  1. trying to remember all the posts to answer :P We are documenting everything and once he gets his green card (hahha we don't wanna piss anyone off before he gets that) we are going to make some serious complaints about this doctor's office.

And for those of you that have said you admire my strength.. lol you should have seen me on my couch bawling my eyes out and having panic attacks :P I'm a wimp, really! I'm just a persistant wimp who never takes no for an answer :P

weee now we're just waiting on monday to hurry up and get here.... i have my ultrasound appointment then :) And on Tuesday my hubby goes back to work :)

  2. Like I said, my faith in the system is finally restored after today.

And the way I've always looked at this process is, no matter how painful it is to me personally, I need to share it with ya'll so that the same issues don't come up with you and if they do you know how someone else handled it and fixed it. I benefited so much from the experience of others during this process, and I want to be able to give back to anyone else who needs it. Plus, many of you know that writing down the problems and then listening to others' advice is VERY theraputic!

You all kept me sane during the visa part of this process (and gave me something to do by searching approvals through NSC and posting them on here :P ), you've given me so much advice through all the process, and hopefully in 2 weeks I can post a big YEAH we got the greencard thread. So THANKS!!!! for all the support. I love my visa journey family :)

    We'll keep you posted!

  3. Well, Johnny showed up for his infopass appointment and saw the same lady we saw on Monday. She said "oh no, I knew it! They won't give you anything at the doctor's will they?" Johnny explained what had happened on Monday and she said that she was going to take the new medical form back to her supervisor and see what he can do. So a few minutes later she comes back and tells Johnny that the supervisor took one look at it and said "this isn't their fault. they've done everything they were supposed to do and can do. They should NOT have to pay any more fees". So, they've accepted the case as reopened... they say we should hear something from their office within 2 weeks. Also, my hubby's work authorization has been reinstated and the march 9th get out date has been stopped!!!

FINALLY, I've gotten some of my faith in the system back! It's refreshing to know that at least 2 people in the St. Louis office have a heart and are able to see past the red tape to see the clear aspects of a case.

I'd forgotten to post on here that the job that J has been working (a temp job at Ralcorp in St. Louis) told him that if he could get this straightened out today then he could come back to work. (which is impressive as he is just a temp there). So he's going to call them today and see if they want him to come back. The best news is that he'll still be able to take the new job on March 20th.... the one that comes with health insurance and all sorts of benefits.

Even though it seems like things are going great now for us, please please, anyone who is going through AOS and needs a supplement.... make sure the doctor has filled out the right forms! Get copies! And for the love of God, please DO NOT go to the People's Health Clinic in St. Louis, MO. They are the ones that screwed ours up. Let me be your shining example of what can go wrong :P

We'll keep you posted and let you know what we hear from USCIS in 2 weeks :)

  4. it wouldn't surprise me if she did work there. You know what she sent in to USCIS? A freaking vaccination card (you know the ones we all have that says what shots we've had)! How stupid can you get?

Right now, the focus is on getting this case reopened tomorrow with our new form... after that I'm dealing with that stupid doc's office. I just need that "you have till march 9th to leave the country" thing to go away.

  5. well, at the infopass appointment we were told that we need the doctor to sign a letter saying they screwed up. She recommended that we go down there right away and sit there until we get something. We spent the entire day at the doctor's... and well, after being treated horribly (accused of lying, accused of "playing some game" etc) We were able to speak by phone to an administrator. She said she'd look into it and then call us back today. The congressman is also supposed to call us back today after speaking with USCIS to see what they can do. Johnny made another infopass appointment for Thursday to see if we can reopen without this letter from the doctor. My dad wants me to sue the doctor for 1) screwing up and 2) not fixing it.

We'll see, I guess. I'm not sure what else to do at this point...

  6. we got copies this time from the doctor yesterday. So at least we know this new batch is done right.

About now, I'm ready to go in there on monday and file whatever in the hell we need to file to get my hubby's status fixed and EAD reinstated. So, if I have to pay some fee, I'll pay it, but we will surely be going after the doctor for the cost, that's for sure.

I just want this all to be over.....

  7. thanks :)

right now we are at a standstill today. We have the infopass appointment on Monday, I've talked to one of my congressman's office and she has already received our letter requesting help and is working on it, and if we need to on Monday we can go in to the lawyer and talk to him as well.

As hard as it is, I think we're going to try to forget about this for the weekend. It's our anniversary, and we had booked a room at the Lodge at Pere Marquette State Park (it's so pretty up there and it's also eagle watching time of year) and that's already paid for, so we are going to go and try to enjoy our first anniversary. Other than that we are trying to make things as normal as possible for my children at this point, and I'm trying to remain calm so as not to hurt the baby...

I'll still be checking in here for any more advice... and we'll be working on Sunday to prepare documentation and get things ready to speak to the immigration officer on Monday.

  8. well, they told us we have to make an infopass appointment. so i got online and actually we could have had one later this afternoon, but we need to get the kids from school today as I can not justify paying a babysitter when I'm not sure when my husband is going to be able to wrok again. So I made an appointment to speak to an immigration officer on Monday morning. I also have a call in to a local immigration attorney who is supposed to call me back later today to speak with me about this issue. So maybe it's best to speak to him before our monday appointment so that we can try to get this taken care the right way.

And like I said, if we are going to have to pay that big of a fee, then we will definitely be suing the doctor's office who screwed up to recoup that money.. hence the call in to the lawyer.

I'm not messing around here. Just because I want my husband with me and my family complete, I will not be taken advantage of.

  9. well he's at the doctor's office right now. and surprise surprise, they refuse to admit guilt... they actually said "you can't prove it that you showed us the letter from USCIS" He's still there waiting to talk to an administrator (which all are in a meeting right now.... doesn't that sound just right?) and then if he doesn't get answers I am going to call. I honestly feel right now that this doctor's office is trying to take advantage of someone who they feel "doesn't know any better". They actually told him, well, pay us $110 and we'll let you see a doctor and fill out a new form, but we won't admit we were wrong.

  10. i'm going to sue the pants off the doctor's office if we have to pay another fee for this case. That with the lost wages would be the straw that broke the camel's back. THEY screwed up, not us.

Johnny just dropped me off and left to go to the doctor and then USCIS. He'll call me when he leaves the doctor's office and then again when he leaves USCIS and let me know what happened.

I'm going to call him in a minute and reiterate how important it is for him to demand some sort of admission of wrongdoing from the doctor.

  11. Thanks, guys, for all the advice. I've finally calmed down a bit and we had already decided on the plan of action for today. Unfortunately, I HAVE to go to work today (can't afford to lose my job with hubby not able to work anymore), but Johnny is going to march down to the doctor's office and demand they make it right. He is also going to try to get them to write something that admits that they screwed up. (good luck, right?) And then he is going down to USCIS with a letter I typed up titled "Motion to reconsider" that states exactly what happened, and give them the new correct documents. He is going to TRY to talk to someone (you know how they are down there) and ask them what we need to do to make it right. We figured if all else fails then, I am calling a friend of mine who works for an immigration attorney and asking advice... I'm calling my congressman, and if nothing else works we are going to contact the media. The local stations here have great sections on the news called things like "you paid for" and stuff like that. I'm willing to go as far as I have to go to get someone to notice this case and get it fixed. Especially since we've done EVERYTHING right and legal and here a USCIS approved doctor screws it up for us. BTW, we got the doctor's name directly from our interviewing officer, she gave us a list of the "approved" ones.

I hate to play that "i'm pregnant (whine) " card... but if I have to I will. It won't hurt that I'm very obviously pregnant when it comes to getting people to at least feel sorry for us.

I'm going to try to keep this on the first page so that if anyone else knows anything they can see it. Plus, hopefully people will read this and at least be wary of the "approved" doctors that USCIS sends them to. If I've learned anything at all in the last 24 hours, it's this: DEMAND to see the paperwork before they seal it up.

  12. Ok, so we went for the interview on oct. 18th. They wanted the vaccination supplement from a civil surgeon done as a RFE at that time. My husband went to a civil surgeon listed on the approved list and had it done. They gave him a sealed envelope to give back to USCIS in St. Louis.

Well yesterday we received a letter that stated his AOS was denied and that he has until March 9th to leave the country. On the following page it tells us that the form submitted was not the right form and that the doctor who signed it was not an approved doctor, even though it was from the approved doctor's office. Basically, the doctor screwed up! They had all the info on what to do in front of them, and they screwed up. It says at the bottom of the letter that there is no appeal but the case can be reopened. What does that mean??

The letter also said that his EAD has been revoked, which is scary because we need the money, and he has a job that he can lose if he continues to call in sick like he is going to do today to try to get some of this mess straightened out. To make matters worse, he has been offered a new job starting march 20th, which offers lots of good benefits and much better pay...

I've been up all night long, I can't sleep. I'm so terrified that they are going to not do anything to get this fixed. I'm 5 months pregnant and all this crying and panic surely isn't good for my baby.

Johnny is going down first thing this morning to USCIS and see what we need to do.

Please, if anyone has experienced something like this, tell us what to do!!
