    You can try for the employment visa, most likely it would be denied.
    First for an employment visa you need to find a employer and their lawyer has to file for visa.
    Since you already have a petition for perm immigration your visa for based on employment would be denied, as it would be assumed you are just trying to bypass the F4 immigration process by employment visa.

    Guys just take deep breath and think clear,
    *First; last year when all of us were current ,no one-or very very few one- got their interview date before the VB getting out like we used to nowadays!! does it seem some strange?? since each one receives his Interview e mail/call/letter before VB getting out! but last year that's never happened!!
    *Second; if you looked at the previous movements since years ago yes RETROGRESSION never happened twice following each other no repeated RG ! if so plz correct me..
    *Third and this is very important Notice if they did that RG for any reason they have, can u tell me to which year they will retrogress when almost they finished 2006/2007/2008!! all are current right now!what they will do by the new Quota?
    *Fourth at that VB which they wrote at D,the coming movement will be from three to six weeks they were clear with us and they almost are following their word so;
    all we can expect right now HOPEFULLY is VB moving from three to six weeks and that's good at the time its moving and each one knowing for how long he should wait.
    *Finally; even if they shocked us by any RG so guys all of us /i mean most of 2009 almost within view months already will be under the category of V visa since we stayed three years away from our spouses so with retrogression or not we have that right to ask for V visa and since they didn't use it since loong time they will not push themselves and us to do that..
    well i just wanted to share you some thoughts of mine so if i am wrong at any point plz correct me and i hope the best of luck to all of us

    update: everything went through!
    basic info...
    category: f4
    consulate: guangzhou, china
    priority date: 9/2001 (current on 8/2010)
    case completed: 11/4/2010
    interview date: 1/10/2010
    [completed through electronic processing --- total time: ~5 months]
    uncle (principal applicant), cousin, and aunt arrived at the guangzhou consulate on 1/10 before 12:30 p.m. to drop off documents. he said they only took the I-864 and I-864A. i forgot about this during the filing process, but remember to make copies for each additional applicant! (in case anyone else out there is a block head like i am).
    uncle and his family went back again the next day (1/11 @ 7:30 a.m.) for the actual interview....they arrived about a half hour early, were sworn in, then the interview began. the questions that were asked:
    - what is the petitioner's name?
    - what's your relation to the petitioner?
    - where does the petitioner currently reside?
    - do you (principal applicant) intend to work after arriving in the u.s.?
    - what are the names of the other applicants and what is their relation to you?
    they received the final results before 10:00 a.m. guangzhou time (around 6:00 p.m. pacific time)
    after almost ten years of waiting...can't believe they're finally coming (after chinese new year)!

    Keep Calling NVC and DOS ( 202-663-1225 Press 1 then 0 for a live operator) and as experts believe in this forum, NVC does schedule for interview preparation throughout the month and based on the present scenario, NVC will schedule the final December interview by next week, Right now Mumbai IV appointments lists upto December 19th while in reality many people got Dec interview upto 30th..As ur case got completed by November, I believe u can make it for the second slot of the Interview schedule for Mumbai..there is still some hope...

    If visas are available in your visa category before your child's birthday, the NVC may be able to expedite your case so that you and your child can immigrate together. Unfortunately, if visas are not available before the child's birthday, the NVC cannot expedite the case.

    Newbie, I'm also an F4,PD April 2001. Interview completed on 10/04/11 already in NYC,Federal Plaza, but waiting for visa. Don't know how long that will be.

    Hey Folks,
    Especially folks from Gujarat and those who need to go to Ahmedabad Passport Office for passport Clerance certificate, below is a useful hints, tips or information for all:
    On 1st Nov, 2010 I personally visited passport office in Ahmedabad and stood in the line for pcc. At the gate of the building compound entrance the security person asked what are you here for and where is your doc's. (He didn't check anything thoroughly, just glanced it). After entering to the compound, I saw that the another security guy was asking for your purpose of visit and sending people in two different queue. One queue is of-course for passport applications and another one is for PCC. There were about 30-40 people in the queue for pcc. So everyone was doing final arrangements while waiting for their no. to come.
    I have also noticed that before even they allow you to enter to the passport office, your documents and forms are being checked by another officer who stands outside the passport office door. Well, I kinda knew that I will not be allowed at the passport office since at this stage I do not have the 'CHECKLIST LETTER' OR 'INTERVIEW APPOINTMENT LETTER'. (I went with some of my relatives who are ready for this process). Below are the facts that I can share with all VJ'ers :
    Here are the facts:
    1. Passport office will not issue PCC without having 'Checklist Letter' OR 'Interview Letter' in hand FROM NVC. (This is well known to everyone by now). - IV fee bill OR PAID fee invoice are not considered by PASSPORT OFFICE AHMEDABAD for pcc purpose.
    2. If your case is F1, F4 or other kind where you are the Beneficiary and there are derivatives in your case, such as children and/or wife than,
    Passport office asks for separate checklist letter for each derivatives including main beneficiary. (It's bullshit, I know, because NVC doesn't issue such kind of letter), OK! NVC issues checklist letter and that contain names of all DERIVATIVES. According to passport officials - they do not want to accept this as checklist letter for derivatives, instead for any/all derivatives, they want CHECKLIST LETTER OF their own name. (I LAUGHED A LOT, BECAUSE THIS IS LIKE ... Chaaa Karta Kitli Garam....lol... NVC DOESN'T DECIDE ALL THIS, IT IS BEING DECIDED BY THE PASSPORT OFFICE. HAHAHAHA)....
    SO HERE is the whole story,....so this could help some people across gujarat, India who are in this process........

    According to the law (7% per country cap) means:
    All family preferences (F1+F2A+F2b+F3+F4) including IV visas and Adjustment of status including family and employment
    (bcoz H1 will adjust their status through employment one) = 226,000(family) + 140,000(employment) = 366000 Total numbers
    be issued to all among the world.
    India's or any other country's 7% cap means = 7% of 366000 which is = 25620 (including all family IV visas and adjustment
    of status (includes all family preferences) + all employment in a fiscal year)
    15,820 is the total number of visas and adjustments of status that can be issued to the citizens of any one country in
    the Family based categories, 9,800 is the total number of visas and adjustments of status that can be issued to the
    citizens of any one country in the Employment based categories.
    The 7% cannot be applied to each category or sub-category. One can immagine, for example, a scenario in which all of a
    particular country's 7% limit is consumed by adjustments of status. In such a situation there would be no visas issued in
    either the family-based or the employment-based categories.

    Your family still can go to the interview and you don't need to adjust the interview's date. They will ask for your husband medical examination result, but it is okay if he doesn't have it. He will have it after 9 weeks of the sputum culture. If your husband is the principal applicant, the derivatives will not be granted visas. If your husband is a derivative, the rest of derivatives may be granted visas if the principal applicant is granted a visa.
    thanks carol for the relief...i am the principal applicant my husband and my kids are my derivatives.thats my point i dont want to move my interview date.thanks a lot

    Just a note for your family: Please follow instructions of doctor to prevent the contagious of TB disease. I didn't mean that your husband has TB disease. But it is safe for everybody if we know how to prevent TB disease.

    Hello guys...
    I wanted to explain what I think:
    I think, I am not sure that by looking forward to interview letters we can say that Visa Bulletin will move forward or not!
    I am explaining :
    In October 2010, they issued the new amount of visas, and then suddenly in December 2010, they realized that, they issued too many visas only in 2 months and they have
    10 months ahead! That's why the retrogression happened!

    By that time , NVC had issued many interview letters and also many people got interviewed.
    So there are plenty of cases that have been interviewed, they went into AP, and VB retrogressed, and then they are just waiting for their PD to become current again !
    Then, in my opinion NVC will not issue so many interview letters, because there is already plenty of people whom got interviewed and waiting in the queue,
    why should NVC add to this queue?
    Therefore I think that VB will move forward, despite even no interview letter has been issued by the NVC, and my guess is 3 months forward movement in Oct. 2011 Visa Bulletin.

    I can understand how much u miss Jamaica..It is natural all the immigrants personally miss their hometown especially for F4 Visa filers as most of their lifetime is spent there..Good Luck for your new hometown US too..

    yes...i hope so too....but one thing i have marked since last two months embassy in india is assigning 30 to 40 visas to f2a every month....and in the past after retrogesion it was assigning 70 visas per month......this is the proof...

    see the difference when they have no visas they are allocating most and now new fiscal year they have new 88000 visas and they are not alloting......can anyone explain the reason?????
    if this continues my prediction is 1 month for every moth and if they are going to allot the full quota then it will be atleast 3 month advancement....
