I am always afraid to give wrong advice so others may want to comment on this but maybe wait until you have a case# then send in a new page of the 129F with the correct info to attach to your already sent app....since u already know that it is missing take action so you don't have to wait for RFE which will only delay approval of your application.

    Okay so I am also new at this and my application is also being processed. But, what I do know is that every Consulate is not the same. I know for a fact, and you can check with my earlier posting, is that I have already confirmed that the Consulate in Laos will not accept co-sponsors for K1 visa applications. Now, if you were to be married and were applying for a spousal petition then the Consulate does allow a co-sponsor. I've beaten myself countless times trying to understand?? Having said that, you make more then the required minimum for sponsoring your fiance. I understand that being self employed you will be required to send your tax transcripts for the last 3 years, and your bank statements showing your yearly deposits into your accounts. What's most important is that the CO interviewing your fiance believes that you can take care of your fiance and that he will not be a public liability. Thus, knowing that you will really only have 1 1/2 year of tax transcripts for your business, make sure that you write a letter explaining your situation so the CO understands your situation. About your question of life insurance cash surrender value, you can find that out by calling your life insurance agent or company. If you have a term policy only you will not have cash surrender value. Generally you have cash surrender if you have a whole life or Universal life or VUL but check with your agent. Your car doesn't really count as asset. Questions of assets are generally important when you do not show enough income to qualify for sponsorship but I think that even though you haven't been in business for 3 years you will be okay and may not need assets to qualify. After all it's the income you are making today that is important not what you made yesterday. For example, you may have been making $100K last year at the old job but if you have a new job and are making $17K this year you will not qualify. If you are unsure....find employment. Anyhow, I think you should be fine and it's really up to the CO. Hope this helps a little.....also I don't think that having benefits is a requirement though I am not sure. But I am certain it's really income that's important.

    Thank you for your email. The US embassy in Laos is not required to accept affidavit of supports for the K-1 visa petition. The petitioner must show that he/she meet the 2011 Federal Income Guidelines for a household of his/her size.

  4. I don't know about the RFE but I am positive that my background check would be okay; I am sure that if I had criminal record I would know about it. It does concern me a lot because no one at NVC or at USCIS will tell me anything. The NVC rep did say that NVC does not adjudicate and my file was never sent to the consulate so no CO has seen the file to make a decision. However I recently did find out that Social Security had my birthdate transposed. I just went to Social security yesterday and fixed it.

  5. My I-129f application was approved and I received my NOA2 on 7/11/11. On 8/3/11 I called NVC and got my case#. On 8/8/11 I call NVC and was informed my application was returned to USCIS with no explanation as to why? I checked my receipt # with USCIS and this is what shows today:

    On August 18, 2011, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    Can anyone tell me what this means?

  6. So, if I put my 2 girls, whom I cannot claim as dependents on my taxes, as dependents on my I-134; I will not meet the 125% of poverty level based on my 2009 and 2010 taxes. For 4 people the 125% federal poverty chart says $$27,938. In 2009 My gross income was $26,390. In 2010 it was $26,963. This is because I was on unemployment in 2009 and did not start to work full time until 06/05/2010. I am tracking to be at $40K++ for 2011 and my current income is well above the poverty guideline for 4. Will I be okay without a sponsor or do I need to get one? Will they consider current income or will past 2 years tax return hurt me? There is not much by way of savings or assets.

  7. I am filling out form I-134 and it's asking me about my dependents. I have 2 kids with an ex-girlfriend. The kids live with their mom and I see them 2 weekends a month. I claimed one child on my 2008 tax return (the year their mom and I split up) but have not claimed any of them as dependents on my 2009 and 2010 income taxes (their mom claims them). I also do not pay child support, but I do provide for them by giving them cash for school supplies, clothes, spending money etc...when they visit me. should I list them on the I-134 as partial dependents or not? thanks for your help
