We were married already back in our country for 2 years when I came here in the united states. I have a cr2 visa right now. We have airline tickets to show that he was with me and my daughter the first time we went here in US. I can show them bills, pictures, marriage contract, birth certificate of my daughter, lease/mortgage that we are really together and our marriage is bonafide. Even life insurances that i am his beneficiary and he is my beneficiary.

One more thing is, if Im changing my status, would it me filing married separately? My husband did not work in 2012 so he didnt file and HE was claimed by my mother in law.

Thank you so much. Just an additional information, I talked to a friend whose brother is working as an interviewer at the immigration. And she said that the tax is not gonna be a problem. But I dont know. Reading all the comments, I think I will just amend my 2012 tax. Do I still have the time? Actually my 2013 tax was also amended because of the filing status. On the 2013 tax I filed originally as head of household then amended it to filing married jointly. We ended up owing the IRS but we are on a payment plan now. 2014 tax is all fine because this time we did it correctly.

Exactly what the tax preparer when I was amending my 2012. She said it wouldnt make any difference if I change my status because my income was only 3000 and claimed nobody. The only issue here is I filed as single. But in case vmcan I still amend the 2012 or its too late to do that?

I cant amend the 2012 already. And no i dont owe anything because I didnt claim my husband and daughter. I wouldnt owe them even if I amended ut before. The only thing thats gonna change is the status.

I am getting ready to file n400 but I am thinking if I should hire a lawyer to help me better with my case. I know they will need 3 years of tax return. But on one of my tax return, I filed as single. Single with no dependent. My mother in law claimed my daughter and husband since she was supporting us. I am not required to file on that year because my income was below 3000. I just filed to get my withholding tax back. When I ask the tax preparer to amend it, she said it doesnt have to because I didnt claim my husband and daughter and I disnt owe anything. Now I am worried that they might question my giling status. I can provide them strong evidences such as bank accounts, mortgage and bills both on our names. Has anyone ever experience this before?

Yeah. I know its 3 years. I just couldnt file an amendment for my 2012 tax return for some reason. Thats why im asking if its ok that i didnt amend my 2012 because it doesnt have to be amende? Do you think it will arise problems? 2013 was amended and change our filing status from single to MFJ. 2014 was done correctly.

Oh that's right. Forgot that this years filing is for 2014. Thanks. until when can I amend tax 2012? I know if i will amend it, i am not going to owe IRS anything. My husband and daughter was claimed by my mom-in-law. So if I am amending it, I will only be amending to change the filing status. That's what the tax preparer said. Do you guys think I can explain it to the officer?

Tried to access dd261 but its asking for the invoice number? Where can i find that. And does this mean i can fill out ds 261 already

I'm also still unable to choose an agent and pay fees etc.

I received Case Number and invoice id number from them only in reply to my email, but never as a separate email from them or by post..

Anyway I am on hold with NVC right now, so I will ask them about it and I have couple other things to ask.

Where you able to access ds261? You have the same pd as my sister. Last letter we received saying that theres no available visa right now.

When I had my visa and married for less than 2 years when I got it, they gave me Cr1. But when I went to united states 2 days after our 2 nd wedding anniversary, they put ir1 on my passport.

What if I filed as single because in my case, my mother in law claimed my husband and daughter as her dependents. I just filed to get my withholding tax? Will that be a problem?

The decision is still up to the interviewer. I had a friend I met during the process who was requested to get a dna test done. But they are married. Just giving you heads up on what might happen so you will be prepared too.

Did anybody here experience going to the naturalization interview while having your tax amended? I need some ideas please. Im amending my tax return from single to married on 2012 and 2013.

I was in the same situation. Apply for the CRBA as sonn as possible. They didbt give me my visa until my daughters CRBA was approved.
