Now that I've become a us citizen
I am going to file for my parents. They are from Colombia and currently have tourist visa that were just renewed last year. They have been visa holders since 92. They have never overstayed their visa. But now as they are getting older and all of the other immediate family has immigrated here I made the decision to try and ask for them.
So my question is:will there be any issue filing I-130 if they are current visa holders! Would they still be able to travel to the USA while awaiting their case to be process. ( they are suppose to come for Christmas). Would this be considered fraud if they are traveling on their tourist visa but have filed I-130 so that they can immigrate. My father is very worried their visa would get taken away. Also I'm not even sure how to start this journey. Should I seek an lawyer or would this able someone I could do on my on.
Please help vj family

Hello Everyone,
First let me apologize if I am not posting in the right forum.I haven't been on here in so long.
So now we are at the 3 year mark and we are ready to pursue citizenship.
my husband came here on a tourist visa from colombia in 1994. he was not aware of the selective service requirement and never filed. fast forward he's now in his late 30s and so now its too late for him to even apply. I have filled out the "status letter" for the selective service but I am wondering Will this pose an issue with him becoming naturalized?Should i reach out to an immigration lawyer? I was able to do AOS by myself and would like to try and to the N-400 alone. I have all pretty much all documents ready minus this. any advice would be greatly appreciated.
TIA

A GC holder can be outside the US for up to a year without needing special permission. 3 months is a non-issue.
Thank you for your reply. I got scared as on the USCIS website it says under a year can also be considered abandoned.
Less than 6 months is not an issue. See this thread for more details: http://www.visajourney.com/forums/topic/398316-im-a-permanent-resident-how-long-period-can-i-stay-outside-usa/
Thank you for your reply I really appericate it and I appericate the link I am going to go and read it now. Just was checking everyone here whom might have stayed and see what can happen. USCIS website really freaked us out
