  1. Have you all started to gather documents for the interview?

I am thinking about requesting my police report. In Russia it takes 30 days to get it. I have big doubts when exactly it is safe to apply for it so it won't be late for the interview, but at the same time won't be too "outdated"... grrr.. IF only I KNEW exactly when NOA2 is coming... LOL too much dreaming, right? ;)

Letter of intent (do we use the same as we did with the petitition? Just a little different wording.)

As far as I know, the exactly same letter is just fine, as long as it is dated closer to the interview and also has original signatures.

    Anything else??

I also will be sitting down soon and filing out those forms required by the embassy such as DS-230 and DS-156.

My fiancé is bringing me his documents, W-2 and stuff, when we are meeting in June. So I am worry-free about this part.

The only thing we are truly missing is.... NOA2! Other than that we are ready to go.

  2. From your post it looks like your fiancé had made a false statement trying to secure a visa and he was caught. Lying about a fact that has a direct influence on visa issuance is called material misrepresentation. I think this what is going to happen. Assuming that you have done good job with assembling your I-129f package, your petition will be approved at Service Center and then it will be sent over to consulate in your fiancé's country . During visa interview they will denied K-1 visa due to previous misrepresentation. They will let him know if the waiver can be filed.

Waiver for misrepresentation is something that you can possibly do on our own but it's strongly advisable to get a help from an experienced attorney. I would suggest you checking immigrate2us.net There is a whole community dealing with waivers and stuff that comes along with waivers. You might want contacting a few attorneys recommended on that web site. Some of them will give you a free initial consultation. From what they will tell you, you will be able to assess your position and make knowledgeable decisions.

From my limited knowledge, misrep waivers are tough to get, but it's doable given that you manage your energy and resources into the right direction. Don't despair.

  3. Ok guys, I need some motivation and encouragement please :( Going through a lot of stuff rite now ...

Do u think the majority of Feb filers will get approved by May? What do u think?

I agree with previous posts that setting your mind on early approval is no good. Once approved it is approved and not a second earlier. Until then, it's waiting and waiting.

What can be a better encouragement than that in the end of this long and painful journey there will be a life with your Love? Just hang in there and it'll all be alright. What's not killing us that makes us stronger, right?

  4. Speaking of languages, My fiance is russian and i have been trying to study it though its not easy at all...

to quote my dad when I used to complain about how difficult it was to learn English - "there are millions who speak Eng. Do you consider yourself less talented???" of course, he was half joking but somehow it used to make me go back to my studies.. LOL

right now I am working on my Spanish trying to catch up with my Darling who is fluent in 4 languages!!

  5. Hi StarGirl,

"Maybe you can check your case number to see if the above is true. Not really a big deal I guess but helps to have everyone filling in right information and even good for you to be sure which center is handling your case. Hope you're well!

Thanks for pointing it out. I was under impression that filing location will be Texas to everyone with K-1, and then cases are going to Vermont or Cali.. mine is at Vermont, the case number starts with EAC. But I changed "Place benefits filed at" to Vermont

  6. I don't know what we will do showing evidence of wedding. It'll be just the two of us, very simple. I want a real simple dress and to save money I wan't to buy it when I get there. We will either be going to court or travel to a different city, but we can't really book anything before we know when we will get there.... No cake, noe venue, no invitations....

    Any suggestions??

if you are getting the dress for your wedding, chances are that you will want to take few pictures. Might it work for you that you contact a photographer and discuss your situation (unknown dates and stuff) with him/her? And then show the correspondence to the officer? They are human beings after all.. they've got to understand that not everyone's dreaming about a grandeur event. Also, if you are thinking about getting wedding bands, receipt can also serve as a proof of your intentions... Also, I think that presentation of ideas is the key here. Why wouldn't they accept "court house registration" answer if that's delivered with confidence?

  7. Okay, here's some bit of encouragement for us February filers. I did a timeline search to see data on February 2011 filers. Since the search is only limited to 100 entries, I got results based on 100 entries. According to that data, the average time for K1 filers with February NOA1 dates between NOA1 and NOA2 was 98 days :) Now, I'm not saying that is the Gospel truth and that is what will definitely happen for us guys but it is interesting to see such data from just a year ago. The year before that had the average number of days at 40-something but that is 2 years ago and is a lot less relevant. The average for my country (Kenya) was 141 days though but then again, there was only 1 applicant from Kenya recorded in February on listed results so it may or may not mean anything.

In any event, hope this cheers you up a little bit, we might in fact as others have suggested be fortunate enough to enjoy short wait times. We can at least pray that last year's pattern carry forward to this year.

oh, dear God, please 98 days be true this year too!!! that would be AWESOME!! R&RM thanks for sharing

  8. From my personal experience: had an expired passport back in 2008, was leaving US, called my embassy, called the UK airlines - everyone was telling me that it would be OK to travel to your home country on expired passport. I got my ticket, went to the airport, and was denied the boarding! That flight was going through LND, so I thought it might have been the reason. I tried to purchase the non-stop flight from Delta, but the person at Delta counter told me that there was no chance anyone would allow me boarding regardless of itinerary.. so.. the trip was ruined ((((

  9. What do you all think? Any thoughts?

when my fiancé submitted our paperwork, he and I wrote history letters about how our story was developing. Our case is somewhat different from a regular K-1 application so we felt it would serve us better if we gave them a better chance to look into our relationship. Mine was about 2 pages; my fiancé's was a little shorter. He notarized his. As you can see from my timeline there is no way to tell if it was a good idea or not since we haven't even crossed NOA2 step yet, but I thought it might be something that you can use too.

  10. I read a post here once. The couple blackened some things out, and their visa was not issued on the day of the interview. Officer requested originals of the letters without any editions before he could approver. It's better to pick emails and conversations where no editing is needed. That's for one. Second thing that you really need to take care about - never-ever-ever give a reason to think that you two are married. If you choose to submit those emails with your fianceé's "not real" signature, she needs to be well prepared to explain herself to the officer. If I were in such position, I would certainly start collecting evidence that you are NOT married indeed or better yet, I would leave those letters of the package I am getting ready for the interview.

  11. The other thing is how do i get a ticker on my profile

I had hard time figuring out it too :) This is the website where I got mine from, http://www.tickerfactory.com/ezticker/ticker_designer.php In the end when you done with the choosing your ticker, they will give you codes. The one you need to use is bbCode. Just paste it into your signature and you will have pretty picture on your posts. Hope it helps! Can't wait till it's time to make a ticker called "how many days passed since your NOA2"

  12. I agree with the majority of posters here that 1000 pages was way too much. The key in providing the evidence to the embassy is to never-ever give them anything that can be misread/misunderstood. Did your fiancé go through ALL those pages and made sure nothing been said that the officer could possible misinterpret? I highly doubt that he did. Great advice from the post above - pick what you send to them, make the best impression you can, and pray for approval.

  13. I'm feeling very worried today. I know someone who filed quite a while ago and whose situation is very similar to mine (same embassy, same beneficiary/petitioner locations, etc.), and her fiance had his interview today and got denied. It is really scary. We have 3 recent visits to their 1 (plus another years ago before they were together, but they started their relationship and got engaged on the same visit), and I do not have the same schedule/monetary restrictions that she has so I am planning to be in town with him when he goes for the interview, but I'm still so afraid that this won't be enough. Guess there's nothing to do but wait.

I know it's scary to hear about denial of a couple you think you have so much in common. But if you think about it - there should be many-many couples who were approved with their visa application in your embassy. Might be that some of them happen to be sharing your locations too - it's a small world we are living in. From tiny bit of info that you shared, your case looks so much stronger though. I am sure all the visits and your presence in town during the interview will be of a great significance. Maybe their sad experience can help you. Ask if you can about the details of the interview, and see if you can make this info work for you.

Don't let this thing worry you too much. Hope you will feel better soon!

  14. US embassy workers are some of the worst imo. They were rude jerks in Minsk, and no better in Warsaw. How these people keep their jobs is beyond me.

as a matter of fact, after reading the story about "Ms. Congeniality"() I start thinking that this kind of "I can spit on you and you have to love it" attitude is common among Russian staffers in different embassies. I have been a subject for their moody treatment a couple of times but I just learned to ignore them. Disturbing part is that once one jerk wanted me to hand deliver an original of the document that I was missing, stating that yes, I had to take 18 hours one-way train trip and one back to Moscow if I wanted visa. Yet, the moment an officer (the foreigner) heard our conversation (luckily he was standing nearby) he overruled jerk's order and said that a faxed copy was totally acceptable (btw, the document was of no importance). I am sure that such things happen all the time but not everyone is lucky enough to have an officer intervene and stop despotism.

  15. My best friend was in similar position. She was pregnant and wanted her mom to come over to US and help out when baby is born. Mom was living in Azerbaijan, retired, widowed, with no significant bank savings, no property owned besides of apartment. The only difference from OP's situation - her mom got approved for her tourist visa. So, go figure on what grounds officer's decisions rest .
