  1. he needs to wait for the instruction letter, he can track it on the us visa mexico page, where he chose the dhl. once it comes it tells him if he needs to renew the medical and or interview. the medical is good for 6 months and the interview for one year. then it gives him return package instructions for medical and passport. the whole process for him to come back here takes about a month. the instruction letter took about two and half weeks for my husband to receive it.

    I just received the letter of instructions today! My husband has to redo his medical and send in the passport. Just as you advised. We are planning to leave this Monday to CJS. For the medical, what does he have to show besides his passport?

  2. My husband's waiver was approved on September 08, 2014 and I received the notice by mail on September 12, 2014.

    The notice says the approval will be sent to Ciudad Juarez where he had the original interview and to wait for further instructions.

    Does anyone know what the process is from here? How long it normally takes to get instructions?

    His medical has expired so my guess is he will need to redo them. Is there a 2nd interview for this?

    If anyone who already went thru this process after waiver approval can give me their feedback is much appreciated.

    He's been in Mexico since we started the entire immigration process.

    I filed my husband's waiver in June with a received date of June 04.

    Today, I looked on to the website to check the status of my husband's waiver. This is what it says:

    "On September 08, 2014 we mailed you a notice that we have APPROVED this i601 application for waiver of grounds of inadmissibility. Please follow any instructions on the notice."

    Does this mean what I think it means???? Was he approved? OMG.

  4. Hi, I see this post was posted in January. Have you received a response for the waiver?

    I am still waiting for a response on my husbands waiver. We filed in June.

    I am the US Citizen and I also have no kids. My husband is living in Tijuana, Mexico. He needs a waiver because he was working in the U.S. with out the proper visa. He only had a tourist visa.

    If this helps, these are some of the things my lawyer asked from me:

    -A letter from my doctor - I am a diabetic

    -A letter from my dentist - related to the diabetes and have to visit every 3 months

    -Mortgage statement - I own a house

    -A doctor letter for my father - My parents live with me and my father has medical issues

    -ALL my credit card / loan statements showing them all maxed out. (stack of them)

    -My work paycheck stubs showing how much I make in ratio to my monthly expenses

    -Wire transfer receipts - when I send my husband money

    -Bank Statements

    -Work letter from my manager stating my position and how it would effect the company if I had to be replaced

    -Work letter from human resources stating my salary, position, work hours etc...

    -Letters from US Citizen friends and immediate family including copies of their US pasports

    -He sent me to see a pyscologist

    -Copies of my medical insurance cards

    -An annual prescription report from Walmart pharmacy

    -A report from my health insurance showing how much has been paid out

    -Transcripts from my all my education. Elementary - College

    In my personal letter I basically wrote a little bit of everything above. I hope our waiver gets approved as well.

Still waiting, Just FYI update, in other groups I am in the I-601, there is has been several November Approvals, A December approval, without and Expidite...In addition, to Thursday of Last week, I saw a January approval, request for expidite on that case, but there was no exact approval...That ever went to the client....

    In addition to this Info, I spoke at an immigration symposium on Friday April 25th, where I learned that USCIS is picking up the pace internally, for Citizen related cases, because of the huge back log, I have also Contacted the CEO of Nebraska Service Center, she did respond, and stated that they are working on getting the cases out, its been about 3 weeks since I recieved her response, she said they were working October...In my other group areas all October people have been approved, (only not including if you have had and RFE or some that have prior criminal history, those seem to be taking much longer.) The actual 6-8 months...Otherwise looks like a pretty good 5 month lapse...So keep your heads up people..I will keep posting, all this is found under my research itself...USCIS still hasnt updated thier I-601 status, so I would not read that, there is no way they are on the same date they were last month, at this time last year I-601 were takeing 3-5 months tops.

    Thank you for the information. 3-5 months sounds better than 6-8 months. I just recently filed for my husbands waiver and have a received date of Jun 05. It's been barely 1 month but feels like a year already.

    He also only needed a 601 waiver. No 212.

  6. The same thing happened to my husband. His tourist visa was cancelled at the border (fiancé back then as well) for the same reasons, same code and everything. He never overstayed on his tourist visa. He already had his interview in Ciudad Juarez and they told him he only needed to file the 212 waiver. not both. At his interview they focused on all the times he entered and departed the U.S. I would suggest you gather or try to remember all the dates as this will be very important at his interview. My husband said everytime he was asked a question, the officer would check on his computer. Hope this helps. I am getting ready to send off his waiver.

    These are the things I am bringing for my husband to take with him on the day of the interview.

    Invitation letter

    His passport (with a copy)

    2 passport pictures

    Form DS-260 confirmation

    Original Birth Certificates for him and myself (with copies of each)

    Original Marriage Certificate (with copy)

    Affidavit of Support

    My 2012 Taxes

    Pictures = Few wedding pictures, honeymoon pictures, and pictures throughout our relationship

    Wire transfer receipts

    AT&T cell phone bills

    Boarding passes/Trips we took together

    Greyhound bus ticket receipts of when I would go see him in Tijuana

    Travel documents of our honeymoon

    Am I missing anything?? or suggest I take anything else.

    I feeling very nervous right now.

    I have received an email from NVC on October 10, 2013 (on my birthday dancin5hr.gif ) stating the following:

    "The National Visa Center has received all documentation necessary to complete the pre-processing of your case. As soon as an interview date has been scheduled, the applicant, petitioner, and attorney (if applicable) will be notified.

    The applicant should NOT make any travel arrangements, sell property, or give up employment until the US Embassy or Consulate General has issued a visa."

    My questions are:

    Does this mean everything has been forwarded to Ciudad Juarez?

    Does anyone know how long it normally takes to hear from them with the interview date?

    I am the petitioner and i have received an email from NVC saying they have received all the necessary documents and it is now complete. They said we would be notified as soon as an interview date is available. Does anyone know how soon after one receives an email like this do they normally find out when the interview date has been scheduled?

    Also, i am going thru a lawyer and they have filled out the applications and necessary documents. While visiting my husband over the weekend, he has "remembered" he had enterred the USA many years ago (approx more than 15years ago) on a special 12 hour permit via the El Paso border. He was part of a music group and they had an event to go play at and he said they only gave them a 12 hour permit just to go play there and return. He said they only used their identification and not a visa. He said everyone turned in the permit upon returning back to Mexico.

    My worry is i don't know if at one point up to this stage where we are at if there was a spot anywhere on the forms where we would have had to state the "first date of entry to the usa". Does anyone know? My husband needs a waiver and i know on this part he has to state all his entries and exits and we will state it there but i am just worried that all the forms we have sent already has the incorrect date.

    I already a left a message for the lawyer but you know it takes a while for them to get back to you and this is driving me crazy.

    Any thoughts?

  10. hello everybody, I am an US citizen wanting to marry a colombian national in Colombia; In order to do that my girlfriend told me I need to get a "certificado de solteria" from USA,does anybody know which office provides such document or is it something you can writte and have notarized? also the divorce decree needs to be translated and "apostillado", does anybody know how to go about that?

    Hello,

    I had to get one to marry a mexican citizen. You can get this document at the county register. They will make you fill out a short paper and you have to pay i believe around $20.00. It will come to you by mail. They basically do a search for your records from XXXX to XXXX years. Just tell the clerk what you need it for. Hope this helps.

  11. Hi VJ Friends,

    I received an email from NVC a couple of weeks ago. The email states my total income tax amount on the I-864 was enterred incorrectly as it does not match my 2012 taxes.

    Come to find out, yes, my lawyer's assistant enterred this amount incorrectly and i was told it would be corrected and sent back to NVC asap.

    Today, two weeks later, i emailed the assistant to find out exactly what date she had resent the I-864 with the correction. Her response was it had been returned as apparantly there has been an update to the form and it needs to be filled out differently. Does anyone know if this is true? Has anyone come across this problem with this form?

    I am just getting frustrated and anxious to receive and know my husbands interview date. It's seems the closer we are, the further it seems. ClockWatch2.gif

    I did go to my local USCIS office today and was not any help at all, it was to be expected. Seems each office is a different world which they lack communication. I have contacted a lawyer and I am just waiting to see what she thinks and what are the options.

    Michell, I did prepare my waiver with lots of research and also because I thought that not having any criminal record it would be easy. But they took it as everything I said they turned it around and used it against me with also comments of not giving enough explanation. I hope the best for you Michell... and yes, get a lawyer (I learned the hard way). I thought that being forthcoming and sincere would count but unfortunately it does not work that way. Good Luck and best wishes on your upcoming husband's interview!

    I already have a lawyer. We just haven't reach the waiver stage yet so will see how it goes.

  13. I'm so sorry to hear your news. Never give up! Get right back up and keep fighting. Try again and i agree with the previous response. Consult with a lawyer and explore your options. Did you prepare your own waiver?

    Was your husband working using his name?

    My husband has a similar story to yours but he still hasn't had his interview yet. Now i'm nervous after hearing your story.

  14. Hi Everyone,

    I am the US citizen petitioning my husband. My husband is currently in Mexico. We met here in the US while he was visiting on a tourist visa. He would travel back and forth and he would stay until her I-94 (6months) would almost expire and leave back to Mexico. He would stay a few days, weeks and return to the U.S. again with a I-94 permit all the time. On his last trip he max out his I-94 permit and return to Mexico 1 day after it expired. When he tried to return to the US his tourist visa was cancelled due to having reasons to believe he was living here. He has been in Mexico since November 2011.

    We married in 2012 and since then i have petition a CR1 visa for him. We are currently in packet 3 stage.

    My question is would he have a 3 or 10 year ban based on multiple entries. He only overstayed by 1 day and it was the last I-94 he received.

    Would he be eligible for a waiver?

    Any information would be helpful. I'm feeling a little nervous as we are moving closer towards an interview date.
