  1. So here is my situation:-

    I entered on a K1 Visa end of December 2012.

    I have received my AP & EAD combo card.

    I'm still waiting on my Permanent Residency (as I had an RFE).

    The issue is, my father has terminal lung cancer and I'm wanting to go back to Australia for 2 months to spend time with him while I still can.

    I'm wanting to know the following:

    a) How long can I be out of the country without hindering the procedures over here (Will 2 months be ok?)

    b) What happens if I receive my notice to go in for interview whilst I'm overseas?

  2. Hey guys, Just wondering if it is possible to reply to the Packet 3 without having medical results ready to send in with it. The earliest medical in Sydney was June 25th and I'm ready with every other form needed to reply to Packet 3 now. Also if I do send it now, will they even schedule me an interview without having received my medical results?

    Have you emailed the consulate to see whether this is acceptable? They are quiet helpful.

    I know how hard it is to be waiting and away from your other half but 2-3 weeks isn't that much longer. You're at the tail end of things! Yaydancin5hr.gif

  3. My fiancé lives in Tassie and has to travel to get the medical. Since he also has to travel for the interview, we are hoping that we could plan for one trip where he could get the medical done and then pick up the results and then take them to his interview. Does anyone know what the turn around time for getting the results of the medical is? I know that the interviews for K1 visas are on Tuesdays, and he would have to schedule his interview time and then schedule his medical around (obviously before) that- but I don't know how much time is needed for the results. I can have him call, but the more information I can give him before hand, the better things will go, lol. He's a bit overwhelmed by the amount of paperwork, etc., so I'm trying to make things easier for him if I can.

    Any advice or information anyone has about this would be very much appreciated! smile.png

    It's not so much the turn around of results that you have to worry about.

    In order for you to have the interview you must submit the Packet 3 which is either inclusive of the medical/sent directly too the consulate. The consulate will review your Packet 3 documents to ensure everything is in order. They will then contact you with "Packet 4" which will outline when you're interview time and dates are. Lately from what I've read, this has been approximately a month after the consulates receipt of Packet 3.

    So what I'm basically saying is I don't think it will be possible for you to expect to get a Packet 4 until they have received this. He most likely will have to do two trips a pain, I know.

  4. We're so thankful to God that we've now moved from USCIS to NVC and now they've sent our application on to the Sydney Consulate. But I'm puzzled by NVC's notification:

    'Your case is in transit to the Consular Section. Your interview date was provided to you by the National Visa Center.'

    Can someone help us: have NVC already talked to the Sydney Consulate and decided our interview date? I haven't sent any packet 3 documents to them yet.

    I think this is a generic "next stage" message. As Adrian-Danielle said, you need to send in the Packet 3 documents which include the actual visa application form for them to get back at you with Packet 4. I would ring NVC, get your case number and start working on all those tips that were provided to you. Namely medical and police certificate. You're cutting it pretty close!

  6. Here's the latest - NVC have received our file, and given it a case number. And with that number, the Sydney medical centre let me book an appointment.

    I've also got the police check ordered, and my fiancee is about to post me the affidavit of support.

    Now from what you've all said, what do you think of this tactic:

    at the US end - my fiancee calls the NVC and says "URGENT, please send this case number on as soon as you possibly can".

    at the Sydney end- I call the Sydney Consulate and say "URGENT. PLEASE can you (a) send me a provisional packet 3 now, and (b) schedule an interview for me, in anticipation of this case number arriving in the mail".

    You can't call the Sydney Consulate.The only way of contacting them is via email. In any case, they won't schedule an interview for you until you return Packet 3 and they are satisfied with the documents provided.

    Looking at the US embassy in Canberra, it doesn't look like an interview date is needed to book a medical. However none of the doctors listed have websites listed so I can't double check.

    In Australia, the medical is sent in with the Packet 3 or directly to the Consulate. Then the Consulate in Sydney will send you what is called Packet 4 outlining interview date and time and any extra documents they may or may not require.

  8. Thank you everyone, this is all so helpful. We're now thinking through everyone's comments.

    As of today, the NVC says it has not received our petition from the USCIS, so we don't have a case number yet. I've ordered the police check. When we get the case number, I'll book the medical. My fiancee is posting the affidavit of support tomorrow. And I've begun filling out the online versions of the Packet 3 forms in advance.

    We'd like to get really clear about

    1) where the delays are likely to be from here, and how we can speed them up

    2) what might go wrong, and how we can help make sure it won't

    We know there's a chance we'll have to postpone the wedding. But if we know the key hurdles, then as we clear the big ones we can at least update my Australian family on the 'probability' of it happening on Aug 9th, as the weeks progress.

    Hope this thread will be helpful to others too.

    1) Delays...it's hard to give you a definitive list on where these may be! Could be postage - your documents from your fiance may be lost or take longer than anticipated to reach Australia. Consulate - they may take their sweet time in contacting you with the Packet 3 AND with the Packet 4 and even when you do receive the Packet 4, you may find that the interview scheduled (Which only happens on Tuesdays for K1 Visa) may not be within a time frame that is suitable to you. Some people have contacted the Consulate and have been successful in booking an earlier interview but of course, this is subject to availability.

    2) Um...How long is a piece of string? My suggestion to you is to ensure that all forms are filled out and you review them THOROUGHLY. Read the instructions in the link that has been provided to you THOROUGHLY.

    All in all, a lot of this is out of your hands. Like I said previously, too many variables for you to control in its entirety. All you can do is make sure you have followed the instructions.

Have your fiance send over the I-134 (Affidavit of Support) with original signatures and whatever supporting documents you need.

    To get the ball rolling, I would start off with your Police Certificate - this can take anywhere from 3 - 6 weeks depending on what state you are in.

    Call NVC for your Case Number It should look something like this SYD12345678

    With the above number, you are then able to book your medical. (Again this is dependent on the state you are in - my doctor in Brisbane wouldn't allow me to book until I confirmed I had the number)

  10. Hi i was wondering if you could help me. I am waiting for my packet 4 and interview date and would like to pay my visa fee in advance but im having trouble paying it online. I set up my profile but when selecting my visa type I have no idea which visa im applying for....the options don't suit my visa. I just want to pay for the K-1 VISA thats all.

    I can't help you with this one. I don't can't remember how I did it. I know a while ago people were having similar issues with paying for the visa online. If you search it and look through the previous threads, there may have been a solution.

  11. Hi all, can I have some advice on paying the visa fee? I got an email from the consulate telling me the date my appointment had been scheduled for and giving me the link to the ustraveldocs site to sort out payment. So i've found my way to this page: http://www.ustraveldocs.com/au/au-niv-paymentinfo.asp Is that the right place?

    It has all these instructions, I'm supposed to register a profile online and then I can go and pay (I think I'll just pay at Australia Post seeing as I've got to go there to buy the 3kg envelope anyway), and it also says that once you've paid, then you 'schedule your appointment' online. My question is, don't I already have a scheduled appointment? Do I just put in the date and time that I've been given, into the system, and that confirms it or something?

    I paid mine online. I went to my local post office and they had no clue what to do. I didn't want to risk them somehow stuffing it up so I said not to worry and paid online.

    Yes, you already have a scheduled appointment. I didn't do the 'schedule appointment online' thing. Just make sure you print off a receipt for them to sight that payment has been made.

  12. i finished my Bachelor of Science in nursing last 2009, havent had any experienced yet, i didnt take my license board exam either in Philippines, after i finished my college i went to singapore to work as an assistant outlet manager at the Mall, and now i just arrived 3 weeks ago here in Texas, me and my husband wonder how am i going to continue my nursing degree here in America, aside from having my SSN, waiting for my GC (i came here with a CR1 visa), learning how to drive, get a driving license and state ID, what else do i need to do to prepare myself in continuing my nursing degree.i hope to hear any good advice from vj members. Thank you!

    I would contact the American Nurses Association to see whether your degree is recognised and ask them what to do in your instance. If so, what you need to do in order to be licensed. I know that coming from Australia, a lot of nurses have to take a couple more classes to be eligible to take the NCLEX exam. This may or not be the case from the Philippines. You'll also have to look into state licensing.

  13. Do I have to wait until after the Medical to set up an interview? The packet says I need to include the medical results before sending in the packet? Confused?

    You need to have the medical done and then send it off WITH the packet 3 (or the doctor will send it directly to the US embassy). The US consulate will then contact you via email with the interview date and time.

    I came here on a student F-1 visa in 2011. Met my husband and we married Feb of 2013. heart.gif

    Sent off our package and lots of hard earned money to USCIS and just got my biometrics appt date for May 17th.

    Exciting but also plays on my nerves.ClockWatch2.gif

    Im so bored at home, I only have school twice a week and the rest of the days are spent playing Suzie homemaker.

    Im out of status currently while waiting for the change of status to come through.

    Luckily hubby is a US Marine and we get looked after well.

    Anyone who came on an F-1, in or out of status when married who successfully gained their visa got a story to add? What is the process for applying for a SSN once the EAD is approved?

    Count yourself lucky you've got school to keep you occupied. I was doing the Suzie homemaker thing full time while we waited for my husband's orders to drop from the worst base imaginable in the USAF (Thank Gosh we finally have them).

    Once you have your EAD, you go to the SS office and apply for a card. Make sure you bring the EAD.

  15. I think you need to reread the guides to get a better handle of all of this. You can get married whenever you want. You don't need a special visa for it. The K-1 and CR1 are meant for people that are staying in the US permanently. If you are not to the point that you will be staying permanently then you can come in, get married and go on your married way. You can file the spousal visa later when you are going to return to the US permanently.

    As for the K-1 you need to have met ONCE in the past two years. At least.

    If he is concerned with his schooling in Australia, have him enter the US on a VWP, get married and fly back to Australia, however, I would caution you not to have him say anything to this effect at his Port of Entry or he may be denied entry (people are able to adjust from a VWP and this would be seen as intent to stay).

    When you are ready for him to permanently move to the US, apply for the CR-1 visa (Spousal visa).

  16. Sifting through the guides and interpreting some of the semi-legal speak, this is how I currently understand the K1 process to work, and I please correct me if I am wrong on any of this...

    1.) The prospective-fiance enters the US and becomes engaged, after which they will return to their home country and the K1 process begins with the I-129F filed by the US citizen on their behalf.

    2.) There is an approximately 6-month waiting period during the processing of the K1, which is necessary for them to re-enter the US and marry. Upon approval they move to the US and marry within 90 days (else unlawful status could be accrued).

    3.) Following marriage the spouse remains in the US for the duration of the process to receive permanent resident status. They can work and freely travel if the AOS is filed and approved (how soon in his process can that filing begin?).

    Please forgive my ignorance on this process if I am off in my understanding of any part of it. I respectfully request clarification from someone who can provide it if that is the case.

    1) The minimum requirements is for the petitioner to have visited the beneficiary within the last 2 years. The "prospective fiance" aka beneficiary does not necessarily have to get engaged within the US. The I-129F is the petition in order to apply for the K1 visa. Once this is approved, then you start the K1 visa process which is an additional couple of months dependent on your country and how organised you are.

    2) Once you receive the k1 visa you must marry within 90 days.

    3) After you are married (within the 90 day period) you can apply for the AOS. This is dependent on when you receive your marriage certificate - I understand some states are up to a 6 week wait for an official copy. You must submit this in your AOS package. After they receive their Advance Parole and Employment Authorisation, they are free to work and travel.

Do I need to send in with my DS-156K the originals and photocopies of my Birth certificate, evidence of financial support, police certificates, evidence of your engagement or do I just bring them with me to the interview and send in the check list with everything ticked?

    All this should be sent in with your "Packet 3" to the Sydney Consulate. I'm not sure whether the instructions have changed since last year. Sydney will send you an email with these instructions referring you to this site http://canberra.usembassy.gov/fiance_niv_appl.html Read them carefully - they are pretty straight forward. If they need any further documents they will let you know - but this costs you time :)

  18. Hi Everyone,

    I am just putting together my AOS paxckage after getting married on a K1 visa. I know we do not have to do the full medical and only include the vaccination supplement.

    I was just wondering if anyone had any ideas on how to record that with our package. I have heard of people writing a little note explaining the did the medical overseas, or including a copy of the medical done for the K1, or just referencing the section where it states K1 visa holders do not need to new medical.

    Anyone have some advice on what we should do/how we should word it?

    I do have a copy of my medical and vaccination supplement?

    Any ideas or advice would be great.

    I put the packet together as per the instructions (in exact order). I only included the vaccination checklist as they requested.

  19. so i just wanted to let people know of my experience today at anzac square medical centre.

    to be clear, the form they email you says to bring australian-sized passport photos. do it.

    i know in the whole process you've had to supply american photos but in this part, the state department provides them with forms that suit australian sized photographs.

    DO NOT sign them before you get there, as they require you to do it in front of them. i took three american and three australian photos today in case i needed the other ones. i signed the american ones and they immediately :devil::ranting: breathed fireballs :ranting::devil: all over them (as mentioned in another review of this place by another member). i was so lucky that i took the australian ones because they are the ones they need and i didnt sign them til i got there.

    they make you go pee in the sofitel restrooms. you gotta take three escalators up and walk to the far left right next to the check in counter. they give you a bag so it wont be obvious.

    i had about a 15min wait and then i got to see dr taylor. he's really nice and answered all the questions i asked him. he first went through my vaccination checklist. i only had records of one vaccination, flu vac, which was recently. i gave a verbal declaration that i had chickenpox. everything except for Tdap and MMR were not age appropriate. so he gave me those two vaccines and then went ahead with the physical. probably took 15mins at the most. pretty run of the mill type one. checked height, weight, eyes, ears, throat, reflexes :bonk: . did a squat and touched my toes. he took a good look at my body including down there :blink: (only quickly) and noticed a mole on my back but quickly determined it was harmless and just caught his attention. i got dressed again after that.

    i went back to the front desk and paid the remainder of the account ($445+$100 deposit made a few days ago. also includes the two vaccines, the chest xray and the blood test).

    the ladies at the front gave me maps and details on how to get to the next two places. first up was sullivan nicolaides (sp?) at manor apartments on queen street (post office square, near the BoQ building).

    i rocked up to a waiting room and simply took a number and sat. girl came and got me and i sat in the big grey chair and rolled up my sleeve. she took my forms and passport and the other girl got her jabby things ready. the needle hurt a bit because its different to the ones i usually get at other joints so that sucked after having two injections previously in the day. it was done in about three minutes so i got my stuff together and headed towards citiscan. this place is on the corner of queen and albert above that chemist the same side of the street as HJs.

    waited for about ten minutes and got called in. really neat looking place, looks new-ish. stood up against the machine and she took her happy snap and signed my forms and saw my passport and sent me on my way. that was the easiest part of the day done.

    note: if you aren't taking public transport then parking is in one of two places. cathedral square or the oracle building on your right as you head down ann street towards central. i was hit with 40 bucks for about two and a half hours parking at oracle - never again will i park there :( . i intended on taking the train but my go card had expired and so i just figured "f**k it" and drove in.

    overall, it was alright i guess. i was pretty stressed out by the hustle and bustle of the city but you get that.

    this was a quick review, but nevertheless i hope fellow brisbane-dwelling peeps find it helpful.
