So, a few years ago, under the Obama administration, my wife had a relatively smooth process in getting her CR1 visa. Whole process took about 11 months and she moved to the states a few weeks later to be with me. 2 years later, she filed for her 10-year visa right at the time when the option became available, but Trump was now president. What, in the past, used to take about 6-9 months (getting the 10-year visa) turned into a potential EIGHTEEN months after she received a letter telling her that her processing time was INCREASED to that time frame. As of April 2019, it will be ONE year since we filed for that 10-year visa to remove conditions and May will be 3 years since she has been here and qualified to apply for citizenship. So, does she still wait for that 10-year visa BEFORE applying for citizenship or once she qualifies for the citizenship, she can simply apply for that and just forget about the 10-year visa or can she even do that considering the fact they could always find some reason to DENY the 10-year visa which, I can only assume, means you won't qualify for citizenship?

Anyone else in this predicament or received a letter telling them their road to the 10-year visa (to remove conditions) has become longer by well over a year?

Umm no. Lots of people these days file N400 while I751 is pending. This action by itself does not lead to more scrutiny. Most IO's will not care. If you have other issues like criminal history or a suspiciously timed divorce, then that provokes scrutiny. I751 denial rates are pretty low to begin with anyways. Please don't be giving people incorrect info about this process.

You are right mushroom. I think you took my reply out of context. I have had my cousin’s removal of conditions denied after he filed for n400. I am not saying that’s is a universal rule. The essence of this website to share experiences we have been through or witnessed so PLEASE CALM DOWN

  2. I was in the same situation. I waited until I had my 10 years before applying for citizenship. You do have the right to apply for citizenship when your time is due even if you have not gotten your removal of conditions approved. However, the officer in charge of your case would want to find out why the rush. This will let them scrutinized your l751 thoroughly which could lead to a denial. Even though u can file the N400 now, I would advice you wait. Sometimes you gotta let USCIS know that your life doesn’t depend on them .

  4. Hey,

Thank you so much for your reply, it means a lot for me.

And yes I did sent the divorce certificate, so I should be fine at this point.

I had an immigration lawyer before and he told me to prove my deportation will result in an extreme hardship is optional. And also I didn't see it's mandatory to prove that even in USCIS website, can you help to explain about this? Maybe you have more experience or information on this issue? I do appreciate it.

Hey, once you submitted a divorce certificate, you should be fine. It will work out fine! Good luck

    Best,

    Donna

  5. Hi,

My check was cashed on 01/07/2016, and I'm filing form I-751 myself, cuz we got divorced at September, anyone knows how long I will have to wait until they can send me the receipt? Our marriage wasn't very long, I'm worried, thank you and God bless you.

    Donna

    Hello,

Once your cheque was cashed,it means your receipt is been printed and its on it way! Be patient ! Did you send a copy of your divorce certificate ? If you did then you should be fine! If not then you will receive a RFE to submit it. since your marriage didn't last long, you MAY receive an invitation for an interview to prove that you really entered the marriage in good faith but your spouse abused you and your deportation will result in an extreme hardship! If you don't,then your application will be denied and you will be put in removal proceeding! These are the options you have. Keep your fingers cross .I wish you good luck

  7. How about this? found on page 3 under "How to Fill Out Form I-751"

Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been married and the question asks Provide the name of your current spouse), type or print N/A, unless otherwise directed. If your answer to a question which requires a numeric response is zero or none (for example, How many children do you have or How many times have you departed the United States), type or print None, unless otherwise directed.

You are right! However, that is the instruction for the new I-751 forms beginning in February ! I am not sure you will penalized for putting N/A if you used the previous forms

  8. Yea...supporting documents is all the require...Once u say u ve benn dating since Date A or Date B,u should be able to support that claim or else u don't have a case...it is well .I also want you to know that,u going to Ghana for the second interview has absolutely nothing to do with the outcome....It not add to his approval or denial cos it's not a K1 requirement .....

  9. U were supposed to at least print a porting of every years chat and tag every document .One thing about K1 interview is being discipline and formal. You got to label all documents appropriately .Label every folder on a white piece of paper and pin it on veery document. That's all...Don't give the consular a chance to ask you about anything...just have ALL proves labeled out neat and in order...My interview was very short and concise cos he has everything well labeled in front of him and all he asked was my fiancées name, age and job...Just 3 questions and that was it...I can understand how u feel especially when u have waited all these months. U gotta pull out well this time around.ALL THE BEST

  10. is that 6-9 months from noa1? i went on the nbc timeline and they are not even processing i485 applications

No no no...that is not what i was talking about at allll...i did mention processing of a GC without an interview....GC means GREEN CARD not NOA1...NOA1 is a few day after submission...and yes u will not see any information on i.485 on the nbc website...its been like that since time immemorial...use your service center processing time to track your case...i hope u understand this time around

  11. Our case is the same and it is still in acceptance stage since July 15th. Do you know how long it would take (avg) for this process?

According to the timelines,we may not get an interview. And it takes 6 to 9 months for the GC to be processed.I think that is the disadvantage of we not having an interview..But once you EAD/AP is approved,u can work and travel and live a normal life...One thing i have realized is that,USCIS will do what they want...Calling them 100 times don't even solve the issue of getting your GC on time...so just take your mind off it and save the stress...It will be ready at the time They want and not the time the applicant wants...so i have relaxed and working and i will be going home soon...The more u think about it the more u get stressed out...However,one thing i know for sure, once u filled the AOS with all required evidence, your case cant be abandoned..You will sure get your GC but the waiting is the problem..so lets just deal with it friends.......THANKS

  12. my husband's i485 is still in acceptance!!!sad.png can someone please tell me whats the hold up??????

I think u are amongs some of us who will not get an interview...and cos of that USCIS may not change your case status until card is ordered for production....but u should still consider calling the USCIS to find out why your case is still in acceptance cos i believe it should at least be in initial review...Good luck

  13. You can call them, but really all they do is read your status to you and tell you to wait however many days it says in your status to wait for. Or they might look up your local office's wait time and tell you that you're still within normal processing times. The USCIS call center is pretty worthless...

I'm sure your EAD is coming soon. If you call them they're only going to tell you that EAD processing currently takes 3 months, so don't waste your time.

Hi Sushi&Charlie.......its seems our RFE was around the same time...My 60 day Response review will be due on the 19th of this month but still hasnt heard anything from USCIS...When is yours due and have u received anay info from them?
