  1. Hi.

    I'm in the US on a K1 Visa.

    I'm not married yet but my fiancee and I have moved.

    Our address is now different than the one we have in the documents when submited the petition.

    I called USCIS and they said we must submit 2 forms.

    One is the AR-11 but she said because my fiancee has filled out an affidavit of support and we are living together, we should submit another form as well.

    Can anyone tel me what that is? I can't recall.

    After filing an I-864, then you need to send off the I-865 to change sponsors address. However, I'm not so sure about the I-134, maybe the same one anyway? Sorry!

  2. Hi Guys,

    I was wondering if anyone out there had any advice on the name change after marriage and green card approval? We have had our approval and I have received my green card but now I want to change my name to take my husband's and I'm not sure how this is done. Is this a huge hassle or is it straight forward enough?

    How will this effect my green card and travelling also, do I need to get a new card once the name is changed before I travel back to Ireland at the end of December? How long will this take and does it cost a whole lot to do?

    Sorry for all the questions, I've been researching it and can't find anything that tells me the story exactly how it is and who better to ask than those already gone through it!!

    Sorry to ask, but.........why? LOL, would have been easier to do it all from the start. Not helping though, I know.

    As far as I know, you will need to file I-90, renewal or replacement of greencard as biometric info has changed. Unfortunately it costs $260, check USCIS forms & fees. As for travelling, your passport will need to match the greencard obviously. I think you will have to go by the processing times for your local DO, check that out also. If you are planning to travel in Dec, and right now everything on your passport and greencard match, I would hold off until returning, just book ticket in maiden name. It will save a lot of panic wondering if it will be done in time.

  3. I have gained a little over 20 pounds so far but you know what. Even if I gained 50 Pounds and I have a healthy baby, I would not care for it at all. Hard to believe that my biggest fear before getting pregnant was to gain weight and get saggy boobs. Now I just don't care about it anymore. As long as you are healthy and the baby is developing good, you are fine. Your body takes whatever it needs to keep that baby safe. You are doing good. Don't worry about the extrapounds, you gonna lose them again...

    Oh I am fine with the weight gain. Getting compliments about how good I look doesn't hurt one bit! hehe It's just the doctor keeps warning me on how it could negatively affect the baby and all of that so it's worrying me a wee bit. I feel healthy though...healthier then when I was a "skinny mini."

    I have gained the same Nizzy....30 lbs and not finished yet. I know it's my own fault, I kinda relaxed on watching what I was eating at the start, but lately I have been much better and am gaining at the appropriate rate. My Doctor is not concerned so neither am I. I will worry about it afterwards, and if anything, it'll make me more determined to work it off quicker!

    I think your doctor is wrong in worrying you over a few extra pounds, stress will do more damage than that in my opinion! As long as the weight gain is steady and not too much at each checkup, I wouldn't worry for a second. Should be about a pound a week at this stage.

  4. Girona, that Vermont seven day fiance' petition approval isn't something new at all. That kind of processing has been happening up there for ages.

    I don't think speedy petition approvals and speedy AOS approvals are apples to apples. A petition is just a petition and is NOT even a visa approval, let alone a status adjustment giving permission to an immigrant to legally remain in the US.

    Regarding interviews at the I-765 stage, it's been discussed previously that this is indeed what will be happening with those not being interviewed now. If that does become the case, then all USCIS has move the pipeline clog up a couple of years. Nothing has been solved.

    It's also been discussed that effective Jan. 1, 2007, USCIS will not be conducting interviews unless the security clearance is complete. If that comes to pass, I can hardly wait to hear the howling about the incongruities in the process. One will either be transferred to CSC and approved lightning fast with no interview, or linger at the district office level with no interview for ages.

    I hope you're right Rebecca, I hope these people are interviewed at removal of conditions....call it sour grapes if you like, but every one of these posts make my blood boil. I know I finally did get my interview date for Dec, but we filed in JUNE 2005!!!! That's 18 months, count 'em! For those who just don't get it, it is literally torture to be stuck in this limbo for all this time. Our mortgage rate was affected, I cant start my 401K, I'm tired of throwing money at the USCIS. I have no status in this country and I'm sick to f88king death of being a non-person!!!

    USCIS certainly does have a lot to answer for, and I for one have absolutely no respect for or faith in any government agency in this country after all this. I'm all but ready to pack us all up and go home, only for the fact that I'm determined to see it through after all this struggle! :angry:

    I got a job! yessssssss!! Trainee manager position at Hollister with all the skinnies :lol: I start on Wednesday!! I'm excited to finally be earning some money!

    Oh shoot, I've got an appointment at the Docs on Wednesday.......for genetic testing as Roshon has a half brother with downs syndrome. I'm quite nervous about that :unsure: My mum and dad fly in on Monday so my mum is going to come with me so at least I don't have to go by myself.

    Better go change my first day at work :blush:

    I was just wondering if they still sold it. I don't know ####### about wine, apparently if I drink the $2 plonk. Wasn't exactly a recommendation!

    Asking to postpone an adjustment of status interview is not a good idea - many people have had their applications denied for missing an interview that they thought had been postponed.

    Better to forget to bring a critical document to the interview and be told to send it in.

    We will be married 2 years in Feb. 2007....but my wife's interview is Dec. 2006. Can we postpone the interview until after we are married 2 years or is it not a good idea?

    Yu&Dan, I know you help a lot of people that ask questions in here, but do you realize how arrogant you sound when you tell them something "doesn't cut it." If it were me, I wouldn't want your help after a comment like that. Maybe you can let someone else answer the question if their profile is not up to your standards or at least be a little less condescending about it!

  8. Irisheyes, I haven't looked at the website that you posted yet. I have been counting kicks every evening (between 8 and 10pm) and our little one is doing VERY good and gets his 10 kicks usually somewhere between 5-30 minutes. today he's having a lazy day, must be the 40 degree rainy, windy, nasty weather out there...

    I hadn't really started counting yet....baby is so active these days, I haven't really been concerned about it. I did have a docs appointment yesterday and apparently my blood pressure is pretty high, like 160/98. I have to monitor it 3 times a day, luckily my MIL has a cuff and monitor, and I also have to do a 24-hr urine analysis. I'm pretty sure it will be ok. I had a particularly busy day yesterday, went straight from work to grocery shopping to doctors, so I'm hoping it was a one off. The urine collection will have to wait 'til Thursday. Can't take the day off work to pee in a bag! ;)

    Well, we finally got our crib yesterday. I have been spending days in front of the computer reading TARGET reviews ons cribs, comparing prices etc. Yesterday we took off to Wilmington (about one hour south of where we live) in hopes to find something cute but NADA. Absolutely nothing. So we went to TARGET and looked at the only crib they had there. My husband first didn't want to get it since there was plastik on the bed (where you push and slide one side up and down) but I told him that it got very good reviews (average of 4 stars) and for the price 140 Dollars it looked pretty good and comes with a mobile and vibration thing and a trundle drawer. We bought it, sliced the box open to get everything in our litte Toyota and he put it togehter last night. I love him for doing that since it was already 9 pm and it took him two hours to figure the (completely messed up) instructions out. He made it and the crib lookes very cute. We need a mattress now and then we have at least one thing standing. It suddenly is sooo real that we are having a baby. I mean, it took me a little while to sink in and now we have a crib standing in our bedroom. I was just standing there staring at it and thinking about this little bundle sleeping in it..our son, our baby...I can't believe it

    That's cute! We have been putting off buying the crib for that reason.......We'll sit and look at it and drive ourselves crazy waiting! So for now we are only buying practical stuff, baby supplies, moniters, etc. Once Christmas passes we will shop for the crib, stroller, etc. Won't seem so long then. Doesn't stop us from spending hours traipsing around Babies R Us, Walmart, Target, etc just looking though! :no:

  10. You can try and go back when you get your NOA's for AOS. Watch and see everyone tell me I'm wrong and that you will need EAD at least, BUT, I got my drivers license with my NOA's, in Louisiana, not CA. Every DMV is different, some will do it, some will make you wait.......They can't arrest you for trying, all they will do,at worst, is tell you come back when you have the EAD, worth a try in my opinion! :thumbs:

    Yes - you were right on target in your 3rd post in this thread, post #4 I think it was, for the reasons I stated in my previous post. This person should discuss his situation with an immigration attorney.

    Do you have any actual input based on the information provided?

    Exactly what I was talking about...........any moron knows he has the choice to consult with a lawyer!!!! At least give the person reasons as to why they should, and why it's not a good idea to do it alone. Not have them thinking they are up sh!ts creek when most of the time it's not that bad!

  12. You only need to send the AR-11 to the Kentucky address. This is mandatory within 10 days of your move and this is whether you have an application in process or not. It is not necessary to send it to everyone.

    If you do have an application pending, you need to call the hotline and change it with them. Call several times if you have to. (I had to call only twice, lol). Do not give up on this until you get a letter in the mail at your new address confirming the address has been changed on your applications. It will be a mess later on if you don't.

    Finally the sponsor needs to fill out the I-865 form (change of address for sponser), send to the address on the form. See? It's easy! It is actually as long as you keep on top of it, and it'll save a whole lot of heartache down the road. :thumbs:

  13. Obnoxious a$$ kid deserved it. He was mouthing off and trying to be the tough guy from the beginning. If kids don't get enough discipline at home and learn to respect others, then when they do mess up and act like a$$es to the cops then the cops need to take measures like these. I also believe it should be ok for cops to shoot people that run away from them too! Call me ott, but people have no respect for law or consequence anymore!

  14. A J-1 is not a dual-intent visa, once the I-130 and I-485 is accepted, the status is cancelled.
    Does this occur at the NOA1? Would the employer be notified that the person is out of status? Because if not, just like over staying this will be forgiven upon a successful adjustment.

    I'm thinking their restaurant work may have been on the QT!

    Sorry, lol, 'on the QT' is an abbreviation of 'on the quiet' or without anyones knowledge. I guess it's just slang.

  15. So here's what happened: At my interview for the Fiancee Visa at the Vancouver Consulate, I gave them the original W2 and original paystubs as part of my then-fiance's Affidavit of Support. They took these and put them in the brown envelope I was to bring for the customs officer at my POE (Las Vegas).

    Now, I just realized that these are needed for I-864 and it didn't occur to me to make copies of these documents (kicking myself really hard here). How do I get these back?? Is it possible to get these originals back? Who do I contact?

    Or would it be quicker for my husband to request copies of them from his HR office?

    Ouch, I would imagine you might have more luck trying your husband's HR office. I don't even know where you would start to get these back from USCIS. First you would have to know where your file is, I guess. Could you maybe get tax transcripts and put in a note saying W2's already submitted at POE? Doesn't it all end up in the same file anyway?

  16. For Aupair - if you leave the program (find another job and abandon the program) then she would be out of status. That's what I understand anyway from working as an aupair and with the aupair office in Bangkok.
    The example I use is from personal experience. A ski resort near by always hired J-1 visa holders from South America to work. Most of them quickly realized that the ski resort wasn't paying them much. So they got second jobs at nearby restuarants. Others left all together. Most of them confirmed that their program allowed them to change or add another employer. Perhaps everyone involved was breakng the law.

    I'm thinking their restaurant work may have been on the QT! My J-1 was non-transferrable, it was a work-study programme, I was teaching at the same school as I studied. Any J-1's that I know of are issued for specific programs, usually through colleges and are related the student's areas of study.

    Yeah, I get a little unsure when the case isn't your standard vanilla case.

    That's understandable Lucky, and you have been involved in this for quite a while now, so you know it's not actally as daunting a task as one might think....tedious, yes, but not always complicated. Imagine how daunting it is for a new user who doesn't know anything about the system. I think the standard lawyer answer may scare newbies off into a longer period of inaction on their cases thinking "OMG, what have we done, can't do it without a lawyer," or wasting 6 months saving up a $2000 retainer, because let's face it, no lawyer is gonna say "you don't need me!"

    All I'm trying to say, is that maybe if the only 'help' someone can offer is 'get a lawyer', maybe they could hold off for a while to see if there is actually somebody who has had the experience before them. Or like Wench did, find something in writing that provides info applicable to them. No matter what the situation is, someone out there has been through it already!

    Sometimes not 'helping' is 'help' enough! :help::P
