  1. @ Dorah28: Just to clarify, I am the American petitioner. Will I have to go to Nairobi to present those forms or can my Ugandan fiancee do this on her own? Thank you.

    [/q

Yes your fiancee can present the forms ,i personally went through the nairobi consulate in Jan but my petitioner wasn't around.Just make sure you plan things accordingly

  2. Hey all

We received our NOA 2. Glad I didn't start to worry too much. But on it they list our consulate as "Kampula". Literally misspelled Kampala. Anyone else here from UG? I am confused how the process works. I had heard that we all go through Nairobi. Does Kampala get it first and send it to Nairobi?

    Thanks!!!

    Kelsey

    Hi there,

Just dsregard whats written on the NOA 2,I had Kampala written on mine but all immigrant visa applications for Uganda are processed by the Nairobi consulate.NVC will correctify that on the letter you'll receive in a few days from now.

  3. Received NOA2 Feb 1st, valid until May 30th. I need to take a contract job in Antarctica (still considered a US job) until October to raise money so I was going to delay sending packet 3 (?) until close to the May 30th deadline. As I understand it packet 4 follows? Is there a time limit on that also? If so, I will stall in sending that also. Then hope I can delay the interview until October when I return to the US, perhaps by canceling the first interview as somebody suggested. Does this seem possible to stall for so long?

Also, we have child together if that helps our situation at all.

    thanks in advance!

    Hi there'

There's nothing like sending packet 3 and 4 at the Nairobi embassy, you'll have to present those packets on the day of your interview however i'd advise you to keep in contact with the embassy so they don't think that you abandoned the petition.Am assuming you're from Uganda because all immigrant visa applicants from Uganda go through Nairobi embassy

  4. Thanks for the information. So, that's how it goes (correct me if I'm mistaken, please):

    1. Plan and schedule for medicals from your country.

    2. Fly to Kenya the day before medicals

    3. Have the medicals (takes 2-3 days?)

    4. Pay for visa at the post bank

    5. Schedule for the interview online and hoping you get it within few days

    6. Go on interview

    7. ...

    Thanks heaps!

Medicals take 2 days and you can also pay for the visa fee before the medicals are done.it will save you time.Actually what i did was to pay for the visa at the post bank just on my way back from the medicals so by the time i was through with the medicals i had already scheduled for the interview. There always openings on the embassy website, you'll be able to get an interview date in about 3days.its very easy.

  5. Hi,

    Sorry to burst in.

From what I understand, you traveled to Kenya with all completed documents, paid for the visa fee, schedule for the interview, wait two and half weeks, have medical exams in between (right?) and finally go on interview. That's a long trip! What about those who live far away and can't stay that long in Kenya?

    Hi there,

I scheduled for the medicals just 3 days before the actual day,i traveled to Kenya the day before then had my medicals done on jan-23 and 24,i paid the visa fee at post bank on the first day after the medicals then i managed to schedule for the interview online a few hours after depositing the fee at the bank.

I had my interview on Jan-26, just 2days after the medicals.

so i basically did all in less than a week, the whole process is fast if planned accordingly.

    Hope that helps.

  6. I think the fact that you need to follow the directives on the red 221g far outweighs an error on the behalf of the CO.

Depending on the harsh treatment i received from her,iam 100% sure that she was out of her mind that morning,i wasn't given a chance to prove anything.

This whole process is both time and money consuming so am not going to ignore such fact just like they wouldn't ignore any loopholes on my petition.

This is not a common error, and the consular officer is supposed to be more keen than us the applicants

  7. See? I KNEW it was the blonde woman...she can be extremely hard...but, other people have had her and had no issues at all  I am sorry for everything. Did she ask if your Fiance was with you and how many times he's visited?

she didn't ask about my fiance being out or how many times we've met.and also never gave me a chance to defend myself, she kept talking over me and yelling

  8. The emails I was referring to were the ones that we sent in with the I-129F package...not at the Embassy level. However, we did bring emails with us to show an ongoing relationship, but were not asked to provide them.

Providing emails from back from April until now only show an ongoing relationship...I'm not sure why she suggested anything else. If she didn't look at them, how did she know you had emails from April?? Were they included in your original petition package?

Your fiance can try emailing them, but you may have to get married and then apply for a spouse visa and go through the process again. The CO's are tough...I don't know why she gave you such a hard time. I think I know who she was...Ben had her. Was she a blond woman in her late 20's early 30's? If so, yea.....she's a really tough nut to crack. I'm sorry you are going through this.

Was there anything else that happened during the interview that could have caused the denial??

Yes its a blonde chic who looks to be in her late 20s.she actually didn't see any emails i showed her my oovoo call records that showed all the way from April thats why she wondered why i was keeping such records,i told her its on a computer my fiance sent me the records and theres no other way he could do screen shots of some leaving out others.

Secondly she asked me how i convinced him to come and meet me?that was kinda an insult to me,she gave me the impression that i seduced him.

Then she asked me where we met an i told her online then she said that i went online basically looking for an american,i told her i was on an african dating site and wasn't specific in my search but she was just moving up and down hence turning a deaf ear.

  9. Many embassy's are set up it seems for the sole reason to keep people apart. My husband was rejected on his first interview and we also went through the devastation , followed by his father dying right after that interview. We filed again and that time we were granted a visa. I have stayed here on VJ more than most after getting the visa to help others as a way to vent my anger at the forces that do this to families. You can be sucessful if you just keep going and don't dispair.

How long did you have to wait before filing again? We're also not giving up

  10. Oh my, I am so sorry to hear this. I can understand your frustration, it's very unfortunate. You have been given good advice by Rodceasar, apply it, and hang in there, all will be well.

I have tried to get my significant other to the states twice, but not via the K1 or K3 visas, but they have been very tough. Our last attempt was with a medical letter and believe me, they even denied that one. Pray and just do it all over again, don't let them take your life's joys away.

Thanks for the advice but we're both devastated right now,i just can't believe how someone puts judgement on 2 people she doesn't know.Someone has us all wrapped around her 5 fingers.

  11. So sorry to hear about your dilemma! The Nairobi consulate is one of the most difficult embassy's to pass through and from experience, denials are frequent and expected by many there. Most do not succeed without several interviews. I was almost in the same boat of possible denials. However, having researched this emabssy and reading several posts of VJ Members, knew that the expense over the years has taken a toll on me, so I attended my wifes interview. Although I was told that I was not able to attend, found it easy to convince the security to allow me into the embassy. If it were not for me being there as the petitoner, we would not have received the visa. Our interview lasted the entire day and I was interviewed as well, since the initial consular was rude, disrepectful and was trying her best to give a denial.

After all was done, the 2nd consular who seemed to be a foreigh service national, told me and my wife that he is extremely satisfied that we have a bonafide relationship. Evidence is key there and I mean alot (i.e. family pic's, emails, chat logs, western union moeny transfers, in our case a traditional and church ceremony showing family, etc. along with a logical progression how you met and came together as one). The 1st officer came back, after we were approved and said that we are lucky for most people are denied several times prior to obtaining a visa, if ever. Our visa was given on that very day which was great for not having to wait several days to pick it up. However, the mental stress was overwhelming and I don't think I could ever do it again.

Don't give up, compile evidence as much as possible, marry if possible in Uganda and reapply for a CR-1. Petitoner should attend future interview, even if has to wait otuside the embassy. Research, study VJ and help your spouse to full yunderstand the process and use this experience to continue on. If you don't continue on, it only makes their case that it was a fraud marriage. Feel free to contact me with any specific questions, however the advice provided by other VJ members is on track such as contacting a congressman although this is still challenging for a fiance visa considering the timeline as indicated above. Good Luck~!

Thanks for responding. Is there a chance that we can be rescheduled,my fiance has tried contacting the embassy by email and requesting for a second interview so he can come down here and attend the interview with me.

I had all the evidence as mentioned above but she just didn't want to know, she didn't even take the time to look at anything

  12. I had my interview yesterday at the Nairobi embassy,i was interviewed by a consular on window number 8,she started by asking me how i met my fiance? How old and how did i convice him to come and meet me?

She then asked me how we communicate? As soon as i pulled out my oovoo video shots and call logs ,she just yelled what the hell is this? she didn't even look at them, Then she said that how come i have records from way back in April,That i shows thhat ive been preparing for the visa for a long time and then she just pulled out a red #### marked failure to prove bonafide relationship and petition will be sent back to DHS office

She didn't give me the time to answer anything or even show her any paperwork that.Am so dissappointed i can't believe i was judged so wrongly like that by someone who doesn't even know either of us.

She ruined our happiness after putting so much time, emotion into this.

My fiance has tried emailing the embassy requesting for a reschedule but i don't think theres any chance.

    Any one please advice

  13. Oh, and about the emails...I included some of just one or two replys back and forth as well as LONG ones that included hours of conversation just so they could see how we conversed back and forth, and for how long, etc. I probably included maybe five of those altogether. I double sided all of them.

Thats exactly what i presented yesterday during my K_1 visa interview at the nairobi embassy but it worked in a negative way towards me,the Lady who interviewed wondered to why i was keeping records all the way from April and said that it seems i was preparing for the visa for a long time.

So based on that i got a straight denial

  14. Looking at your timeline it says you filed in august so having records from april doesnt mean anything except you were preparing because you both had alreayd planned to be together ... and wanted to have proof of your relationship. Im very sorry to hear that. Not sure if you can make enough noise to keep the petition there and obtain another interview or not. But you should try to do that if possible. Try contacting your congressman to get him to make some noise too.

Was there anything else in the interview that maybe you answered that may have sent red flags up to the CO? I know your upset but try to think clearly and write it all down now while you remember. If you want to share it please do.. im sure it would help the other members answer better.

There will be someobody who can tell you how to get another interview/keep the petition there if possible. Good luck...wish you the best!!

She asked me how much my fiance earns and i answered her that he earns a little more that $100.000 a year, then she asked me how did i convice him to come and meet me,i told her it was his decision because he loved me.

She also asked me about his ex divorce and i answered correctly then she said that why am i answering just exactly how its documented on the decree,so i went further and explained it in details but she was all swinging her head left right.

Yes a decision was already made even before the actual interview,my fiance is so devastated,he's destroyed, these people just don't understand ,they keep judging one person to another

  16. This is the best news I could get this morning from my fiancee, who attended the interview in Kyiv, Ukraine.

Her Visa was approved. I guess we are the lucky ones it only took us 5.5 month since filing to get the visa.

I can't be more happy then that, finally the LDR is coming to an end!!!

And here is my happy dance of today

Thanks everyone on VJ who helped me out throughout the process and special thanks to the organizers of this forum.

    Congratulations Oksana $ Max

  17. I think the Answer to both questions is NO !

Insurance has no bearing on a K-1 Visa or CR1 for a Adult Child of the Petitioner. (Not residing at home but on his own)

Your Finace needs to read his Insurance Policies well (And talk to his Agent/Carrier) and you as the Beneficiary need to know exactly what is wrote in that Policy to COVER YOURSELF.

Thanks Tim/Mav,guess am being inquisitive and picky over nothing
