  1. Hi guys,

    Do you know any December filers already got EAD/AP approved? I haven't seen any approval yet.

    My online status for AP is in "card production" and has been for almost three weeks. EAD was showed the same status, but went back to "inital review" a few days after it had changed...

    I got my biometrics letter in the mail, dated 01/19... too bad I didn't get it before the weekend, as we were in Denver for a few days and I could have tried to do a walk-in...

  2. Were you already married when she entered the country on a visa waiver? Because if that's the case, I don't think you can apply for AOS... someone please correct me if I'm wrong!?

    If she entered on a visa waiver and then you decided to get married, with no prior intent of getting married, then yes, you can file I-485 and I-130 and she needs to get a medical done by a civil surgeon that USCIS recognizes (you can find a list of civil surgeons on their website).

    If you were already married before she came to the US, she'll have to go back to her home country and you'll have to go through a different process for her to be able to the US and gain permanent residence.

  3. I was about to say 'Congrats' but still you'll have your hard copies now. Give them some time to make it right since there was this address change thing going on. I'm still waiting on my update for I-765. They got it on 29th of December but still no updates. :crying:

    Oh and I was wondering I came here on J-1 as well but I never had gotten my biometrics before. I came here as an intern with J-1. What program were you in? Just curious.

    I was here as an intern as well, the sponsorship organization was WISE... they took my photo and prints when I had to go to the consulate in Berlin to apply for the visa.

My gosh... this is starting to drive me nuts... today we received hard copies of the address change going though dated on 01/05/12, the day we changed it... and then later email notifications that (again) the notifications for I485 and I765 were sent back as undeliverable... the status for the I765 is back to "inital review" (while the I131 is still on card production)... I really don't know what to think anymore, it's such a mess :-(

    Wow, I have never heard of getting EAD before biometrics --that's sooooo fast! I'm in NY and I don't think I'll get EAD or AP for at least another MONTH, and I filed before you!

    Thanks! I was really confused about it too... but they took my biometrics before I moved here on my J1, so I guess they were able to use those (the lady at the hotline said they do that sometimes). Beyond excited though, the area we live in is super expensive and it'll be nice to have both of us making money again soon!

  6. So, last night I got updates on the I131, I765 and I130, the e-mails said:

    "On January 6, 2012 we mailed the document to the address we have on file. You should receive the new document within 30 days."

    The status of all three says "card/document production"

    Holy smokes?? I'm so confused right now... with all the drama with our PO Box, and I haven't done biometrics yet... can that really be the EAD/AP already?? Or would they send updates on anything send in connection to those forms?? And maybe I'm just being stupid, but what document would they send regarding the I130??

  7. So, I checked with our local post office and they send all undeliverable mail back the same day... so I guess our NOAs are on the way back to USCIS...

    My husband called the hotline again, and the guy we talked to was nice enough to help us fix the address in the system, so hopefully from now on we should get the stuff in our PO Box... We might just have to live without NOAs...

  8. I'm not sure what happens to the mail that is addressed to the physical address, as I have never had anyone try to send anything here...

    I told the guy at the hotline I was worried the mail wouldn't get to us, he said h can't really help me until it's been 30 days since the email notifications, cause then they could see what happened to the biometrics letter, but for just the notifications he couldn't help me. He wasn't able to tell me which address the notifications would have been send to...

    We have no relatives in the area, my husband's parents and sister all live on the east coast... Started a topic to see if anyone had advice earlier, but didn't get any answers so far

  9. I'm starting to get worried our hardcopies may have been sent to our physical address instead of the PO Box... We can't receive mail at our physical address... received the email/text notifications on 12/20...

    Do you think it's just a delay because of the holidays, or should I really be worried they won't get to me?? I'm getting worried that I might miss the biometrics letter on top of the NOAs... any advice???

  10. If I need the Xray, apparently they can do it on the same day during the second visit, so they said on the phone, so I'm not too concerned if it has to happen. It has been quite a while since I had my TB jabs, still have a pretty mean scar however haha!

    I see that you Ines have only just send all your paper work off recently. Good luck with everything coming up, im sure it will all go fine :)

    Thank you! Even though we just started, the waiting game in no fun lol. Best of luck to both of you as well, from what I've seen and read so far, it sounds like you have a pretty straightforward case there!

    Good for you that they'd be able to do the x-ray on the same day, if it becomes necessary. I had hoped mine would turn out the way it did, just to save the money the x-ray would have cost...

  11. So the stop clock officially starts when the NOA has been sent? Will I get an email to state this has been sent? Or will it just arrive by post?

    I phoned the closest Civil Surgeon and they were actually extremely knowledgeable and helpful. I have an my first appointment with then next week, and my second two days after that. She said on the phone, that at my first appointment, as I dont have any shot records, they will give me a blood test, as well as all the shots they offer, which is fine, at least they will all get topped up! Then two days later, I will have to go back for the results of the TB skin test, which will come up positive in my case as I know I have had a TB shot before, and therefore I will need a chest X-ray after on that day, to confirm I don't have TB. Then they will issue the sealed documents I require.

    Although I'm lucky and I'm positive I don't have any medical conditions whatsoever, what would happen if for instance, I have something I was unaware of? What are they looking for, and what is there that you could have, that may have them refuse you through this whole process? I'm just curious I guess. I've never had any issues to date, and I'm sure that is still the case, but always nice to know I guess!

    And obviously, it appears that everyone here seems to recommend not bothering with the attorney. Just for my own peice of mind, are there any negative effects to having an attorney involved in the process at all, aside form that of cost?

    Not necessarily! You might be lucky and not have to get the x-ray. I had the TB shot too when I was younger (the civil surgeon said it was pretty common in Europe), and have had two TB skin tests (one in 2004 and one now) with no reaction, so I didn't have to get the x-ray. I'll keep my fingers crossed that you are equally lucky!
