No brainer in my part . now my Legal name will be is Marilou Garcia Phillips. and that is the name i am going to used when i apply for US passport. and i will used my Maiden name (marilou Reyes Gracia) when i apply for Philippine passport. and a fellow member here told me that a filipina had a choice either used the husbands last name or keep the maiden name. and if they choose to used their husbands last name they need to Report their marriage to the Philippines so they can used their Husbands last name. and this happen to me 5 years ago when i renew my passport and wanted to used my husbands last name. they told me that i need to have 4 pictures of him and he need to sign the form, but he is not with me anymore so they told me i cannot change my last name and used his last name. the reason why i dont want to report my marriage and used his last name is because i will filing a divorce pretty soon and they said that once you report your marriage to the Philippines and you get divorce here in the US you also need to Annulled the marriage that you reported in the Philippines. this scenario is happening to my friend now.

Yes that is what I am saying.  When you arrive for the oath taking, inform the person that is "organizing" everyone that you need to complete the form to change your name.  How things are done seems to vary by location so I have found.  For my wife we were all directed to a room to wait (she did the oath taking at a courthouse, some do this at a USCIS office), there was an attorney there that "represents everyone" and she instructed everyone that if ANYONE wants to complete a name change to come up and get a form to complete so the certificate can be printed in your new name.

This is the last moment to do a name change for naturalization .. for free.  ;)

that is good to know. i dont know if i check the box or not. but if i did then i will just going to get a philippine passport to my maiden name. thank you so much for the input

  6. 20 minutes ago, Hank_ said:

Yes you can change your name to your maiden name for Naturalization... if you did not check the box on the N-400, already completed the interview, then make sure to mention your name change at the oath ceremony BEFORE.

are you saying that i can still tell them that i want yo change my married name into my maiden name before the oath taking? i will do that. but i thought having a name change take a lot of time.

oh that will be great then. so i can used my maiden name when i get my Philippine passport. i will be naturalize hoping this weekend. i might going to used my married name when i apply for US passport. :bonk: crazy me i should changes my name into my maiden name when i apply  N400 but it is too late know. oh well. but i am happy to know that i can used my maiden name in my Philippine passport. thank you

  8. 3 minutes ago, Hank_ said:

Did you complete Report of Marriage?   What name is shown in your current passport?

i didnt report our marriage, it is because i didnt know that we need to report our marriage, until now that i will going to have  dual citizenship. i dont know if i need to report my marriage so i can used his name which i will apply for divorce in the future anyways or should i used my maiden name, and i dont know if Philippines consulate will let me.

i did not report our marriage

the name that is shown in my current philippines passport is still my maiden name

I think the correct answer is that you get to choose which one you use. On the Bureau of Immigration Philippines web page there is a section on dual citizenship. One of the notes under procedures and document says "(Note: applicants who are married and who wish to use their married names must submit a copy of their marriage certificate).

    http://immigration.gov.ph/?option=com_content&task=view&id=163&Itemid=83

SO in my situation i will get naturalize probably next week with my now legal name. and when i apply for my dual citizenship and file d a philippine passport do i have a choice if i can keep my maiden name or use my legal name? it is my fault not to change my name in N400 process ( where i should know better, but not). by the way i applied 5 years in N400 (petitioning myself)  i am seperated to my ex husband (not divorce yet) for 8 years and  i will going to to philippines with my daughter this year and would like to have a dual citizenship before we go there. so is it possible to apply philippine passport under my Maiden name or used my legal name (which is still under my ex husbands name). please help

  10. i need help in here. as i wanted to thank everyone in here for helping me during my naturalization process. my question is can i have 2 different name? (US passport and Philippine passport). when i apply for my N400 i didnt do any name change which is for example. Linda Garcia Smith (married name) and i used that name in my GC, DL, SSN, CREDIT CARD and i used my maiden name for ex.  Linda Policarpio Garcia ( maiden name) and i used this in my Philippine passport. Now i will have my Oath taking soon and it is on my married name. and i will for sure going to have a Dual citizen ( US and Philippine) my question is can i used my married name when getting my US passport and use ny maiden name when i am getting my Philippine passport. please help i would like to travel in the philippines this november

    thanks

Hi all, just found the Chicago thread. My wife filed online (since that's now an option) in July 2017, with ROC still pending (since August 2016).

For biometrics, we learned that the Broadway service center recently closed (boo! It was super close, just a couple of stops on the L, whereas the Norridge one is a PITA to get to on public transit). Yesterday, Sept 28, she already got notified that an interview has been scheduled, and that a PDF with the interview date should be showing up in the online portal soon. Given the backlog for N-400 cases in Chicago, this seems way too good to be true, and we'll believe it when we see it... Good luck to all who are processing through the Chicago office.

just got update from ELIS myaccount that they already mail my Oath taking notice. after 150+ days i finally see the light in the tunnel. hope you  guys will have a speedy processing. goodluck!

I thought you could file suit after 120 days past your interview if you hadn't heard anything?  Have you tried info pass appointment?

i did schedule my info pass and that is going to be this wednesday (Oct 3) i hope they will give me a good news (answer). ive been patiently waiting and trying to understand them. contacted my congressman's representative and he contacted them already. hope hearing from them soon

So if @GoChicago as a late Frb filer , seems to be the last person we have a record of being interviewed , what is going on? I know we aren't the only people waiting in Chicago but has it all stalled? It seems crazy that there seems to be nothing since late Feb!

@Heidy1980 I would definitely get legal advice or speak to your congress representative

i already contacted my congresman's legal representative and he called them yesterday. he send me a message today and he is still waiting for them for the inquiry he made. i hope i will hear anything from them this week. i am still crossing my finger and still waiting patiently.

Going by our monthly threads it seems like there is a slow down again in progress.

It was running at about 6.5 months to now but between Feb and March filers it's seemed to have slowed down (or people just haven't updated yet) .

Im a May filer and was just hopefully that I'd be done by year end but I'm starting to doubt that. Anyone else from Chicago feeling frustrated or have any positive stories other that what I'm seeing here? I've a terminally ill family member back in Europe , and when I requested an expedite I was declined.

Chicago Filed Office Filer here, and i cannot call my story a positive story. i will right my timeline so you have an idea how slow they are. (chicago filed office)

I would just be happy to get an interview...  I am coming up on 13 months since my filing, and no notice.  I am sure there will be some wait for the oath as well.

So much for the 120 day rule, or is that just for the approval/deny after the interview?

Best of luck, you are almost there.

its been so long for your interview. i got my interview date last May 2, 206. i filed n400 last August. where is your field office? did you make an Info Pass? or try to call your congressman or senator they might going to speed up your case. hope you will something from them soon.

I think you're right. I just made an infopass appointment for the 120 day mark (in a few days). Hopefully it resolves this. I was just wondering if anyone else had a similar experience.

    May 2, 2017 - Interview

May 5, 2017 - updated my status to be scheduled for my oath Ceremony

September 13, 2017 - still no oath taking notice, called USCIS and talk to Tier 2 didnt get any answer from them. all he said that , he saw that they approved my application but didnt see ant date and time for my Oath taking, advice me to make info pass to ask them what is going on in my case.

really...? i wanted to make an info pass appointment since i reached the 90 days but they told me to wait for 120 days because within that time they will update my case. now it is been passed 120 days it is been 128 days to be exact and they still can give me a proper answer... so tired of waiting on them. i will going to write my senator a letter so they can process my case

  21. 15 hours ago, CookieCat said:

Your status message "We placed you in line for your oath ceremony..." is pretty straightforward... It means you are in queue to be scheduled for an oath date but USCIS has not actually scheduled a date yet.

Once your oath date becomes scheduled, you will receive another message that says "Oath Ceremony Notice Was Mailed. We sent you a notice..." THat's when you should expect a notice in your mailbox with a date. So for now, there is nothing for you to do but wait.

    Good luck and congrats!

Thank you very much... i also keep checking my account in USCIS just in case they mailed it already, because most of the time our mail lady put our mail to my neighbors mail box. i am just going to wait for the notice in our mailbox... hope it is sooner because i have a plan to go to my country on July

  22. I just wanted to ask if anybody here has the same status like mine.

May 2, 2017 (citizenship interview) IO told me that they cannot make a decision regarding my application that time.

May 5, 2017 Check my status online and they change my status to "My Oath Ceremony will be Scheduled"  we placed you in line for your oath ceremony and will send you a notice for Receipt # IOE********* with the date, time and location of your oath ceremony. you should receive your notice within 30 days of its mailing date. please follow the instruction in the notice. if you move, go to www.uscis.gov/addresschange to give us your new mailing address. and check My.uscis.gov and my Current status that's been updated at the same date is " we approved your application" final step to becoming a citizen is to attend your naturalization ceremony, we will mail you a letter when we schedule your naturalization ceremony.

Until now (5-26-17) i still didn't receive a notice for my Oath taking from them regarding my oath taking date. call the 1-800 and talk to a customer rep and they giving me the same updated that i seen when i am checking my status. what should i do? any input and advice will help.

    thank you
