  1. I would talk to a tax professional (not HR Block). Usually married filing separate is worse than single. I would say married filin jointly is better..

    Okay I will make sure that I talk to a professional... In this journey I have learned that doing your research first and then going to a professional is much better. Professionals just tell you just about anything these days.

    False. Why would it be worse when you file married but separate? That makes no sense .... They are just telling the truth. If there's no reason to file jointly then song do it .... But filing as single is a BIG FAT LIE when you're married. And he can get a penalty for that.

    So then should I attempt to get a tax ID? Will I be able to get one since I have been here this long? I have not worked at all since I have been here, so filing separately would that raise a red flag because he has been supporting me all these years.

    IRS. H filed incorrectly and probably underplayed his taxes. He needs to amend his tax returns for all the years he was married and pay any back taxes and penalties.

    USCIS. On hi tax returns, he claimed with the US government that he was single. Hard to prove that you have a real marriage when he has separate tax return for all those years he claime he was single on official documents.

    Okay....I understand you can only amend 3 years worth of taxes though...

    Do I need to consult a tax attorney???

  3. My husband has been filing taxes as single (was advised by H&R Block rep to do so), and has been doing so for 10 years as I don't have a ss#.

    My question is should I have him change his W-4 from single to married even though the taxes and W-2 are going to show single?

    Will this tax thing affect the AOS decision?

    Anyone with similar experience?

  4. My questions are:

    1. Should they file for the I-102 (Application for Replacement/Initial Nonimmigrant Arrival-Departure Document) so that she can get at least a copy of her I-94, or should they just submit the I-130, I-485, I-765, and the supporting docs, even if she isn't even sure of her visa class and she has no I-94 or passport stamps? Personally, I think they should file for the I-102 at least.

    As for the I-102 I have heard that if you do not have proof of entry, USCIS does not give you a copy of your I-94. I was in the same situation so instead I FOIA'd my records with the state and they give you your I-94#, arrival date, POE etc...basically the info on your I-94 in exception of expiry date, then you can file for replacement that way and submit FOIA records as proof of entry. (It takes 3- 6 months though to receive it as it is free).

    If someone has filed for I-102 with no evidence of entry and received a copy they can chime in, but I haven't heard of it...I actually read a post from the USCIS about the process of approving the I-102 application (I will have to find the link).

  5. Not yet I called today and said its GC hasn't been order yet and said too early to worry advised to call them back after a month ..so I guess it have something to do with my lost i-94 i think....

    so i guess I have to call them back on Oct 10...

    your passport stamp should have been sufficient enough....

    If they try to say they need your I_94 (in which they shouldn't), you can FOIA your records

    and those records show what day you came in / POE / I-94 # etc... The only thing is it takes

    about 3-6 months to get it.

    Let me know how it goes, as I am preparing my packet. I just hope that they accept my FOIA records

    as proof of entry and am going to try and apply for a replacement using the FOIA info too.

  6. :help: I need help completing I-485.

    Quick summary of my story;

    I entered in 1997, passport got lost along with I-94.

    I FOIA'd my records, received them but they only state my arrival date and Admission # and NO VISA #

    Really appreciate your help!

    QUESTION;

    Part 1 (information about you)

    A) I-94 #;

    Is that the same as Admission #? It is a 11 digit number

    Part 2 (application type)

    a) I am applying for adjustment to permanent residence because;

    ???? (I don't know which one to choose)

    Part 3 (processing info)

    a) Non immigrant visa #;

    Passport stolen, have no copy of passport and FOIA doesn't state my visa #

    I FOIA'd my records with the state too and have not received them yet

    b) Date Visa Issued;

    I do not have that info as my passport was stolen what should I put there?

    If I don't have this information will my application be kicked back??

    I intend on sending a copy of my FOIA'd records from the State along with my package.

  7. I paid $150 for mine plus $100 since they had to do a title for the vaccines I didn't had the record. Ended up needing MMR and Tdap, went to walgreens and my insurance covered it

    Thank you everyone!!! The Physicians office said I can go anywhere and bring proof, so I just need to re-verify with the Physician about that Hep A & B ('cause I don't know if I can do 4 shots in one day...I hate needles! lol)

  8. You need the Hep A+B shots for real (at least it depends on when last you had them done) cause i think you have to redo every 7-10yrs. I had those two, MMR, Tetanus. The only shot that was administered was the TB then he took blood work cause they have to test for Syphillis and HIV. What state are you in if you don't mind me asking?

    If you read further along it says that Hep A & B can be administered in cases the Dr thinks that you are at risk (something like that) otherwise Hep A for 12 months and Hep B 11-17 years.

    Let me know if you were able to pull it up. If I find a free clinic I will take the shot just to be safe but the powerpoint is directly from USCIS.

    I think I will find a free clinic.

    I just saw a released power point from USCIS for Vaccinations Seminar for Medical Exam and these people want to give me shots that are not required just because they want me to pay.

    To make things worse they told me that I needed a shot for Hepatitis A and B, I am not 12 months old nor am I 18 years old! They just totally want to rip me off. Will politely call and ask if they would accept the proof if I took the shots elsewhere and bring proof back.

    I paid the $225 already, I don't even know if I should trust this doctor with my paper work.... :blush: I mean he literally

    told me that I needed Hep A & B shots and some nurse told me the same thing before the doctor walked in.

    Thanks for chiming in 'cause I was about to go back on Mon and pay for those shots.

  10. I had a medical appt y'day (adjusting from B2), and was told that it costs $225.00

    After I paid the initial amount I was told that if I needed

    more shots then I have to pay more for shots (never told me that

    and I called several times). After meeting with the doctor I was told that

    I need 4 more shots and 3 of them cost $95 each and the other one $150.

    Should I proceed with this or are they ripping me off? I already paid $225.00

    for TB test and blood work, and when I go back I have to pay $435 extra :(

    How much did you guys pay for your medical?

    If I sent the application with no supporting evidence of legal entry they will not give me a copy of my I-94.

    I was asking if FOIA records as proof of entry was strong enough for them to issue me a copy of my I-94.

  12. USCIS issues you the A number after they create a file for you i.e. after they receive your application(s).

    If you have not filed anything yet or haven't gotten in trouble with the law then you don't have one yet, but

    you should use the number on your I-94 which is 11 numbers (it's 9 digits plus 2 extra numbers), use all the numbers.

    Otherwise if you have already filed and received a NOA then you should check that for your I-94.

    If you still have doubts Google 'difference between immigration A number and I-94' so you can get clarity.

  13. Congratulation!. What was your process for the FOIA?

    I'm in the same boat, my passport and my docs were stolen in a bag. I filed a police report and last time I got into the country was 1994. I just filed a I-102 and got an RFE because they said they could not find me. I'm trying to AOS from F1. I don't know if they would use my driver-license information to complete the search.

    I filed with CBP. It took me 6 months to get it. I just gave them my name, birth date, date range when I entered the US, Port of Entry, Country of Citizenship. They are really backlogged and I figured it was worth the wait. I had to call every month so I can track what months they were working on and if they had received my request. When you mail it please use certified mail with a return receipt, 'cause after my month was processed they told me that they didn't receive my mail and was not on the system. Fortunately I had the return receipt and had to fax that info for them to see the proof and was entered in the system that same day and received my FOIA two weeks after.

    Will PM you the letter I used if you want and here is the address I sent the FOIA to below; (it came back with my date of entry, admission number, port of entry, time of arrival, and POE)
