    My wife is a US citizen by naturalization (she became a citizen in April 2011)

    We got married in June 2011 in US. (I was here on F1 visa)

    I am now applying for AOS by submitting i-130 and i-485 (along with health form and affidavit of support and g325a)

    Just wanted to make sure if procedures are same for spouse of US citizen by birth and Us Citizen by naturalization??

    If there anything that i should be careful about?

    I am filing for an adjustment of status (i-485 + i-130)

    While filling out form g-325a, where they ask for Applicant's employment last 5 years:

    My wife worked for a health insurance compoany through a staffing agency.

    So although she worked at the insurance company office, her pay check was run by the staffing agency and her W2 also says staffing agency name.

    Question 1: So which company should I list in the employer, the insurance company or stafing agency.

    Question 2: She has worked a lot of different places for short time periods while in college and we dont have details of all these employer names and dates.

    So how important is it to provide all these details for 5 years accurately?

  3. If you are including your income, include a letter of employment from your employer stating your income will continue once you are granted your new EAD or GC.

    Thanks ceadsearc. Do i also need my paystubs from 3 months.

    And what about paystubs for my wife and employment letter for her?

    She is working on a temp position (actually it is a permanent job but the term they use is temp.. will that be a problem if i have to submit an employment letter for my wife?

    I am filing for an adjustment of status (i-485 + i-130)

    As of now I have no plans to travel to my home country but I mught plan before my AOS process is complete.

    So would you recommend submitting i-131 along with my application for AOS?

    If I do, what will be my Part 2: "Application Type": I think option D (Advance Parole)

    Also since i dont have any concrete plan yet what will be my intended date of departure and duration of stay?

  5. You can add your income to your spouses income - for the 864.

    As long as the same source will continue after you become an LPR.

    Follow the instructions for more details.

    So when I include my income I should also include my W2 and tax returns right?

    So along with filled and signed i-864 I should include both me and my wife's W2 and tax returns.

    Am I missing out on anything?

  6. Hello everyone.

    I am in US on a student (F1) visa working on EAD (employment authorization document)

    I recently married a US citizen (by naturalization)

    I am applying for AOS by submitting i-485 + i-130

    I have a question i-864. Our household size is 2 (125% poverty guidelines $18,300)

    My wife's income for last year (2010) was abt 20,000.

    This year (2011) she was unemployed for 6 mnths.. but based on her current job her annual income is 35,000.

    Will W-2 and tax returns of 2010 and her income this year suffice to prove she can support me?

    Or should I submit my returns and add myself as a joint sponsor? I have also been working for last 1 yr.

    What other documents should I submit with i-864?
