  1. The process is going great so far, but we received a RFE today (request for evidence). They want a copy of my father's (the co-sponsor) birth certificate, a copy of my 2012 taxes, and documentation that my husband legally entered the USA. He came in on the Visa Waiver and did NOT receive an I-94. What is it that we can give them to prove he entered legally?? We gave them the page stamped with his entry stamp, should we give them another copy?? Also I filed my 2012 taxes as single, even though I was married half the year BECAUSE I filed online and they told me I HAD to give my husbands SSN, (which obviously he doesnt have one). This shouldnt hurt our case right?? Maybe get me in trouble (I HOPE NOT).

    Anyone got any answers???

  2. It's possible, but very rare, that an EAD is approved before biometrics. If your case says card production though, I'd have to assume that you're one of the lucky few. Let's wait and see :)

    Yay! So on top of that, our I485 says request for additional evidence was mailed to us on the 9th. That's not the letter we got yesterday for his biometrics is it? What could they possibly be asking for? Lol

  4. Hey there. Adjusting status from visitor to immigrant and I have a few questions:

    1. Can I file the packet for the I-130 and I-485 together?? Like can you combine the packets?? for example, Both require a marriage certificate. Can I just include ONE certified marriage certificate. Same with any other duplicate required documents.

    2. How much of each of the passports do we need to include?? I mean should I be photocopying BOTH of our full passports? Seems like an awful waste of paper!

    3. People have told us a MILLION times but i'm hoping to hear it from someone OTHER then the person who usually answers. He has overstayed ALMOST a year. We were married (unplanned; have proof it was unplanned) before his Visa Waiver expired. WHAT WE'VE HEARD is since i'm a born American citizen and therefore he my spouse, overstay will be forgiven. Which makes sense but I just wanted to check.

    4. Last but not least, What are recommended things to include in the packet as "additional proof of bona fide marriage"? Suggestions?

    We are finally DAYS away from sending completed AOS packages with physical et al. He is currently 7 months overstayed on his visa waiver, due to needing to save up the funds however, we had eloped before his Visa Waiver expired. We have been told by the VJ community time and time again that overstay is forgiven for spouses of US citizens, is this still the case?? We just want to make sure before potentially wasting this money. No, he did not come over with plans to stay, in fact that has become much a problem as far as obtaining documents he never thought he'd need. But that is neither here, nor there.

    Will his overstay effect his eligibility? once again we are married, we were married before his VW expired. just been slowly putting the package together.

  6. We are totally confused on the I-485. Is the Information about you, supposed to be about me ( the US citizen) or about him (the foreign spouse)

    Also on part 2, none of the answers seem to fit on why we are applying for adjustment of status. He came here on a visa waiver, we eloped, is the answer B? My spouse applied for Adjustment of status?? Or is it other basis of eligibility??

  7. We're finally ready to put in his papers and as we're reading through the checklist we see the I-693 form. I thought that was what the bio-metrics fee was, that they would tell us a physician to see for his physical. Am I wrong?? Does he need to have a physical which gets that form filled??

    Also the I-485 says we need two passport type photos in the package. We paid for him to have two done for the I-130 which only asks for one. Will we be safe if we just send in the one other one or do we have to get more so he can have just one more. Can we make copies??

  8. Just wondering, My spouse is NEARLY 6 months overstay because we haven't been able to save up enough to put in his papers. Do we have any options? Should we be worried about what might happen???

    Its a horrible cycle because we need his papers put in so he can work, BUT I only make enough to cover our bills, food, rent etc.

    Really winds me up that people who have tons of money just marry people to give them papers but two people who are really a great, functional and productive couple but have a minimal income AT THIS TIME would have so much trouble.

    Loans arent an option cause I messed up my credit when I was young and family have all said no.

    Not looking for handouts, just wondering if we have any options as far as him getting work or anything.

  9. Okay, so. The deal is this. We met two years ago while I was on a vacation to Scotland, we liked each other, then eventually fell in love and continued our romantic correspondence after I came home to the US. In Jan of 2012, he came over to visit for a month or two but by the time his plane ticket was due, we decided we just couldnt be apart anymore and we eloped at our city hall. For the most part, its been lovely, exciting and reviving. We're both college (age) students, who have degrees to complete. I have taken off time from mine to establish a home with him and he's away from his because he essentially has now moved here. Was it impulsive, yes, but we've not regretted it yet. Except for in one area. This whole AOS process is REALLY starting to look like its expensive. Like REALLY expensive. I recently lost my job and most of our money saved has been spent paying bills, Still looking for a job and will be returning to classes in about a month. But just out of real curiosity:

    As two young adults who are poor college students, one who is willing but not legal to work, how painful is this process going to be??? I mean give it to me straight. Its so dang annoying to see loads of people posting on here about how they have had spouse fraud and such and two people who are really in love can even pay the processing fees for his AOS.

    Feels so hopeless!

  10. Right, I have a bit of a quandry. We're at the point now where everything is filled out and ready to go....except the check. This whole process has been a massive struggle. We're two twenty somethings who met abroad, fell in love, eloped on a trip he had made over (unplanned mind you) and now we want to ensure that nothing will cause us to have to be apart. HERE'S THE PROBLEM, I recently lost my job so the savings we accrued has all been just about spent in paying bills, one unemployed person, plus one person that isnt legal to work = lots and lots of bills. We're both willing and ready to work, and in no way want to live off the government, but my guess is (as i'm a student and have no formal qualifications yet), that any money I make will still not be sufficient to pay the 1495.00 fee that needs to accompany his papers. We've been married 5 months now and we're still happily in love, but he's going insane because he cant contribute to our household or attend university and i'm going insane cause all this pressure is on my shoulders:

    HERE'S THE QUESTION IN ALL OF THIS:

    Are there any agencies, or places that could potentially help us with the fees for his papers? I know it sounds like a long shot but I thought maybe someone might have a broader perspective then me. Loans are out of the question because I totally messed up my credit when I was in my late teens/early twenties, (its crazy how your parents are right about your money decisions following you every where >.<). Other then hand outs (which feel really horrible) do we have any other options?? Are we just doomed to be stuck like this till I can manage to get a job and save up in 10 dollar increments??? Any suggestions?? Any and all advice is appreciated.

    You SHOULD file the I-130 with everything else. Do I have fees for any of the forms other then the I-485 (plus biometric)and the I-130???

    No, your total fees are $1,070.00 for the I-485 (includes the $85.00 biometric fee) plus the $420.00 I-130 fee = $1,490.00. Separate checks should be written for these.
