  1. I believe her income would be zero, but your income would suffice for the total household income.

    i'll go make a time line. in the meantime

    for 2011 we have filed joint and already got our return. i dont need a joint sponsor because my income (the intending immigrant) can be counted since its lawful and i have a letter from employer stating full time status.

    let me see if i can articulate my question better.

    for the year 2011 her contribution to the joint return was 0. my contribution was xxxxx. now the form is to be filled by the sponsor (her).

    the question uses the word "my" in the "my total income".

    so for 2011, should her total income be 0? since she didnt really earn anything, or should it be our joint income since we filed taxes together? we got married in october, but irs allows joint filing for the whole year.

    for 2010 and 2009, her total income would show 0, but as i said above we are demonstrating my income for the last three years which is well above the 125% mark.

  2. on the form i-864 q25 it asks for federal income tax return reported income. here is the situation

    in year 2011 my wife (usc) had no income and i (h-1b) had all the income. we were married in 2011 so we filed joint. so when it asks for total income in the three most recent years is it just the sponsors? or just the total income on the return?

    the exact question is

    My total income (adjusted gross income on IRS Form 1040EZ) as reported on my Federal tax returns for the most recent three years was:

    tax year total income

    2011 (most recent) ???

    2009 (2nd most recent) 0

    ...

    since this is from the sponsors perspective, what does "my total income" stand for in year 2011?

  3. guys guys... lets not start a pissing contest.

    basically since chat logs can very easily be manufactured, and are incredibly difficult to verify since ips can be dynamic and i can use timbuktu chat service that has practically no server side logging, since all that, i am questioning the credibility of a chat log submitted as evidence in a immigration case. im submitting enough other evidence that is actually asked for. above and beyond that, i see many people submitting chat logs. im just trying to understand if that adds any additional merit. so if u have actually used chat logs.. and they have somehow proven useful, let me know.

  4. My wife (USC) and I (H-1B) lived across the US while we were dating. We flew to see each other often (5-6 times a year for 3+ weeks every visit) and after marriage she moved across the US to live with me. I am currently readying a package to file for GC/AOS. When we were apart, we skyped a lot (mostly left it on all night). many people seem to be including chat logs in their package even though its not really requested anywhere. is this of any real value? or is it just fluff, because IM chat logs are not really proof as they can easily be generated or created at home.

  5. What you need to do is file your 2011 taxes jointly as being married and with both your incomes on it. That's what I did and since the source of my income didn't change, it was accepted without hesitation. This may also have a bit to do with the amount of the income. If you two are barely scraping above the 125% of the poverty line, it's less likely that the I.O. will accept this as if you are having a rather generous income.

    we already filed joint for 2011 and received the tax return as well.

    by Gods mercy and grace, together we are doing many times over the 125% so the amount is not an issue.

My USC spouse and I are almost ready to file for my GC. my only concern is that I am the one who is the bread winner (my h-1b job) and we are using my income under the i-864 provision to include the intending immigrants income if they can prove continued income. I am getting a letter from my employer stating title, salary, years of employment and that it is a full-time salaried position.

    is this situation generally successful?

    how many of you have successfully done this?

  7. I am filing out forms for the spousal GC. I had a bunch of questions so i have tried to order them carefully and post the images of the questions. it would be great if someone with similar experience or knowledge in the matter could help me. a lot of thanks in advance for your time and knowledge.

    before i ask my questions, i'll tell you briefly my history so my questions make more sense.

    i came here in 2006 on an f1 visa to get my masters. i visited home in summer 2008 and the last entry stamp on my passport is from then. i graduated in dec 2008, began my opt in jan 2009 and in 2009 my company filed for an h1b visa in 2009 for the 2010 cap. it was approved and i am currently on h1. i never left the country since my visit in 2008, so i don't have the h1 stamp. i do have the i94 that came attached with my i797 for h1.

    in oct 2011 i got married to a USC and am filing for cr/aos based on that. we are going to use my income as the basis for the i864 since her job is part time and doesn't make that much.

    i'll go over all the forms and put any questions that i have here.

    The date of last arrival was in summer 2008 and i have 2 i94s. one from the arrival and one from the h1 approval. what should the date of last arrival be? and what should the i94 number and expiration be?

    in what status did i last enter - student?

    nonimmigrant visa number - for the f1 or h1 (i dont have h1 stamp)?

    ever filed for GC - my company just filed perm for me. results are not out yet. what to write?

    Should i be applying for advance parole even though i have an h1b approval notice? if yes, part 3 requires me to give them dates and length of the intended trip, but i dont have any. i currently don't have any trips in mind. i just wanted advance parole just in case i decided to make a trip and my h1 expires. so what do i enter in part 3?
