  1. No you don't have to wait for a decision from uscis. I personally went through the same thing. I was refused a k-1visa in January 2012,my file was returned back to USCIS but I just went ahead and filed another petition the following month before a decision could be made on my first petition. My second k-1 was approved with no difficulty. Iam currently in the states. So you can make it too

  2. - Thank you for your questions:-

You did not give us any details about the reason of return or what the issues are. You said you addressed them.

CO believed that our “relationship is a sham entered into solely for immigration purpose", because I didn't know much about my finace's ex and how she was sponsored by him 10 years ago.

Waiver for what ? Was there a misrepresentation ?

Filling Limitation waiver, because my had fiance filled a k1 for his ex 10 years ago. Now he is filling for me

You said you "attached a waiver..." to your current petition but then you said "I wonder if i need to fill an I-601 waiver later .....".

I'm beneficiary. I wonder if i need to fill an I-601 waiver later on my interview, because VSC let our previous K1 petition expired and didnt want to work on it any longer, hence we don’t have any chance to rebut CO’s accusations; our problems/faults from this k1 petition are still on their system. On refusal sheet, it said: If USCIS revokes the petition, beneficiary may become ineligible for a visa under section 212(a)(6)©(i)

Don't worry about the first k-1. I was denied my first k-1 in January 2012 for similar reasons but we went ahead and filed a second k-1 and I made it on the second try which was January 2013.

  4. Thanks, everyone!

I just flew in this afternoon from a 3-day stopover to see some friends in Holland on the way back from Africa, and Aaron and I were speculating on the phone about when the embassy might get around to issuing the visa and sending it out, since I'd checked at the end of the business day on Friday and there was nothing listed then. But then when I got home and checked online, a record had been added and his passport/visa is now in transit. !!! Not sure why it was shipped out on a Sunday, but I'm not complaining. He's already saying his farewells to friends and wrapping things up at work, so we're on track for him to leave very soon. Surreal!

For those of you who've done the whole POE thing in the U.S. recently, what does he need to have with him when he lands, other than his passport, the visa, and his x-ray?

So happy for you both,Congratulations! How was the interview? Where you able to attend or allowed to reach the consulate area?

  5. Hey all,

My petition was approved on 0ct/03 and assigned a case number by NVC oct/10 but today when i checked the uscis website it shows that our approval date has changed to oct/29 today. I was hoping that our file is already at the embassy by now since it was received and already assigned a new case number by NVC about 2 weeks ago but now iam all confused. We neither recieved the approval hard copy nor the NVC letter yet.

Anyone had this happen to them?

  6. You pay by M-Mpesa,actually i asked someone about how she managed to do the payment before going to Nairobi and she directed me to a certain place in Kampala,You have to buy a safari com line, have it activated. The M-Mpesa guy will show you how to do it,you can pay the guy in Ugandan shillings then he'll convert the money to Kenyan shillings and make the transaction for you.Just go with the equivalence of $240 in Ugandan shillings.

  7. Please fill out your timeline.secondly you can't present such forms on your interview, why give them a reason to refuse your application?Try to be organised and if am not mistaken you can download those forms free of charge.

    Good luck

  8. Nairobi consulate seems to be a tough place. Am already getting scared and with our case, it will take a miracle to get the visa.

Yes its a tough consulate, you just have to be confident and don't let them intimidate you or even get you folded.Thats what happened to me in january, just know that its not like any other interview, make sure you stand your grounds and defend yourself.

  9. My fiancé is also using Easy fiancé visa services. Dorah28 what do you mean by front loading of petitions?

Front loading means sending lots of evidences not just 5 pictures,2 emails,2chats and 2 phone records like how Easy fiance visa tell us to do on their website.Susan in Nairobi they barely look at the evidence you bring with you on the day of interview so its advisable to send lots of different types of evidence with the petition. The consulate makes decisions prior to the interview depending on what you submitted in the innitial petition

  10. I see...and may i ask how is your application going this time?....

Good i guess,We didn't receive any RFE's on our first petition,we got a quick approval in just 3months and we haven't yet received anything like an RFE on our second petition,Its 3 months since we submitted it,so i believe they are good at doing the paperwork,Our case worker MR David Roudriguez is a good guy

  11. Its definately a good agency,my fiance hired them to help us with all the paperwork,i can say they are good, reliable but they know nothing about how to deal with high fraud consulates, the agency had no idea about the importance of front loading petitions for applicants that come from high fraud countries.I was denied a visa in January and i believe it could have been avoided if we knew something about front loading a petition.Actually they offered to help us submit a new petition at there own expense. So Easy Fiancevisa is good and iam sure you'll have a better outcome because Philpines is not difficult on fiance visas

  12. She said, "I am not convinced of your relationship, how can you do that, how can you marry someone from Harvard"

She said she was "Not satisfied with the relationship."

He was interviewed by the infamous blond...I am devastated but trying to keep my chin up.

Oh sorry about that, but you still have a chance. The blonde woman is fond of talking over people, just advice Dan not to let her talk over him next time.I know he'll make it.Sometimes we Ugandans tend to be very humble and respectful.

  13. Without personally knowing anything about what Dorah submitted with her petition or what she and the CO said to each other during the interview, it's hard to know exactly why a visa application was denied. I hope the petitioner's absence was not the only reason, as I am also a USC petitioner with a Ugandan fiancé, and I will also be physically absent (albeit in town) during the interview. We submitted a wide variety of solid evidence of our continuing relationship (and plan to amass more before the interview) and have no red flags, so I am optimistic that we will be okay.

Every case is different,am sure yours will be alot better than mine

  14. That's good to hear! I hope things work out better this time. What are you doing differently with the petition this time?

Smile...Actually nothing was wrong with my petition but the mere fact that my petitioner wasn't around contributed to my denial so he's definately going to be around this time,i thought everything would go well with just me having all the necessary documentation and answering the questions correctly but i was wrong.

It was a terrible experience,i had no idea what visa interviews are like but believe me i learnt my lesson the hard way.

  15. Welcome, everyone!

Dorah, I remember you from the Nairobi embassy thread: have you decided to start over rather than getting married and applying for a spouse visa?

Yes Afoyoswa,we were advised to start over, this time all bases are covered and pretty sure things will go well.Although we had a formal engagement in Uganda I don't really have a big family in Uganda,Its pointless for us to get married in Uganda with only my sister to attend yet we can get married in the states where his family and friends can attend
