Our case is @Long Island Office (Queens). Our case was updated to Testing&Interview stage in Dec 12th. We have been waiting since then w/o interview scheduled.

Today, I got an RFE for both I-765 and I-131 because of missing proof for pending AOS. It is really weird since I mailed three applications altogether. It doesn't make sense to me since USCIS is the authority who is processing all three applications and NBC is currently processing them all. How come they couldn't check whether I have pending I-485 or not? It is so silly.

I filed mine in Oct 26 and it is still not showed up yet.

Unfortunately, USCIS web site is totally a joke. It is very very primitive comparing with current web technology. You can even see this when you attempt to open an e-service request. I remember those kind of web forms 15 years ago. My guess is they have pretty good IT resources responsible for their internal system but very insufficient resource for their web application. I even doubt they have IT personnel for such live site issues.

This is an indication how they prioritize the customer service.

Our AOS package was received by USCIS in Oct 26 and our NOA1 date is Nov 6. I haven't got my biometrics appointment letter yet. I am seeing people getting their appointments few days after NOA1. Is it still early enough to worry? I am also from NYC area and I heard some office closures for few days due to hurricane Sandy. Do you think this might be the reason? Is anyone in the same situation and still waiting for the biometrics?

- Reviews case for required criteria (e.g., signature, correct fee, visa availability)
- Accepts fee
- Sends receipt notice to applicant/representative
- Assembles case
- Captures data and transmits to NBC
- Ships application/petition to NBC

[*]NBC:

Schedules biometrics appointment and mails biometrics appointment notice to applicant/representative
Ensures application contains required initial evidence
Consolidates application with existing applicant files
Conducts security checks

NBC REQUEST FOR EVIDENCE

On average, 32% of all I-485s received at the NBC require the need to request evidence to prepare it for the Field Office interview/decision
The NBC has completed an analysis of the common reasons why RFEs are generated and developed a tip sheet for how to avoid processing delays.
The most common reasons why Requests for Evidence for Family Based Adjustment of Status (I-485) are sent:
- Affidavit of Support -> 56%
- Medical Report/Vaccination Report -> 20%
- Birth/Marriage Certification -> 19%
- Other -> 5%

Why don't you just send a copy of your naturalization certificate along with I-485 of your spouse to USCIS? I don't think you need to email NVC at all since your spouse is already in the US.

I was thinking as a courtesy But I don't want to wait an hour on the phone to do the things I don't have to do.

you can file for advance parole and EAD in the meantime though right? Isn't that fast?

Yes, we did those, too. Only drawback I can see of this is the time to apply naturalization.

Good luck. I'm sure you know this, but in case not, spouses of US citizens can do adjustment of status even if they overstay so don't worry about OPT expiring.

I'm curious, why does AOS take longer than consular processing? It was my impression that for most AOS cases, interview isn't even done?

B/c we have just filed AOS and if we hadn't done so she would most likely got an consular proc interview sometime in dec or jan 2013. Based on processing times, AOS would take five months which is march or april.

Good luck for all F2A members.

Things are going good and bad on our side. Our priority date is Sept 2, 2010 for F2A. But recently I became a US Citizen and I e-mailed my naturalization certificate to NVC in Oct 12. NVC is still processing it. My spouse is already in the US for five years under F1 visa. We have been waiting for visa over two years. And she has a very tight schedule for consular processing interview as she has only 2-3 weeks during winter break and also her OPT is about to expire. It seems hard to travel to home country and show up to interview so we decided to go for Adjustment of Status. It's safer but definitely longer path at this point of time.

We haven't informed NVC yet about recent AOS application. Waiting times for phone is killing.

Yes, actually, election board officials came to the ceremony and they distributed the Voter Registration Forms and collected them just after the ceremony

Anyway, I am trying to be patient as much as I can. I will not be able to vote in the coming election, but I guess in NY one voter more or less doesn't really matter.

I think you should give a call to USCIS and ask to talk with tier-2 rep. You have paid a fee (plus taxes) for this processing and you have right to expect reasonable service.

Here is the end of story. I had my oath at Cadman Plaza, Brooklyn NY. It took way too long than I expected. I checked-in around 8:15am and judge appeared at 12pm and total time I stayed in ceremony was over five hours. It looks like it wasn't an exception but a normal procedure since USCIS officials have to do some pre-processing (they call everyone for signing certificate, name changes, warnings, right and responsibilities after citizenship, etc.) before oath. I would strongly recommend you to bring magazines or books to entertain yourself or find somebody to chat with. After all, most of time was passed basically just for waiting. My other observations:

o Security collects all cell phones at the entrance of building.

o You are allowed to bring guests but they send guests to the cafeteria upstairs where they can watch ceremony live from a TV.

o Oath part was pretty emotional and our judge was pretty passionate while speaking and we felt her energy and enthusiasm.

o You are allowed to go out for short breaks but you need to make sure to be there while judge shows up.

Last but not least, I really enjoyed following this forum and I found all answers of my questions from this forum (I think this forum saved me thousands of dollars for lawyer costs :)). I wish you good luck with your journey from my heart and welcome as a citizen in advance

I had my interview at 7am in Queens Field Office today. It was a pretty quick process. It seems like USCIS employs a good number of staff for interviewing candidates. As far as I remember, I saw > 10 different interviewers calling for interviews. I waited around 20-25 mins. Interviewer was nice and polite. She spent some time on my international travels in past. She checked the each date and counted those. Rest part was as usual: going over civic, English tests, and yes/no questions. She told me at the end that I passed (although she mistakenly stamped "Denied" on my app ) ).

She asked me choose to wait my oath letter (for an hour) or wait it to be mail. I preferred to stay. My oath is scheduled for Oct 12.

I am pretty glad that I got my oath sooner than I expected since we have been waiting for immigrant visa for my wife for > 2 year. Her OPT is about to be finished. We finally get a chance to upgrade her application and get her an interview.

Too funny..... FINALLY I was schedule for an an interview today September 10, I just got the text right now 20 minutes after calling uscis. Now just a matter of waiting to see when I get the letter and for what day they schedule me for. Good luck to all the other New Yorkers,.hope you get yours soon.

I am happy for both of you. An interesting coincidence was that my interview was also scheduled in the same day I called USCIS. In spite of more applicants, I agree that NYC Office could do a better for responding applications. They simply could employ more staff or could schedule oath ceremonies sooner.

Based on most recent NYC filers, interviews are being scheduled 3.5 months from biometrics date for a normal case. Oath takes another five weeks from interview date.

I called them after 30 days but they keep saying the answer we already know: "NYC is currently processing cases from Jan 2012".

So happy for you.....happy for new too. because hopefully it means I'll get mine soon too. Because I got my fingerprints done the same day at the same location.
