Ok so we are goin to file an expedite for humanitarian reasons on our I-130, its currently 46days into the process, no NOA2 yet, and i have had to have major emergency surgery, while looking after 2small kids myself, so we are goin to see if we can get it expedited on my hardship due to health an hardship with the surgery an dealing with 2 kids alone an my husband missing out on the crucial formative development of our 1year old an the vital bonding that should be taking place, its worth a shot we do have valid reasons im a mom on her own with 2 small kids just had major surgery and i need my husband to help me an be with his kids, but my question, how do i file? do i just send a letter to California where its being processed with doctors letters an proof?

  2. how is it fair that people can file priority dates on there I-130 an some dont have reason to, for those who are in hardship, ill or extreme circumstances this does not apply to you, me an my husband have 2 small kids 1 he missed the birth of because of this visa proces an we filed may 24th, we be lucky if he makes christmas or even easter, we couldnt get a priority date for ours, i think the system needs looked at, those with children should get it done lil faster its not right to make moms deal with kids by themselves for nearly a year an to split familys apart like this, sorry for the rant, miss my hubby so much an i no the boys need him :( hopes fading pretty fast

    Please ignore my prior post, I got it plain wrong.

    As the petitioner, you must file an I-864 on behalf of your husband. You will count yourself, your two dependent children, and the intending immigrant (your husband) for a household size of four.

    Here are your options for a joint sponsor;

    1. Your mom could file a second I-864 as a joint sponsor. She will count herself and the intending immigrant for a household size of two. However, when the joint sponsor lives with the petitioner and is related, some embassies have required the joint sponsor file the I-864a as a household member. As a household member, your mother's income would be combined with your and together you would have to count you, your mother, your two dependent children, and the intending immigrant for a household size of five. If you move out, your mother would be fine as a joint sponsor with a household size of two.

    2. Your dad could file a second I-864 as a joint sponsor. He will count himself and the intending immigrant for a household size of two. You do not need to move out of your mother's house to have your dad be the joint sponsor.

    In addition, anyone submitting an I-864 or I864a for your husbnad must count their dependents and legal permanent residents they petitioned for where an Affidavit of Support obligation is still enforceable.

    yes i think we are going with me moving out, and my dad as a co as i wouldnt make enough to support 4, and thank you for your help its greatly appreciated, now back to the long waiting game i gues

  4. ok so say i moved out, an i dont make enough for the 4 of us, effectively id need a co sponsor, now my dad has said he will sponsor my husband, he is single man living alone so he would only need which he does make enough to support him an my husband as i cant so therefore i need a co, have i got it right? its rather confusing, so basically i cant support hubby on my own when im in my own place, so my co sponsor, now dad, will do it, he is single man on his own an makes enough to cover 2 people past poverty line, so there should be no problems? so confused

Ok we are currently awaiting for our NOA2, i live with my mom who has the house, me an my 2 sons, then hopefully soon my husband, my mom will be the co sponsor, so how does that work does she have to make over the poverty line for what 4 people? so itd be both mine an my moms income combined plus assets, what would that include? house, bank? the house is being paid up eg mortgage confused as to how this works with the co sponser, and if i where to move out would or could my mom still act as my co sponsor

  6. so our estimate for our NOA2 for CR-1 is beginning of September,lets just say it all goes smoothly and we get it say, around 2nd week in September, can we say or get our hopes up to be home in time for Christmas? we have 2 small kids any my hubby has missed so much, any hope is worth clinging to at this point, we are filing through cali an it will go to London Uk after NVC

Its been a month since we recieved NOA1, a long way to go, or maybe not, hopefully, can we call uscis an ask for a detailed update on our case we tried the number on there website was all automated tried emailng just got back rubbish is there a number to call a real live person who will say this is whats going on kinda thing? we are using calis office also thanks guys!

    p.s what is goin on in cali, the approvals seem to be flying outta there thick an fast an alot before the 'due date' keep wishing ours will be one of them too :)

Ok so we filed an recived the I-130 on the 24th of may, been 16days so far, my hubbys british im born an raised US citizen as is our 1year old baby, the wait is HORRIBLE, we wanted to no after reading alot of things if hiring an attorney or more likley gettn help from congress would speed things up, the goal is to get my husband home before christmas he has already missed our sons birth an first birthday, the time line here says between 14 september an 29th, i pray we get it before then but thats out of our hands, also whats the current times from when nvc recieve package to final interview in london, so many questions, so much time, this is a cruel way for a family to be living

Ok so again we have filed, noa1 13days ago, horrible waiting, we filed the CR1 under us citizen applying for spouse, relative or child under 21, now we are legally married in usa, an our son is born us citizen, when we filed was for me(american born an based wife) for him, spouse(uk born an based husband) but will the fact our son is a us citizen change anything or in a way ''speed'' things up, also how can u tell what priority u are expample F1, F2 etc, ive read havin a kid an legally married makes u F1 which is on the most processed faster but how an where can we find out what we are, and does our son help us as far as getting things done smoother if not quicker thanks :)

Hey all, whats the current estimate once we recive our noa2 in cali, from the NVC till they day my hubby gets his interview ive found so much about noa2 times etc but nothing on the time frame of when NVC recieve it till the day of interview, just a rough guess or timeline thanks folks :) the consulate will be london if that helps

  11. I would seek legal advice if I were you...Overstays under normal circumstances start an immeadiate ban...accruing a ban but from what point I am unsure, but mau not tell him unless he tries to enter again

    i spoke to an attorny he said if it was over 180days to a year, its 3year ban, anything over a year is a 10year ban, so we are in the clear with that but they will grill him an it may delay petition but it wont affect us or decline visa on that reason

We have filed and are now playing the long cruel waiting game for our noa2, my husband came back over in august on the VWP, he overstayed by 140odd days, he was never asked to leave, never had warrant etc etc, he left on his own accord so we could do this hassle free, but when he left they took his passport were gone around 30mins an then returned saying dont return with out a visa, which hopefully we shall have, will this cause a problem for us, he was never given a ban nor did he get in anyway letters or warnings etc just told to get a proper visa next time, i hope this doesnt affect us or cause a delay????

  13. My husband is in the UK too. We filed in February and have just received our NOA2. Its been 110 days or so thus far. I'm expecting it to be another 4-5 months before he is here though. We can always hope!

    well i hope for u its sooner from what i read from nvc to interview shounldnt be more than 2months, its alot quicker than NOA2 for sure, i wish u all the best an hope he returns soon to u, trust me i no the hurt it brings daily

Ok so we filed an recieved our NOA1 for alien relative(spouse) us citizen I-130, now comes the hard waiting games, we do have a us born son etc we have been trawling like most do at the timelines, i see alot of confidence coming from the fact that almost 95% of the cases from cali dealing with uk citizens are from date of file to visa in hand averaging 150 days, i really hope this is the case for us he missed our son been born, an his first birthday, lets pray he is home for christmas, it did fill me with hope when i seen so many done withing 5-7months from start to finsih, some even done within 4, every case is different sure but when all u have is hope then all u do is pray the time away, anyone got any stories or shed some more light on what ive just said?

  15. Sorry to say but when your in an immigration process, your relationship is THEIR busniess. All i know is my husband would be mad if i didnt list our relationship status as married or whatever. I dont get why you dont want people to know your engaged. If i was an immigration officer i myself would find it a bit odd that a social network you use to communicate daily with your "fiance" you refuse to list your actual relationship status. You have to consider these things and how it looks to others. I dont think its right that they would go as far as to look at peoples social networks, but it todays world its a big deal and used daily by tons of people. As i said you basically have no privacy when your going through this type of process. So you should expect them to dig in any aspect of your life.

Man i am sorry i have straight talk and had the same issue as you i mean what a pain to get your own call history. i just sent other #######, chat convos, fb text messages, old emails, pictures, his passport stamps affidavits from thrid parties, and a letter explainin why as of the time being his name aint on our sons birth certficate along with a notarized copy of aknowlegement of paternity think that all i wasnt wating to sent my packet for stupid records. sent all u can if u dont wanna wait
