Just an update: I received an email from the USCIS today, 2 days after my AOS interview.
On May 24, 2012, we mailed you a notice that we had registered this customer's new permanent resident status.
Great, were approved! :dance:

Going straight to your questions...
1. Yes you do need to send a copy of your spouses proof of US citizenship which could be either the bio data page of her passport or a copy of her birth certificate.
2. You only need to send one copy of marriage certificate. That should do for all.
3. I would suggest that you make photocopies of every page of your passport including the bio data page and also send just a photocopy of your I-94... This info is in accordance to the instructions.
4. No! Make sure all the supporting documents you send are copies. This is because you still have to take with you to your interview the originals of everything that you might have sent with your AOS package. So don't send originals of anything!
5. I don't think you have to notarize anything except if you are sending affidavits from people attesting to knowing that your relationship/marriage is real... then they it they have to notarize it.
6. Either way works but from personal experience and reading about other Vj members' experience, I'd suggest you send a check.
7. Now I'm not sure about the cover letter but I would think that send just one cover letter detailing everything that's in the package would be enough. It's gonna be one package at the end of the day.
8. If you tick status as a permanent resident or tick other and type in AOS, I for one think it's still gonna be the same. You are apply to change your non-immigrant status to that of an LPR so I'd say tick the permanent resident. That was what I ticked I don't recollect having any issues about it till date.
9. Yes you will be able to apply for a license once you receive your EAD after approval. EAD's usually get's approved and received say in between 60-90 after filing. So with that you can go to your loval DMV.
10. Yes. Look at the instructions for the proof of relationship that is required of you to send alongside your package and also send anything else you can come up with that proves your relationship is a bonafide one. So yes, send proofs, whatever it is that you can.

I spoke with an attorney and he gave me some advice. I'm not sure if he's blowing steam in order to get money from me but this is basically the scenario he laid out:
I would have to voluntarily return to my home country and apply for a non-immigrant k3 visa. He said that my false claims to citizenship will be eligible for a waiver since I am now applying for entry into the country a s a non immigrant.
How probably is this?

Of course he is blowing your steam. The truth of the matter is that there is no waiver for false claim to US citizenship unless you can get a presidential pardon or from the entire congress I think. No two ways or short cut to it. But if you have the money to spare and you just wanna give him some, it's up to you. I'd say you ditch him asap. I'm sorry for this situation.

The fact is that, you can't work without permission anymore especially now that you've filed. It will be illegal for you to begin working now and the company could also get in a lotta trouble with the government. Like someone said, see if they can make a written job offer to you then try to see if USCIS can expedite your EAD... hopefully they are able to expedite it for you so you don't miss this job opportunity.

You need to calm down first my brother, there's always a solution as long there's life. Like someone said earlier, you shouldn't have any problem applying for a new passport with your country's consulate without any problem with immigration or whomsoever.
Secondly, after you get your passport, there is a form on the USCIS.gov website that you can file to request your original I-94. You pay the fees and once that is done... there shouldn't be any problem with filing your paperwork because marriage to a USC forgives being "out of status or rather overstays."

From my understanding, I think she is entitled to apply for SSN being that she came in with a K1 visa. It seems like if one comes in on a K1 visa, you could apply for it after 2 weeks of arrival, that way DHS would have updated their system to show that the person is here legally at least for 90 days.
So take your wife to SSA with her passport, I-94 and marriage certificate. It shouldn't be a problem. After applying, you should get the card in the mail in between 4-6 days. Good luck with the kids!

Good news to share!!!!! I got the approved at the interview.
We had about 10 mins for the interview. We arrived there 30mins and waited to be called and the IO asked first question about my cancelled work authorization which I totally forgot that I did it and did not pursue for the visa so it got denied but he did not really wanna know the answer so he kept asking about how we met, my passort, my husband stuff, and asked if we know the 2 year condition, in the first 5 mins and he asked where we live, how much is the appt, and stuff.
I was kinda disappointed that I did not get the stamp on my passport b/c I told him, hope to go to Canada for this long weekend but he said it might be risky to come back with no GC, just wait, it might take 7 days only. And he said "congratulations" and will update status in the afternoon, as he showed us he had so many cases waiting for him and he wanted to make no mistakes input all the important info, very cautious one.
I think we had a nice interview, although I was so so nervous and couldn't put words together

Good Afternoon all..
quick question if i was too supprise my finacee with getting married on the spur of the moment while im visiting her in pennsylvania can i legally get married ive seen so many things saying i need a SSN but im from the UK so i don't have one any idea's or suggestions please?

First to answer your question... yes you can marry without a license. You just need to check online with the county's requirement. For the most part, your passport is all that will be required of you.
Lastly and most importantly, it already seems like you have the intent to apply for AOS once you are married here, now that's doable but just like someone said earlier... it will be looked on as visa fraud because of your intent. Now we here are not one to tell you what to do and what not, but in the long run, the burden to prove that you didn't have the intent would be on you when you do apply for AOS here after marriage. Which from all indication, that seems like what you intend to do.

Looks like our interviews are exactly one week apart, mine is three weeks from today and I am also going through the nervous motions of re-checking my interview file and even went down to the local IRS office with my joint sponsor to get the 2011 transcripts in hand.
Think we have everything in order documentation wise, just need to relax and hope I dont screw up my wife's date of birth on the day

The USPS reported that they picked up mail from USCIS containing your new card on May 21, 2012. You should receive your new card within 7 days. If you do not, or if you move before you get it, please call our customer service at 1-800-375-5283.
EAD mailed. Now sitting tight and waiting for interview notice and date. Best wishes to everyone with their respective interviews.

It has been so frustrated, hasn't it? Again, thanks for your help! My husband and I are going to call USCIS on next Monday.
Hopefully they will have some sort of good news for you guys. I totally understand your frustration and how fast things like this tends to make "HOPE" depreciate and if there is one thing I have come to realize about this whole process... that would be the fact that we only have "HOPE." When you lost that, there seem to be so little to carry us on.

Part of the reason why they require everyone to do the biometrics is to determine things like this. Like others have said, the paper trail seems endless and I doubt it'll be hard for them to pick it up which is a "no, no" for you. Sorry about this, but it's beyond VJ so to speak.

Like someone said, patience... especially since you felt it all went well. From what I've read and heard, not everyone gets approved on the spot, so no need to panic or think the worst. Just think positive and pray if you can. All the best!

I know right. All along I thought the rfe would delay the EAD but it just proves to me now that rfe's don't cause I was surprised they approved me at the right time the timeline states predicted despite the rfe. Now I just have to wait for my interview letter which shouldn't be far ahead before they schedule me, I hope. Thank you pasportit.

If I were you, I'd wanna make sure I didn't check that I am a US citizen on any past and previous I-9 forms especially being that you might have thought you were cause you have an SSN. Cause if by any chance even if it was unknowingly, you checked that... then there's gonna be lots of problem ahead of you.

It was for both my petitioners 2011 taxes and also that of the joint sponsor. I have since responded to it though. I should be grateful that my EAD has been approved and soon to be in my hands for the time being. Thank you!

We applied the same day Too bad we are not in the same state, that would be too funny.
It almost seems like you and I applied on the same day also, but I got an RFE.
