  1. :ot2: here's a link to the memo http://www.ice.gov/doclib/secure-communities/pdf/prosecutorial-discretion-memo.pdf

as you can see the date is from June 17. So the only "new" thing is that this discretionary review will be applied to deportation cases already in process. And remember any immigrant (even in exeptional cases naturalized citizens) can be put under deportation proceedings. So there's every sort of case including long time permanent residents, asylum seekers, overstayed visas, people rejected for adjustment of status that as we know leads to being put in deportation proceedings.

Anyway without getting political, the policy is about reviewing cases as gray rather than black and white. so instead of a huge backlog of 300 thousand cases that go on for years, rather saying these are the worst (criminals, repeat overstayers or border crossers, possible terrorists) let's process their cases first and setting aside those that except for being undocumented are not a threat. Very important - those cases set aside DO NOT end, they are closed FOR NOW and can be reopened at any time. The person's immigration status does not change - some may be eligible to APPLY for a work permit but that's not guaranteed. So they won't be getting green cards or be able to apply for citizenship, etc.

Of course there's the whole political side of it, why is it being done now (cuz of elections) who is it meant to appease (immigration reform activists) etc... but that's a whole other thread that sadly still can't seem to happen in a civilized way

  2. You can start trying to get the EAD expedited right now. Your best bet is probably to contact your senate / congress representative, and try to get them to contact USCIS for you. You should try to obtain a letter from the company that offered you the internship, stating that they want to hire you as a paid intern - that will help the process a lot. You can also try to do this yourself through an infopass appointment, but again, they will want to see proof of a job offer.

Thanks for your info! They're willing to write a letter for me. Downloaded the privacy form from congressman. Tonight will sit down with hubbie and decide a action plan.

I don't think there's any negative affects for asking expediting. If they say no then I just wait :)

  3. I was selected for a paid internship but can't start until I have EAD. They've given me a firm deadline of Nov. 1st.

I just got my biometrics Friday August 19. Should I try to get EAD expedited now? Or wait a couple of weeks and if I hear no updates from USCIS then try expediting?

If I get EAD within 90 days then I should be right on time for the internship but if there's a little delay I might not have it in time.

How should I do expediting? Through USCIS? I might be able to get letter with info on internship and the deadline. Or try through senator's office? Or try both at same time and see what works?

I just don't want to be too pushy and just make people annoyed but this is really important to me and only 2 people are selected a year for this opportunity so it's a big deal. And to mention the money would help us a lot :)

    Thanks for your suggestions!

ps: My AOS package was received July 18 - I'm adjusting from tourist visa based on marriage to US citizen.

  4. Biometrics appointment today. Very fast, simple, employees all nice. Hoping I get EAD soon. I was selected for a paid internship but can't start until I have EAD. Deadline is Nov. 1st. Should I try NOW to expedite - anyone know how? Calling congressmen or senators office? Or wait for a few weeks to try those, if I haven't received any updates from USCIS?

It seems like I have a lot of time but some people have not gotten EAD until almost as same time as interview :o Plus I can't apply for social until after get EAD....

Thanks for your suggestions and hoping everyone waiting for bio letter gets it today, so you can have a relaxed weekend!!!

  5. I received a whilw ago my appointement for my green card biometric which is the 22nd of august...and today I received an other appointement, for my work permit biomeric on the 6th of september.

We are at 2hours from detroit, can't we do both at the same time??

I seen on here people with same situation. Take both letters with you to the first appointment and explain the situation. No one here, that I seen, was made to go twice. Good luck!

  6. Hard copy NOA never arrived at our apartment (we've had problems with mail since we moved there :  ). Called the organization that's helping with our case and they received copy of NOA 7/26 but no biometrics appointment letter.

Getting kinda worried and DO NOT want to miss my appointment (I was actually planning on a walk-in attempt). Online status says everything was received 7/18 and under initial review - would the biometrics appointment be updated on-line?

I've gone through July filers and bio appointments seem to be taking awhile but still...and I haven't received RFE *knocks on wood*

Muh and me: 7/21 filed 7/30 NOA & bio appointment received August bio appointment

    EmmillJ: 7/18 filed, 7/30 letters, 8/11 appointment

whyrenee: 7/29 filed, 8/12 bio letter received, 9/1 appointment

dragowill: 7/1 filed, 7/11 NOA, 7/31ish Bio letter, 8/24 bio appointment

    tom.in.chi: 7/20 filed 7/27 NOA 7/29 bio letter 8/16 bio appointment

tlike la2011 i say: Dear USCIS, where in the world is my bioimetrics letter!!? :(

   guess what was waiting in the mailbox for me??!! biometrics appointment for next Friday August 19th. Should I push my luck and try for early walk in on Monday? It's only 4 days difference but there's a paid internship that will only wait until Nov. 1st for me to have my EAD.... time for decisions. Hubby still at work but just had to text him the good news, specially since I was freaking out a little last night :innocent:

  8. Just got the dreaded RFE text message.... Not sure what they are missing, I guess I will find out when I get the letter in the mail.

God, this process is SO STRESSFUL!!:bonk: :bonk: :bonk:

 sorry to hear that la2011. Hope it's something small and stupid that you can fix soon so you are back on track.

I'm still waiting for NOA1 and biometrics appointment letter. I received text notification July 20 and nothing yet :(

  9. thank you so much guys! i really do appreciate it! yeah! coz i was really worried why my case is not showing up on the site. but now i'm fine coz i just found out with you guys that i'm not the only one experiencing this. lol..another one, how do you sign in so that the uscis can text you regarding updates on your case? is there any fee or something? will it delay the process?

No cost, I just filled out the G-1145 form and sent it with my package, but I've read elsewhere on visajourney that you can send it in now, probably with a copy of your NOA1 and case number.... Hope someone else can give you more exact details than me :)

  10. So it sounds like the best situation is to leave before she accumulates the 365 days of overstay and then just accept the 3 year ban - which is not that long a time specially since she doesn't have family in the US. With a chance of a waiver if she reapplyies through marriage with US citizen.

But before she leaves or before the interview whichever is first, send a letter requesting a withdrawl of the petition & AOS. Make sure she keeps evidence of when she does leave as evidence for the ban.

  11. Hi I'm in Chicago trying to get my adjustment of status sent in early June. Anybody from Chicago or the surrounding area that can recommend a clinic or doctor for my medical exam? I've searched the USCIS locator but it's only a long list of approved doctors but wondering if anyone had recommendations.

I'm looking for someplace that's close to public transportation (no driver's license) and since I'm thinking I might need to get some duplicate vaccines since I don't have a record here of the ones I had in the past someplace that is more economical.

    Thanks!
