So my husband just recently got approved for his EAD about a week ago and since then I've gotten 3 emails with the 3rd saying it now has been mailed. My concern is that usually by looking at other's timelines, the AP and EAD usually get approved at the same time.... Has anyone had this happen where thier EAD get's approved but not the AP? the AP hasn't even been touched at this point.

the whole K-1 Visa process took us some 11 months by the time he was here.... just a heads up! and by the way it looks like they are taking about 8 months just to approve the petition... :|. just a thought.

To all.
Due to some circumstances that have changed here in Aus and that I have my Visa to enter the US, how long do I need to be in the US for until I can leave back to Australia with the necessary documents such as green card & SSN. If anyone can help with this would be great. Thanks Wolf

Hi guys, I'm confused? Do I need to send in with my DS-156K the originals and photocopies of my Birth certificate, evidence of financial support, police certificates, evidence of your engagement or do I just bring them with me to the interview and send in the check list with everything ticked?
As TAS said, they usually request that info with PACKET3 and when you send in packet 3, make sure it's originals and photocopies. Basically read the directions carefully so you won't get it back or delay your process.

Yes definetly sucks financially....... I'd say for driver's license i'd go to your states website for it and see if maybe anyother documentation can be used to apply for the driver's license.
When I was reading for the state of texas, I believe I read that if you applied for AOS you can...

Applicants for adjustment of status
Immigration documentation with an alien number or I-94 number
This can include but is not limited to a form I-797 indicating pending I-485 or pending application for adjustment of status.
so for texas with the i-797 pending for AOS can still apply for a drivers license... Hopefully they allow it in your state!!

So.... I'm trying to get some answer's and clarification. I've googled and gotten answer's but just tripple checking now.
1. Can the Australian Citizen's Super be withdrawn once they move the country permnanently?
2. Can the Super be transferred to a 401k if unable to withdraw?
3. Is there any way these funds can be withdrawn without reaching the retirement age?
Any answer's and feedback would be greatly appreciated!!!

We are applying for AOS and I had a question? Do we need to submit the I-765WS Worksheet? or can we just the form I-765 without it?

Don't worry about the expiration of the I-94. You are required to get married within 90 days of your arrival to the USA ie before the I-94 expires. You are not required to adjust status before the expiration of your I-94. It is best to submit your AOS paperwork as soon as possible, but some people don't do it for months. It is best to get the AOS started before your medical is 12 months old though, as this would require you to re do the medical here. I arrived 12/30/2012. Got married 03/12/2013 and sent off the AOS paperwork first week of April....my I-94 expired on 03/29/2013. One thing I would do now, if you haven't already, is apply for your SSN, as this needs to be done at least 2 weeks before your I- 94 expires. I was able to go down to my SS office and apply in person, I received my card just a few days after that. If you don't do it before your I-94 expires, you will be unable to apply for one until you get your GC as until then you are considered out of status and not eligible for a SSN. You don't need to apply to extend his stay....you have plenty of time
Hopefully your Dr will be happy to send you the DS-3025, I'm not positive, but I am guessing that USCIS may want an original one. If the Dr sends it from Australia, post is usually around 9-10 days.
Sorry just to cut into the subject now that you mentioned the SS card..... you were already married when you applied? did they give you any hassels?

Sooo.... I'm hoping someone can help me here.
My Husband entered the US on 02/24/13 on the K1 visa and we wed on 03/08/13. We went to the social security office on the 11th and they told him they couldn't issue him a social security card because the system wouldn't allow them to and that the I-94 was going to expire March 24th...(which didn't make sense to me because i thought it was good for 90 days and the i-94 has a date of may24) and she gave us a number to homeland security to call them and saying we needed to adjust his status before he can get his social security.
Oh and adding to the lady, she also stated because we got married that also affects him getting a social security.
So i figured it was the lady and we didn't think to escalate to a supervisor at the time because we were starving and just wanted to get out of there.
But yesterday I figured to go to the driver's license office to at least get him a permit and to test for the knowledgeable part for his driver's license and everything was going good til the lady said that the system which is tied to ICS (i believe that's what she said) did not allow for her to proceed and said that after a 2nd attempt it was sent to thier head office in Austin and that we would later recieve a letter and then he'd be able to apply for the driver's license.
This is all so frustrating.... Has anyone else had this issue and if you did what was done to correct it?
HELP!! I'm getting so frustrated.

When I picked up my marriage licence Yesterday, she stated I would need certified copies for his paperwork... so I'm assuming you will need them to be certified.

you're probably thinking of Advance Parole which is the I-131, to file AOS it's the I-485; usually you'll file the I-131 with as well if you plan on working the I-765 together with the I-485.
I think the question is.... would you need to file the I-485 for all four of you?

I'm currently looking up flight for my fiance and before we booked we wanted to make sure we have enough time to go from POE to his next flight.... I'm a little nervous as I'm seeing the longest layover is about 2 hours or so.....
Can I please get feedback regarding how long it took you to enter the country going thru customs on the K1 visa?

So per the CEAC website our visa has been printed and issued since February 11th........ But hey have yet to mail it!!! It's been 3 days since we have been waiting! What's the deal with them taking so long........ losing my patience........ this process has gone long enough why can't they just get their act together......

Oh, what kind of Visa did you apply for?
I don't think the consulate will issue a visa til they have all the required documentation they needed and then they still have to process it to make sure they have everything you needed. Definetly would not book a flight... We got held back for a birth certificate and we are showing they have recieved it.. but no word from the consulate as of yet and i definetly don't want us to book til that visa is in hand

I emailed the embassy as it had been more than 5 working days since our interview and I hadn't heard anything about our passports. They informed me that we were in AP

Wow I've got to say this whole experience was very long, but now my Husband's AOS has finally been approved in just a little over 4 months!!
No more waiting for now!
On a side note!! We are also expecting our first child!!!
