Yes, he is in Mexico and we are doing electronic processing.

I have read thru the links you provided and it is very helpful. It answered a lot of my questions.

    Thank you!

  2. How do you know you have a 5 year ban for unlawful employment? Similar situation happend to my husband but he was not deported. His tourist visa was revoked at the Tijuana border and denied entry to the U.S. because they found reason to believe he was working in the U.S. He said they did not tell him if he had a ban or not. However, they handed him a document stating inadmissible to the U.S. pursuant to section 212(a)(7)(A)(i)(I). Same code as yours. I'm just wondering if we will have to file a 601-waiver as well due to this. He has not had his interview yet. I've just paid the fee bills and we are still in the process.

Best wishes to you with your visa journey!

  3. You could file as jointly and get your husband an ITIN. Just remember that once he becomes a LPR he must file income taxes on world wide income. I would look at your tax situation and see which gives you the least amount of taxes paid--filing seperately or jointly.

    Good luck,

    Dave

If i file "married filing separate", do you know if i would be able to amend my taxes once he is in the U.S.? I'm not to sure how long it will take for me to get an itin number for him.

    Thank you

  4. It does sound correct. Because you ARE married, but because your husband does not have an SSN, you can't file with him--therefore, you are doing this separately. If you checked single, it would not be correct. Divorced, would not be correct. The only correct one is Married, Filing separately. Follow the IRS' advice. If you doubt it, maybe call another time :)

Click here to understand a bit more about the category you fall under.

    Thank you. I appreciate it.

  5. well im not sure what you mean, but in my husbands waiver packet and letter i had evidence that am a college student, working part time with a minimum wage. proof of all my bills. that was pretty much it :) I honestly thought that i was going to get a RFE because I didnt think it would be enough for his waiver to approved so quickly. thank GOD it has been approved. good luck to you :star:

Thank you for sharing with us. This is really going to help me when the time comes (if needed) to write my letter. Once again, congratulations and best wishes to you both

  6. Hello,

I am a petitioner and received a letter from the American Consulate General in Cd. Juarez. The letter came to my U.S Address, but the letter says my Fiancee name:

    "Dear( Fiancee name):

Your fiancee visa is ready for processing. Please go to http : // mexico.usvisa-info . c o m to schedule a ASC Appointment and a consular section"

    My question is:

Once I log in to the website, should she ( Beneficiary) input her information ( name, address, passport number) or I have to fill it out with my information? :help:

Just curious, does this letter come after the petition is approved? I am the U.S. citizen and my petition for my husband was approved Dec.5, 2012. How long did it take for you to receive this letter? We are are at 38 days now.

    Thank you.

  7. Hi Everyone,

I'm getting myself prepared for 2012 Tax filing. My husband is in Mexico and our petition was recently approved

I am the petitioner. My husband works in Mexico but doesn't earn a lot. I send him money every month. My question is, can/should i claim him on my 2012 tax filing? Would it affect the CR-1 process?

Also, i know we need to send the last 3 years of tax transcripts. Tax year filings for 2009, 2010 i had one dependant (my uncle) on my taxes. In 2011, i didn't claim anyone. Same for 2012, i will not claim anyone. Unless i can claim my husband. When looking at the chart to see what the minimum amount i have to make to qualify for the Affidavit of Support, do i have to include my uncle eventhough he is no longer a dependant on my taxes?

What is the minimum i have to make for me not to require a co-sponsor for 3 including myself? This would be worst case scenerio My husband, uncle, and myself. I will have made approximately $39,000 in 2012.

Can someone give me some advice in regards to this. I would appreciate it.

    Thank you.

  8. I think is Noa 2. you are approved and i think what is next is that they will forward your approved petition to the NVC . but the most tedious place is the USCIS stage and now that you have pass through that, you should give thanks to God for that. For me, And not all petition takes 6 months now, majority of the petition sent to NBC is moving on very fast and you are part of them. i am still waiting to hear good news of my approved petition. Congratulations once again

Thank you for replying to me. I can´t believe it. It came so fast! Now, time to prepare for the next step. Good luck to you both on your visa journey.

  9. Hi Everyone!

My husband and myself are on our honeymoon as we speak in Costa Rica. My sister texted me to tell me we received a letter from immigration. She said it´s form 201(b)INA. What does this mean??

    She said the letter says:

The petition for (his name) to be petitioned has been approved. Give processing 30 days to receive in mail.

What does this mean? What is next? Is this what normally takes 6 months to be approved? It´s driving me nuts not to have that letter in front of me. Worst of all it´s Saturday and lawyers office is closed today to ask. I don´t want to jump for joy just yet.

Can someone please explain to me what´s next.

    THANK YOU!!

  10. Hello, does anyone know if the beneficiary can travel while there is a CR1 pending?

My husband lives in Mexico and we were recently married there. We are thinking in going on our honeymoon in December to Costa Rica. The flight is nonstop from Mexico City to Costa Rica. We would NOT be connecting anywhere in USA. Would we be able to travel without interfering with the petitioning?

I will begin the petitioning process pretty soon but wanted get some opinions before i begin the process. Your opinions are apreciated.

    Thanks.

  11. From what I have been told it should not be a problem gettin married as Mexican. It's much easier to get married as Mexican than American as there is more steps involved and fees. I'm a born usc and have dual citizenship and got married Mexican in Nov 2011 I filed in Dec 2011 for her cr1 and from what I've been told it should be ok.

Just my two cents good luck

Thank you! I'm more calm about this now knowing there are people who have done it this way.

  12. Are you a naturalized US citizen? If so...technically you arent a Mexican citizen. At least that what i read when i did my citizenship. :/

Well, it's a long story but i gained U.S. citizenship when my parents became U.S. citizens thru naturalization. I was a minor at that time. Yes, the Mexican consulate said people who became U.S. citizens from 1994 or earlier lost the mexican citizenship (i gained U.S. citizenship in 1990) but you are allowed to recuperate the mexican nationality have dual citizenship (U.S. and Mexican).

I was born in Mexico and since i am getting married in Mexico, the civil registry says i have to get married as a mexican. THis is something i have been fighting over and over and over with them as i wanted to get married as an AMerican. I wanted American to show on my marriage certificate. but it's been going on for way too long now and i'm anxious to get married so i can start the petitioning process for him.

I went to the MExican consulate to apply for dual nationality so i can obtain a Mexican identification to get married as a mexican.

This is why i am asking if anyone has been in my situation and if they have had any issues thru the CR1 process. I have asked this question before and some VJ users have said no problems but now i have the last name question i mentioned above.

The marriage certificate will show two lastnames (father/mother) and U.S. passport/certificate shows only my fathers lastname.

Any feedback will be greatly appreciated!

    Thank you.

  13. Hi Everyone,

Here i go with more questions.

I will be marrying as a "Mexican" in Mexico as i have a mexican birth certificate. the marriage certificate will have BOTH my fathers and mothers lastname. My U.S. Naturalization certificate and U.S. passport shows only my fathers lastname. Will this be a problem?

I know i've asked the question before about marrying as a "mexican" but i wanted to ask about the names.

Has anyone married as a "Mexican" with both lastnames appearing on the marriage certificate and only one lastname on the U.S. citizenship/passport?

I'm very nervous marrying as "mexican". Mexico is making it impossible for me to marry as an American.

    Thank you!
