  1. The only other way to get an EAD card without doing AOS is to apply for OPT [either pre-completion ©(3)(a) or post completion ©(3)(b)]. However, that will only allow you to work and stay here legally with your husband for one year.

  2. Thanks for the response, NLR. I was aware of the physical characteristics of the service centers/local offices. I just was not sure what is processed where, since I would see on here sometimes people would say their cases were transferred to their local offices. I wasn't sure if it is just a workload thing, or if it was case specific, so thanks for clearing that up!

    3 weeks sounds like a normal vacation time. All the documents that you mentioned sounds good. When I went for my visitor's visa interview, I also just took my contract letter for my job, and some financial documents. No documents can ever guarantee a visa, since they look at each individual's case. The country you are from also plays a role. But whatever documents you think will proof that he has to return to his country will be sufficient.

  4. The package you want to prepare is not exactly what they are looking for. From the Department of State website:

    Note: Visa applicants must qualify on the basis of the applicant's residence and ties abroad, rather than assurances from U.S. family and friends. A letter of invitation or Affidavit of Support is not needed to apply for a nonimmigrant tourist visa. If you do choose to bring a letter of invitation or Affidavit of Support to your interview, please remember that it is not one of the factors that we use in determining whether to issue or deny a nonimmigrant tourist visa.

    So I guess you can submit it if it will make you happy, but from the above statement it is not going to be used to make a decision.

    Edit: And yes, I do realize you have done this before for your in laws, but again, that would not have determined their eligibility for the visa.

  5. Yes send two separates checks, that is what we did. They were they only document we use a staple on a black sheet to make sure they would not get lost at the time they open the package.

    Make sure to make copies of the entire package you sent.

    I just put three paper clips with our checks--anything to make the process goes faster, right? :D

  6. This thread is a little old, but I was hoping that someone in this thread might reply, or another member might see it under "new content." Any updates AmericanToBe or smithjaxx? I checked the OKC local office processing times, and it says the last case for I-485 was processed August 16, 2013?! Does it matter if it is from a family based visa or from work/student visa, or is it all the same? I guess us in Oklahoma City can forget about the 4 or 5 month timeline?

  7. Also, shouldn't the checks be separate? $420 for I-130 and $1,070 for I-485. To be honest, VJ was my starting point and I followed the guides, but I also spent a lot of time on the USCIS website and went through all the forms' instructions. If you do it that way, you will see that USCIS states the fees for EACH form. I could not find anywhere where they state that you can combine the fees (well, they don't say that you couldn't do it either). However, I'm sure some people have done it that way and was just fine. I just preferred to do it according to the updated instructions on the USCIS website.

  8. You did it correctly. If you hover on that question in the form, it actually says "relative's present employer." And since it is the petitioner filing the form, it is the beneficiary's info.

    Edit: the information below that (question #16) is actually if the beneficiary has ever been under immigration proceedings, not if they have ever been in the US.

    Bad news: I just realized on another thread we made a mistake on the form I-130 http://www.visajourney.com/forums/topic/510823-on-i-130-form-question-15-about-employer/?p=7196401

    Would something like that cause the petition to be denied, or do you guys think will I just get an RFE? Such a simple thing. I looked everything over so many times!
