  1. State taxes are technically not due until October. That's for the state of California. I'm not sure if its standard across the others.

    Is it possible for you to apply through your local IRS office (walk-in)? We did that for Dave and we obtained his ITIN flawlessly.

  2. Hi,

    I applied for My Husband's ITIN number in April 2013. They rejected in June 2013 due to the missing Certified Copy.

    Now I have my husbands Certified Passport Copy. Can anybody tell me if I can re-apply again. I am little worried as I can only file the Tax return after I get my husbands ITIN number.

    Am I too late to apply for state Tax return once I receive the ITIN number.

    Your advice will really be appreciated. Thanks in advance.

  3. My current status in US : h1b visa

    My wife's status : permanent resident

    I130 applied : June 2012

    I130 approved : June 2013

    Applied at Vermont service center.

    Priority date is current right now. What confused the hell out of me is : how do I get a visa number? Do I've to wait to get it or can I go ahead and apply I485 at this point.

    It's confusing because on USCIS site one place it says once priority date becomes available you can apply for I485 if you're in US and at another place on USCIS it says you can apply for I485 once visa number is available.

    Can you please let me know what all documents are needed in I-485 Packet? Can you please let me know the checklist.

  4. Current Individual Annual Income is reflected from the current year, for example the year of 2013. You would have to put down how much you are making, and what that would be in this given year. For example, if you are making $20 an hour. Just multiply that by 40 work hours in a given week and multiply that 52 weeks (A year has 52 weeks).

    20*40=800*52= $41600

    Your adjusted gross income is the number you could find it on your previous tax returns. Just look through your tax returns of the previous years.

    Can I please ask one more Question...In form I-864 what will be the Current Individual Annual Income and Adjusted Gross Income..should I take it form W-2 I received or it will be the Year to date Inome which shows on our Paychek after cutting Taxes. Your help is really appreciated.

    Looks like you have all the basics covered. I would include the 2012 Tax returns as well since we passed the Tax filing deadline date. Since you do not have an ITIN number for your spose, I would file it this way. Married filing separate, and in place of where they ask you for Spouse SSN#, place NRA (Non-Resident Alien). You wont be able to do this E-filing, it must be mailed in. Finally, if you still wanted to file as married filing joint, file an adjustment of tax returns once your spouse migrates to the U.S. I hope it makes sense..

    I am preparing I-864 Packet for my spouse.There are some questios arising as I am going further.

    I applied for my spouse ITIN number 3 days ago. Is it okay to send i-864 form without ITIN number. also what proof should I provide for 2012 Tax return ...We filled 1040EZ along with ITIN application.

    Do we need to include original Tax Transcripts received form IRS or Photocopy is fine.

    Basically I have below documents for my I-864 Packet: Please let me know if anything is missing:

    Cover Letter

    Barcoded Cover Sheet(Will print it after my AOS bill shows paid)

    I-864 Filled and Signed

    Filled W7 form for Itin and 1040EZ, and w2's (since i have not received ITIN number)

    Tax Trancripts for 2011 and 2010

    Last 6 Months Paystubs

    Employment Letter.

    I am not including Bank Letter as I have enough Income to support my Petition.

  8. If you already know your new address, I would suggest you update it now. The NVC doesn't typically sent any form of correspondence by mail. It's very simple to update your address with the NVC. It's not at all like the hassle at the USCIS.

    I'm also changing addresses soon. You will want the correct address on file as soon as possible so they mail your spouse's permanent residency card to your correct address.

    Just one Question..did you use your new Address for Choice of Agent form?

    I got recently approved and received my NVC case#. Waiting for DS-3032.

    So I am moving to new Apartment on June 1st 2013. I am really confused what address should I use in all NVC forms (DS-3032. I-864 and DS-230). Your Opinion will be highly appreciated. It is almost 1 and Half month to move..was thinking to use my new Address...

    also Do I need to update NVC about my change of Address.

  11. Since you are already current once you receive ds3032 packet (choice of agent) from email or snail mail, complete everything as soon as you can for faster processing. You can check your iv bill and aos fee bill online once you rcv ur invoice number and pay for them online.then mail complete ds230 signed by beneficiary plus all requirements stated on the website.they have guidelines here on the forum if you cant locate the requirements at nvc website. Petioner should mail aos plus itr and w2 as soon as aos fee bill has been paid. If ur requirements are complete, you can finish evrything in one week or two weeks tops then wait for nvc to schedule you. You will no longer need to wait for a visa number to become available to you as you are current but you will still be processed under f2a category and not as immediate relative since that is your present category.

    As we have same PD I wanted to ask you one question. What if the cutt-off date this month comes to Feb 22 2011.

    What will happen to our case. As our case is not complete. I am really worried as I haven't received Choice of agent form... Feeling really bad that we will get delayed.

    The "NVC Processing Times spreadsheet" gives you a rough idea of how long it takes at NVC (scroll all the way down). The post also has some very thorough information regarding NVC. At the moment, it takes about 1 month for the NVC to assign a case number and approximately 1-2 months for NVC to complete processing the case (add more time to procure required documents if you haven't done it already). So, that makes it about 2-3 months of processing at NVC.

    It is possible that we may be current in either June or July this year. Given that VSC has also approved cases from March 2011, I think the chances are good. Fingers crossed!

    In the meantime, it is a good idea to gather documents (birth certificate, marriage certificate, tax transcripts etc.) and be ready for the next step. You can post in the NVC forum for NVC specific information. There is also an area specific forum if you need help with obtaining local civil documents like police clearance certificate etc.
