  1. hi All,

Out of curiosity I run some numbers:

My prediction is that Athenia's Aug 2011 PD will be current by this time next year

-assumption: 15 months PD movement in the coming 12 calendar months

VSC current processing time: 16 months, so her case will be passed on to NVC around January 2013.

NVC will take about 4-6 months to complete case, so let's take on average 5 months.

    Case completed estimate: June 2013.

Her case after completion will be forwarded to the embassy for interview appointment in 4 weeks.

And...using the same logic, I can see all service centers heading to the same direction. I have a funny feeling that they are working on cutting out excess wait time between NVC completion and interview appointment date.

    My own case would be

    PD Dec 2011

    Estimated interview date Nov 2013

Estimated NOA2 from CSC Oct 2012

    Estimated NVC completion Mar 2013

So I would still have quite some time to wait...

I will revisit this post in 6 months to see how well this worked out.

  2. hi

Household size is defined as: include yourself and your spouse, dependent children under 21 AND any dependent listed on your most recent federal tax return.

So if you listed your father and mother on your tax return as dependent, you would need to include them if not, it will be only you and your spouse and children under 21 if any.

If you claim your parents to be your dependents (meaning you are financially responsible for them) on your IRS tax return, you are out of luck...

Otherwise you are in good shape and good to go.

  3. this Spanish forum mentioned the May 7th 2010 PD with interview: http://foro.univision.com/t5/Inmigracion-Tramites-de-Residencia/DOMINICANOS-que-solicitan-residencias/td-p/175908863/page/5920#axzz21HIMpsTb

the girl who posted it originally talks about it, however she was unsure if it was true, as she just put it into a google translator. The source of this posting can be found here: http://vietditru.com/bb/viewtopic.php?f=19&t=20406&start=180

The others following her post were just joking around.

It is in Vietnamese and I also went just by the google translator, but it really looks this is correct.

I didn't find Steve's finding, so can't comment on that.

  4. aha...got it :) I see the uncertainty about the NOA2, however I really don't think you should worry about not getting approved. the USCIS process is more about catching suspicious fake marriage for the sake of bringing in someone for the green card. at the time when I came to the USA I was told at the embassy that there are certain countries where people pay over 10,000 USD to a green card holder just to marry their son/daughter. This is what they are trying to catch, all other normal petitioner will just get approved.

  5. i don't mind the wait, cause after approval still have another long wait til the interview, so if they are closer, i might feel better, so 17 months til approval and another 4 or 5 months til interview and during that 4 -5 u get ur aos and docs ready...long wait for approval makes the approval time til interview time seem short as compared to 2 long waits

Jimmy just made the point. No matter if from NOA1 to NOA2 the wait time is longer than a year ago. As long as the total processing is somewhere 24-30 months, who cares if the NOA2 comes after 6 months or 16 months ?

I'm in CSC and they moved from 5 months to 9.4 months (as of June 2012) processing time. There is no advantage to have NOA2 faster...at the end of the day whoever has earlier the priority date will have that much earlier their visa too.

Jimmmy: BTW you got married 1 day after our marriage and your PD is also just a few days after mine. check my timeline :)

  6. I've had the same question and I called the US embassy.

They confirmed that as long as my wife comes to visit and returns, it is perfectly fine.

Actually...when we had our wedding in the USA she arrived to the airport with her wedding dress in her hand crossing the border. The officer asked a few questions from her, gave me a call at my work phone and went through the same questions ...one by one ticked the box for each question as long as my response matched to what my wife said. I was honest upfront with him that she is coming to get married with me.

The key point was that we both referred to reaching out to the US embassy and seeking advice and they confirmed no problem at all....she got admitted, however the officer said he is unsure if it is a good decision he is making...and he said he makes a note on my file too, that I confirmed my wife will leave after the wedding. (yes, he did ask me to confirm that I understand that my green card can be refused to be prolonged in case I end up knowingly mislead them).

Of course, it wasn't the case, but he had to cover his back. Otherwise the discussion was friendly and he was very professional.

Conclusion: tell 100% truth and you will be fine.

She is on the visa waiver program, didn't need to apply for tourist visa.

  7. so..I always wanted to ask this here...how is everyone handling the waiting?

We always talk about NOA1/2/PD..etc, but never about how actually time is spent while waiting...how do you keep in touch and maintain the relationship?

There must be very creative ways people find to survive this 2-3 years of wait...so here I go with my "tricks":

    • Skype a lot
    • Watch movies on netflix. I start the movie, wife watches it by my laptop sitting in front of the TV and transmitting picture by webcam.
    • The good thing is, that I can stop netflix any time, discuss what we liked or not..etc and then carry on with the movie. So far we had no picture or sound quality issues, that worked out well.
    • A lot of time spent on planning what and how when she will get here....and
    • actual personal visitation every 4 months...and we buy the flight tickets 2 months in advance, so after each separation 9 weeks later we already have the hope when we will be seeing each other again :)

Difficult part: 6 hours time difference. It works out OK during weekends, pretty much impossible during the weekdays to talk, as by the time I finish work and get home it is midnight or 1 AM at wife's location.

Please share your way of getting through this waiting...I am interested. Maybe we can pick up ideas from each other.

  8. I am eligible to complete the I-864EZ.

At section 19 if you check the box you confirm that you submitted the last 3 years tax returns, but only sending them the latest.

In my case I have only been in the USA since 2011, so my only tax return is for fiscal year 2011. At the description section they don't specify this case, however they make a comment that if you were exempt to file a return for any of the previous years, you will need to explain it (i.e. not being a US resident for tax purposes).

Anyone has experience with less than 3 years of tax returns submitting this form and what was the requirement if any, other than just commenting in the cover letter on your situation as not being in the USA long enough to submit 3 returns ?

    thanks

  9. I think this is bad news for 2011 f2a filers. If both USCIS service center started slowing I130 processing time, then PD is gonna move faster because of low volume of approved applicant received by NVC. When both service center started faster processing again because of PD current like 2010 VB, Then it will be possible retrogression again for overloaded of approved applicant received by NVC.

Service Center is the main culprit for retrogression. We should raise our voice to minimize processing time for I130 application. So it will very low chances to have retrogression.

this does make sense indeed. However I think that based on the current PD and that it advances by 6 weeks each calendar month , the PD will not catch up with the processed service center applications.

Plus there may be some seasonality with the applications, or the processing slowing down as everyone goes on summer vacation.

Let's not make too early conclusions :)

  10. I'm with CSC. I just checked their processing time and it seems they started to slip away...now the current processing time is 8.3 months, as of June 15 2012 they were processing Aug 23 2011. (which is rather 10 months...)

so in short the CSC is getting in line with VSC and going for a flippin' 1 year processing time.

the good news is that the PD is moving well...currently Feb 15, expected to hit April with August visa bulletin.

Even though the regional service centers are processing slowly, once they are done it will just move faster in the NVC and get to the embassies. (what the used to do after the regional centers approved is have your file sit and wait in the NVC until your PD was closer, so no matter how fast a regional center may process your application if NVC puts it on back burner.

I anticipate to wait another 3 months to receive my NOA2, so the summer will be over when I can celebrate :D ...I will prob. get my skies/snowboard ready for the winter just to see my NOA2 popping in :)

  11. We finally got our NOA2 email and txt yesterday (4/14/2012) which is a saturday! I was SOOO shocked...

Its been a rough week for me as i just came back from seeing my wife in Pakistan last saturday and promptly got bitterly sick here.

This was the BEST way to end this week - some movement on our case.

I instantly txtd my wife (it was past midnight her time) and we enjoyed our progress together on skype...

Good luck to all those that are still waiting for their NOA2.

Now on to the waiting that is the next step i guess?

Someone mentioned a year long wait before NVC process?

I plan to file for my naturalization at 5yrs-90days which should be Dec 1st 2012... so hopefully we will get upgraded before then?

If any of you gets the US citizenship just file a new application and she will be here in 6 months. explore your options.

downside: you will have to pay for the other form which the citizens submit, but if it saves time and instead of 12-18 months you only have to wait 6 months, it worths every single penny...

  12. Athena, check this out: http://dashboard.uscis.gov/index.cfm?formtype=4&office=2&charttype=1

VSC is much small just by the sheer number of applications they receive/process compared to CSC.

first chart is national, second below is the center specific data

the approvals are in line with the expected processing time, those in CSC get approved around 7.5 months, those in VSC closer to 13 months.

About the waiting..someone else said this on the forum, you have to carry on with your life and try not to think too much about this, especially check your status weekly. It will drive you crazy. I try to avoid the subject as much as possible with my wife to help pass time faster. the less she thinks about this, the better for both of us, even though we both know we signed up for a 2.5 year separation ... :/
