  1. Hello all-

As a new comer, I just thought I'd share what we have found out on the process for the east coast. (not too familiar with the terms here yet..)

My fiancé has called and found out the east coast office is processing the march applications currently.

Good luck with you all and hope our party days are quick to come!! :)

    Hello!

They say March but there are a lot of people who filed in May, June and July and are already getting approved =)

    Good luck in your journey!

  2. NEVER

Sometimes it can slow the process tremendously but I doubt it for a city police officer. If you had some sort of TS classification or were in sensitive information employment, military intelligence for example, it could greatly increase the amount of time needed, not for YOU, but for your fiancee right up front.

The regular background check takes less than 30 seconds, it is only if you "fail" or your name generates "hits" that a manual check is used. How much faster do you want?

There is a misconception that there is a huge amount of time spent on petitions. Typically it is 20 minutes or less start to finish, open to close, if all is complete and the background check passes (most do) The rest of the time your file sits in a box waiting its turn. The "updates" or "touches" are usually when the box gets moved around and scanned, it does not mean anyone actually touched your file.

hahaha OMG I had NO IDEA of how it works... all I hear is "background checks take a long time"

    well, now I know

    thanks a lot

Jay, after this clarification from Gary, I believe that what you need is a friend in the Vermont center.... heheheh

Just seat and relax and let the process flow. You will get there.

    yeah, I get it ;)

I know we'll get there. It was just a question.

  3. UMMMM....I really don't know much but your case is just the as everyone when it comes to background check criteria; Unless that the policde officer in questions has a friend in the FBI that

can perform those background checks quicker when your file is sent there :P

 nope, no friends in the FBI

    oh well, worth the shot

    thanks!

  4. Canada, UK and 15 other countries do not need tourist visas at all. Just a passport.

We live at the Canadian border and we and the Canadians travel freely back and forth whenever we want, even just to go out for dinner. At any time about a 1/3 of the lisence plates at the local mall are from Quebec.

If a person has a legal way to enter the USA during the process, they may. Subject to all the normal precautions. Holding a tourist visa has no affect on the length of time a K-1 taes to process.

Would petitioner's employement facilitate criminal background check and speed the process? For example... NYPD police officer...?

Sorry if this is off topic... I didnt see the point on making a new thread for that question.

    Thank you!

  5. Just because there are no papers signed does not make the person not married. In the eyes of the church, the priest, his fiancee and the attendees, they would be married.

I believe that PI is one of the hard countries where lots of questions are asked and AP is fairly common. If the CO calls and asks her parents if they are married what would they say. They would tell the CO that they saw their daughter get married in a beautiful ceremony in a church. It is a very bad thing to ask people to LIE to the CO for any reason.

That would make the K-1 Visa application invalid because they are married. This would also cost them time (they would have to re-apply for CR-1) and in trying to legalize their first ceremony in the PI because they didn't sign the paperwork. It would cost them money to re-apply.

An engagement ceremony could appease the fiancee, her family and community and still keep everything on the up and up for the interview.

I understand what you're saying... I agree and lying is really unacceptable and will cause problems.

What I posted is MY OPINION and from the beginning I said "I THINK"....

Maybe some kind of pre-wedding celebration would be a good option... the engagement has to happen before k1 is filed, right?

  6. Does anyone know what would happen if one were to get married before their fiancee visa was approved? My exact situation is that I have received my first NOA for a fiancee visa (k1), but my fiancee in the Philippines has expressed her desire for us to get married in the Philippines. Will we have to wait until she is issued her visa to come to America and then marry in the Philippines? I feel as though a marriage that occurs before the fiancee visa is issued would be frowned upon by USCIS. Am I correct?

I think you can have the religious ceremony in the Philippines, but legal marriage has to be in the US for k1 visa holders.

  7. Hi all. I recall reading something about the tourist visa in my fiance's passport needing at least one year of eligibility. Does anyone know if there is a rule like in terms of the K-1? I just looked and see that the tourist visa will expire December 2012 and we will not have the K-1 until February or March 2012 probably(leaving only 9 months or so on the tourist visa).

I don't think it makes sense for him to try to get a new tourist visa for 2013 since by then, we should be married and working on AOS.

Thanks to anyone who can help clear this up!

He doesn't need a tourist visa. His passport must me valid for at least 8 months when he's interviewed in Rio.

  8. The waiting game is not easy on either of us (I'm the petitioner), but it seems my fiancee is having a harder time with the wait. That's understandable, because her life is going to be altered greatly, more than mine, but it seems it is really weighing on her heavily the last couple of months.

How can I help her? I'm sure others of you have been in this boat. What should I or can I be doing to help her as we wait? She is a Filipina, and I'm sure there are specific cultural pressures and issues I don't understand.

    Thanks in advance.

I am a benificiary and yeah, not easy to wait to leave everything familiar behind... it's like we are ready to leave, but have to wait and deal with everyday pressure and routine. The day after day is hard, bc you can't make many plans... you live to leave. It's weird, so I'd say... be very nice to her and romantic (lol I know haha) but yeah, that makes a big difference. My fiancé sends me flowers, we skype each other, gchat all the time... and I try to keep myself busy.

idk.. hope you get your visa soon =)
