Hey y'all...well the wife is now a US citizen, and good to go. She has ordered her US passport. Now for the question, we brought her son, who is almost 8, here 2 1/2 years ago. He has not adjusted well and hates it here actually, he wants to badly go back and live with LoLo and LoLa and all the other family in the Philippines. He is still a Philippine citizen, has his Philippine passport, so we wondered about flying back to the Philippines and let him live there for a while and see if he misses living here in the US. I mean since the wife has become a US citizen does that change the boys status?
We know lots of Filipina's who live here in America and never brought their kids here...they just go back and see them on vacation...so other than the emotional toll and such, and ideas?

We do have all the other requirements as is clearly outlined, its amazing when you look for things, haha...one thing that seems a bit confusing the Part 17. Oath of Allegiance. On the instructions it does say to not fill this part in until in front of an officer however later it states:
Your signature on this form only indicates that you have no objections to takingthe Oath of Allegiance. It does not mean that you have taken the oath or that you are naturalized.
Any guidance on this section? My wife did sign it but of course we have not sent forms in yet.

Yes Tahoma, I meant that its based on being married to me and she has had her green card for 3 years, minus 90 days...thanks for pointing that out. Tired last night.

Thanks Alaska...we have no prob sending those copies in but did you do it just to cover your bases or did the 400 ask for such things and I missed it? Just curious.

Hey everyone...well its been a long journey. We have a 2 1/2 year old daughter between us and a step son who is 7 has been here for a year and a half now.
Our quesiton is we have filled out the N400 and are basing the early filing on being married to me, a US citizen, for 3 years...which we know is normally 5 years, so we are filing under section of 319(a) of the INA.
In the instruction forms right under the 'early filing' section is the 'evidence' section. That is where I get confused, its states:
E Evidence.You must submit all required initial evidence along with all of the supporting documentation with yourapplication at the time of filing.I've read the instructions a few times and can't see where it is asking for sending of evidence and such. Am I missing anything? Did I overlook something?I ask this because I think I've read where some people have sent copies of their tax returns, bills, etc, as evidence of being married for X years. Seems a copy of your marriage cert would cover that, but they didn't even ask for that. We just want to make sure we do this right.
So before we put the pkg in the mail we figured we'd ask those who have filed before, thanks.

Hey...well in a couple of weeks we will be in the 90 day window prior to 3 years of being married so the wifey can file for citizenship. My question is about relocating to another state AFTER the N400 is filed. I know they have a 3 month requirement to have lived in the district of where you file your N400 and we will, but its not so clear if you move out of state.
I've searched online and its still not very clear if you move will you have to start again, or wait until you live in your new location before its processed, or is the requirement satisfied and it doesn't matter, you just have to file a change of address card with USCIS.

I got our MNL # when I called up NVC this past friday afternoon. They asked me for my email but haven't sent anything yet.
I guess I will check out that section of your link to see what the procedure is.

Actually plan B is now in play....lola and friend will take Zach from Cebu to Manila for St Lukes in March....so we will fly directly into Cebu in April, then fly up to Manila for interview only as physical would have already been accomplished.

Does it make a difference if he is not a K2? He is a immigrant visa. Not sure if that changes what you said.

Hey everyone, finally have our visa interview date with my stepson, April 24th.
Well we have been looking at flight, hotels, apts, etc, etc. Zach, my son, lives in Cebu with his lola and family.
We were planning on us flying into Manila around the previous Sat, (19 April), checking into hotel. Having Zach, lola and one of his tita's fly up from Cebu either that Sat or sunday morning.
Go to St Lukes and have his physical done on Monday morning. (will that be sufficient time as the visa interview is that thur).
Then all of us fly back to Cebu that thur afternoon or after interview.
Trying to find places to stay that will fit all of us, 4 adults and 2 children, (Zach and our baby who will be about 1 when we fly)....we also thought about simply 2 hotel rooms. .....we were also wondering about areas to stay, ie: how far out should we consider.
Suggestions?

If you don't live with him its hard to know what someone does behind your back...its his loss....throw him aside like yesterdays garbage and learn and grow from this experience.

Most people i came across had their interview rescheduled on an earlier date so im curious why wait for April or May when your case is being expedited? Will that not be an issue during the interview? My sons case is being expedited so when we got the notice its ready for interview, I booked him Feb 12.
Good question.....Well we were not sure how long the 'normal' processing time was, if it were going to take until lord who knows.....summertime, whatever, so we did the expedite. We are flying with our infant daughter who is 9 months old, so we are trying to get her a month or two older before we fly back to Philippines. I mean we can do april...but its going to be a tough flight. Not to mention 2 dogs we need to find a dog sitter.

Ahhhh you are one of the "chosen people" very cool!! Yup you get to schedule and do things very different, an IR/CR-1 is just finishing up that got to go that route as well
hahah, yea I suppose but it doesn't help if we can't schedule an appt...jeez. I will keep checking daily and also call them on Monday.

Hey Capt'n Ron! Just curious but doesn't NVC do the scheduling? You are doing the I-130 for your step-son right? I know with the IR/CR-1 (I-130) NVC does the scheduling for them.
If you are not wanting a February date then be patient and wait for April and May to show up on the calendar for openings
Hey Hank...well as it was an expedite we do the scheduling.....if it were a regular one then NVC would yes.
