  1. I have applied for EAD/AOS/AP with an NAO1 Date of 11/28.

I did have a biometrics appointment on 12/21 but have received nothing since then.

Should I contact USCIS? Has anyone had any luck finding any information before the 3 month mark by calling?

Thanks for your help - it's really difficult to be here and stuck at home.

I filed around the same time as you , mine was approved on the 5th of February , after most of the November filers were already approved and even some December filers. Maybe my file was at the bottom or something. Don't worry you'll get approved soon.

  2. I also just went for a nose around in October filers, a lot of those are still waiting on biometrics and interview dates too, interestingly I found this post:

XXXXX according to your timeline you filed a a K1 (which does mean youre eligible for AOS approval w/o an interview) So I dont know why the level 2 operator would say you were most likely interview waiver-able- you definitely fit into that category. Also it shows you are able to access your 485 online through my case status.

When you access your case it should show where youre currently being processed. If its showing initial review or acceptance at the National Benefits Center or as its referred to here the NBC, then thats where you would get approved w/o an interview. You would 'jump' right from that step to 'decision'

If its not showing youre at the NBC in initial review or acceptance and rather it shows youre in the testing/interview stage it means you have been selected for an interview at your local office.

I know a lot of November filers are with NBC, can anyone validate the above or were they just speculating?

    My edit:

    Just found this on USCIS:

Workload Transfer from Service Centers to Field Operations

"Interview Waivable cases are family-based I-485s which USCIS has determined can be adjudicated without an interview. In the past, the NBC completed pre-processing of these cases and then transferred them to the California Service Center for adjudication. On Aug. 1, 2012, the NBC started to retain these cases for adjudication."

Can you tell I have a quiet morning?? :)

From what I've read most K1s don't get an interview , because we already had an interview for the K1 visa , a small number of K1s still get interviewed though. Also previously when you are not getting an interview they would transfer the case to California Service Center , but now due to work load, cases are approved in NBC , so there is no real way of knowing if you are getting an interview or not because you case just stays in NBC until it gets transferred to a local office for interview or until you get approved and receive your green card.

Also I noticed that people with interviews get their green cards months earlier than the interview waiver-able ones who get theirs in about 4-6 months. Most people don't hear anything for months after they get their EAD/AP.

I may also fall under the interview waiver-able as I haven't heard anything since my biometrics, I'm not sure that's a good thing though, that means no green card for a long time. Hopefully we'll get our EAD/AP soon.

  3. Thank you for letting me know that information. I'm still hesitant about sending mail to and from China/Nigeria and currently have friends there that will be coming back to China (better to have something in hand than lost in the mail). Is there anyway to get around sending the fingerprint section back? Calling the officer that did it the first time? etc.?

Yeah I know what you mean about the mail , I left mine in Nigeria because I knew it would expire before I would have been able to use it . It was easy to send it back to me. I don't think you'll be able to call the officer though.

Maybe someone else can comment on this , there may be another option

  4. I'm wondering if any of you know if I can get another police clearance certificate issued from Nigeria for my husband without being in Nigeria. We got one issued while we were in Nigeria, but since then it has expired (3 month validity). I don't want to (can't) send the expired one in without a new one, but also don't want us to have to travel to Nigeria just for this. Any advice is welcomed, Thanks!

The fingerprint section is valid for 1 year , so you don't need to be physically there for them to issue you a new certificate as long as it's within that 1 year. Just send the old certificate with the fingerprint section back , have someone do it for you in Nigeria and send it to you. That's what I did

  6. My fiance is self employed and has traveled to USA many times in past with this career. His brother runs his business while away and he has had no issues with coming into the country. He has came in twice on his B2 to visit and both times given 6 months stay duration without any issue or concern. My question really wasn't "if" they will let him in, more the issue of will the border agent note that the petition has been filed or not? The bigger question is, will it cause problems at his interview regarding him coming to visit me during process. I don't see any issue with him traveling here while awaiting K1 process as long as he is doing it legally and not overstaying. Thank you for your thoughts thus far.

I am thinking to be safe, I will wait till the 3rd to submit and will await his arrival on the 4th. The forms will not be accepted until after he arrives and I will not have to change the initial petition as he is not in the states when I apply. Again, not concerned about the law as we are following it as stated, just border agent..

There shouldn't be a problem if he has visited many times already. I visited 2 times after our petition was submitted, the last time I had already given up my job and moved out of my flat so didn't have strong ties but I wasn't even asked for any evidence and was let through, I even changed my ticket and stayed a week longer than I told the border agent. The visits will not cause any problems at the interview , you are allowed to visit while processing the K1.

  7. I wonder... do they want to see "proof" that you have a wedding planned or they just believe your words on that? By the time we, HOPEFULLY, get NOA2 I should be in London for a few months, so I could as well go to the embassy for a "last minute interview"...

They don't ask for proof , I actually put 29th of June as my planned date of marriage , I think that was the reason I got the 15th of June interview date which was earlier than the date they gave some other people.

  8. Please I was just wondering if any Nigeria VJ has recently done police certificate at Police Headquarters, Lagos. Please keep us posted on the procedures and cost. Thanks.

The police certificate is very easy to get , I got mine in January while I was on holiday in Nigeria , I think I paid about N6000 but I've heard it can be less if you bargain. They took my passport photograph , passport details and finger print. I got the certificate in less than an hour. The certificate is only valid for 3 months but the fingerprint section is valid for a year. I left my certificate with the fingerprint section in Nigeria so that the certificate could be renewed .It was renewed free of charge at the same place this month. Used it to get my visa last week.
