    So, this wasn't just a big fight that she's overreacting to? You believe the relationship is definitely over?
    Someone will correct me if I'm wrong, but I think you won't need to do anything with your greencard until it's time to remove conditions. Then you'll go to the interview alone, with your evidence that it was a real marriage, and explain that you got divorced.
    It's up to you whether or not you go after her for the blackmail. That's a tough one. I don't have much sympathy for her, but then I'm not the one who was married to her.

    There are some errors in terminology here. You don't have 30 days to file to become a "permanent citizen". You have a conditional resident green card. If that green card expires in 30 days then you have that much time to file an I-751 to get the conditions removed, and get a 10 year unconditional green card. You are not eligible to become a citizen yet. It's critically important that you understand this. If you mistakenly represent yourself to any government official as a citizen, even though you actually MEANT you were a permanent resident, then you could be deported and barred from returning to the US for the rest of your life.
    You must file the I-751 before your green card expires. If you don't then your resident status will be terminated, and they may begin removal proceedings against you. If you are still married then you must file the I-751 jointly with your wife. You must also include evidence that your marriage is bona fide. Joint tax returns are only the beginning. Please have a look at the "Removal of Conditions" sub-forum. Everything you need to know is in the pinned threads.
    Understand that you take a risk filing a joint I-751 if your marriage is on the rocks. If USCIS discovers this then they'll deny your removal of conditions. You can apply for a waiver of the joint filing requirement if your marriage ends in divorce. You must still provide evidence that you entered the marriage in good faith, and you'll also need the divorce decree. You can file the I-751 without the divorce decree. You'll get an RFE for the divorce decree several months from now. If you still don't have the divorce decree, and don't provide it in response to the RFE, then USCIS will initiate removal proceedings. You can ask the immigration judge to grant a stay while you wait for the divorce to be final. The judge almost always approves those requests.
    If your marriage has collapsed then you would be better off filing for a divorce now, and submitting the I-751 on your own with a request for a waiver of the joint filing requirement.

    Hey Carlos. I am filing for my wife in Colombia also so I can help you out with my personal experience. This doesn't mean we will have the same exact results but it helps to have estimates in my opinion.
    1. Can I e-mail the DS-3032 choice of agent after there is a case number or again wait for instructions by mail? Can this be done by email for all instructions to be sent to you?
    After you call NVC and they give you your new case# BGT2012XXXXXX also ask for the Invoice Identification Number. This "IIN" will be used to log into the Department of State payment portal website to pay your fees here https://ceac.state.gov/CTRAC/Invoice/signon.aspx
    The same day you receive your NVC case# your wife (beneficiary) should e-mail the template found here http://www.visajourney.com/wiki/index.php/Email_DS-3032_form to NVCInquiry@state.gov
    She should receive an automated-generated e-mail indicating they have received it, this will take some days for it to clear until they check her e-mail message and tie it to the case in their system. When you log into the the DoS payment portal and see IV fee invoiced that means they have accepted her DS-3032 and u can pay the IV fee and send off the IV packet.
    2. Do you wait for the AOS bill to come in the mail or I can simply pay it online?
    After my case# was given the AOS bill (@ DoS payment portal website) was invoiced the following week (4 days later) then I paid it. It's best u login daily to see when it's invoiced. (You may see error messages that is normal).
    If you wait for them to notify you it will prolong this process tremendously.
    3. Once the AOS shows PAID online do I send the I-864 packet or again do I wait for instructions by mail? The same thing with the DS-230 fee and packet?
    Yes, once the DoS payment portal shows PAID mail your packet. At this website you will be able to print the Cover Sheet that is mandatory to be the first page for your Affidavit of Support (AoS) packet.
    4. If you don't receive anything do you simply call them to find out what is happening?
    After you send your AoS packet you want to start calling NVC to find out if they accepted it, the same goes with the IV (Immigration application) packet, and then again to find out the interview date once your case is complete at NVC.

    Received our "CASE COMPLETE" email this morning!......finally!
    I called the NVC and they said appointment date hasn't been set yet and they only schedule in the second week of the month for the following month (big lie LOL).....Getting real close now!

    If you are doing a I-130 for your spouse, i assume you are married, you will not need to translate these documents for the NVC stage, only for the USCIS. once complete at NVC they will forward your documents to Bogota for completion at the embassy and they accept spanish documents. the comment by the previous post about adjustment of status would not apply if you are doing a Cr1 type visa. hence you would be ok. hope this hels.

    It takes about 3 days for the case to arrive at the embassy. So send them an email on Friday or Monday of next week to find out if they have it. If they do, they will send you the K Visa Instructions Package via email. Just follow the instructions on how to register on the link provided, pick your DHL destination, pay for the visa and pick your interview date. If you hurry, you might be able to make your appointment for August.

    I want to move to the US but realise that it is not a matter of "get up and go".
    I understand that the couple of ways to get a visa is either to get married to someone in the US and move there (obviously a proper devoted marriage) or to work for a US company who will sponser you and move you over.
    however for me, both options are not possible.
    I have no criminal record of any kind and are self employed in IT. I also have a US B1/B2 Visa (a business and visitor visa).
    I am wanting to change my life and move away from where I am and would rather move to the US.
    What things are possible for me to do this? Any suggestions or advice are welcome!

    Hi.
    if one wants to give up their UK citizenship (they were born and bred in the UK), then is it possible to gain for a US citizenship or would the same principals apply where you can only get a visa if a company employs you or you get married etc... ?

    I currently live in the UK. I am wanting to move to the US for many reasons. The main being my line of work (in IT)I am wondering, is it possible for me to get a visa and migrate over taking my business with me? if so - what is the process? Anyone know where I stand on this? Like I said, I want to move myself and my company over to the US and continue doing what I do with the business but in US.
    And when that post did not get the answers....

    for a K1 - how does it work? I mean from what I understand the person in the US would file for this. So what do they file? What sort of details are on the form they need to fill in?
    what if the DOB is entered differently than the actual DOB? just the years having a mistake?
    does age difference matter? she is older than me - around 10 years.
    lets just say that she thinks im 2 years older than my DOB. but i think we all do that when you are dating.... ( you bad boy )

    Today ~
    So I have a US girlfriend. we plan to marry at some point. Obviously means I would move over/immigrate to the US.
    The bonus is, I dont need to apply for a K1 visa. I can get married on my curent B1/B2 visa then the girlfriend can file for the immigration thing/sponser. I can still continue to travel back and fourth which is ideal for me.

    I dont get why I cannot ask legitimate questions here. after all this is an open forum and it is meant to be a helpful community, not this kind of negitive and false accusation community.

    Me being a member of VJ and pointing out that your story comes off questionable does not rock the state of the world.
    I wonder why i bother anymore. I have nothing to hide so really, it is not my fault if you have issues. go sort them out

    To the OP:
    Firstly, for your own benefit, I suggest that you re-evaluate your perceptions of the responses given here. I can absolutely assure you that the overwhelming majority of members here are posting with the intent to either; help or seek help... that deserves respect in its own right and posts should be taken at face value; if you don't agree or take issue with something said, ignore or respond civilly - I don't think a retaliation or 'in-your-face' type thread like this one is very intelligent (particularly considering how premature your case is).
    Secondly, it would also pay to re-evaluate your mannerism and approach, not only in this forum, but in relation to seeking a US visa... FACT: the tone/attitude you convey in your posts is producing negative sentiment. It doesn't matter if this sentiment is just or unjust, the fact remains your approach isn't very constructive on these forums and is a pretty good indicator that you'll have bigger issues in working through a US visa application.
    My final suggestion? Tread softly mate... and before you develop some sentiment about what I've posted, just take a deep breath, clear the mind and take my opinions objectively... humble pie sucks but it can be very nourishing when eaten appropriately.

    I disagree. Reading this thread without having seen the others, I assumed OP was a typical fiancee anxious about his petition, and had actually encountered "doomsaying" from VJ members based on his conviction. Poor OP, I sympathize. However, after reading the compilation posted by "Columbo" my opinion changed - OP wants to get to the US by any means he can find and feels he has found a way to use the girlfriend to do so. Now I don't feel bad for the OP. I just feel bad for the girlfriend.
    OP didn't say "I'm in love and want to be with her at some point no matter what it takes" (like most of us). Rather, OP said he wanted to get to the US for his job, and because he was unhappy with his life in the UK. Now he sees a way to use his girlfriend to make it happen. It was "Columbo's" post that made this clear. So yeah, he did prove something.

    I don't really think anyone is judging the OP based on the conviction. They are basing it off of things the OP has said in previous and this thread regarding his immigration intentions.
