  1. On your FOIA records, do you have anything that says Admission Number?

    That would be the part where your name, DOB, Admission Class, Country of Citizenship is listed.

    What is your story? You lost your passport or you were never given the number. If you can answer the following questions I think you can be helped, or stirred the right way.

    1) What is your entry date (year)?

    2) Do you have a COPY of your lost passport or anything related to your passport?

    3) Do you have any tags from your luggage that shows your date of entry?

  2. I got your message Cynthis24porras. Does the FOIA record show the I-94 #? Because that is how USCIS will pull up your entry records. What is your entry date/year?

    This is how I did it. When I received the RFE from the I-485, I appied for a replacement of I-94 and paid the $320. All I had as proof of entry was the FOIA records, and nothing else. I included a copy of my passport (biography page) and country ID to prove who I was, a sworn affidavit, and a copy of NOA to show that I had a case pending. I also requested for the paperwork to be experdited.

    That motion was denied. Two weeks later I received a RFE for 102. They stated that they needed more info as they could not find my entry records. Although, I was highly disappointed and thought it was over for me, the next day I must have read the RFE five or six times and found that they had the wrong entry date! I then responded with the same info as before and on my cover later I noted that they had the wrong date. I also wrote that FOIA was the only US entry proof I had.

    A few weeks later I received an approval text and got a copy of my 16yr I-94. So I would advice you to file for replacement, at least show that you attempeted to get one. Please include anything - copy of ticket, tags from the luggage, anything relevant to your flight to show that you entered legally (that would help a lot). In my case I had none, and I totally relied on that FOIA.

  3. My husband had files his taxes as single also. He could not claim me because of lack of SSN and could not get an ITIN either becuase my native id and passport had expired. I submitted the taxes filed as single and then when I got my social security we filed our 2013 taxes as married before the interview date. I wasn't questioned about it. I agree it might not be a USCIS issue but will later be an IRS issue. So you might want to amend them.

    My AOS got approved today. This has been a loooooooonnnnnng road but I made it.

    Thank you for your support, encouraging words and truth. Special thanks to Harpa Timsah, you know your stuff (lol).

    My interview was about 10 - 15 mins. We were interviewed by a trainee and the supervisor was just watching and listening (with a mean serious face).

    It also seemed like it might have had been the IO's first or second day. We were sworn in, verified my parents names, address, kids names and asked to

    see their bith certificates. He then asked the yes/no questions and if we had more evidence. I handed over the info including our 2013 taxes. He then looked over to his supervisor and said 'That's it'. The supervisor then asked him how he felt, and he said I feel it's legit. The IO left to make copies of the new evidence and when he came back he asked why did I wait such a long time to adjust. I explained that my passport was stolen along with I-94 (he said , "yeah I saw the police report") and had no way of proving legal entry. Attorneys had told me the same thing until I found out about FOIA in 2011. The only thing I had to do was take my I-693 back to the doctor becuase he didn't complete the last part on the form and I returned it the next day.

    Thank you again! Best wishes to all that are adjusting. I had to stay positive all the way (some days were hard, esp recieving the RFE's) but I responded back and followed advice from here.

  5. I submitted my application for AOS and received a REF for I-864 and I-94.

    I submitted I-102 for a duplicate of I-94. My entry records are very old...late 90's.

    My passport and I-94 were stolen in '98. So I have no copies of nothing....

    The ONLY thing I have is my FOIA records which shows my I-94#, when I entered, flight info, who inspected me etc.....

    It also shows that I never left. I had requested for an expedite for I-102, and received a letter y'day that it was denied. So I have to wait 2.5 months for it.

    So, should I go ahead and submit the evidence needed for I-864 and my FOIA records in lieu of I-94 and see if they would accept is

    as an alternative proper evidence of arrival? I am just concerned that if I wait for the duplicate I-94 it will arrive after my deadline to

    submit the evidence required.

  6. One thing you should never do is lose hope for life while alive! Stay positive even though it seems impossible.

    Does USCIS know your history???? That you were born in Iran and moved to Sweden? Maybe your mom can write an affidavit explaining the reason why

    your birth was never recorded and include her Iranian birth certificate or proof of Iran citizenship before migrating to Sweden.

    Just a thought and my 2c.

Ive been assembling my package for quite some time now and Im finally DONE!!!!! before I ran to the post office I went on uscis.gov to double check all the forms and fees,and thank GOD I did!!! there are new I485 and I765 forms.I wasnt sure if the older editions will be accepted and I re-filled out the new ones and replaced them in my package.

    So just a friendly reminder to all of you preparing your AOS package- always go back and double check fees and forms ect..

    same experience here.... it wasn't the forms for me. It was some of the supporting docs that I thought I had included on I-130 and I-485.

    I wasn't going to triple check, as I had double checked already after I had made copies of everything. I was really surprised.

    And I personally think that if each applicant did that, it would avoid REFs unless a document was purposely left out.

  8. Ok, I know that a walkin doesn't speed up the green card process but can it speed up the EAD and/or AP?

    We are doing our fingerprints in Fargo, we have to go there on Tuesday anyways(and it's a 3 hour drive) so hopefully they will let us do the walk-in. Either way I will report back. My wife wants here EAD asap because there is a teaching job available for her.

    Yes you can get your EAD expedited.

    I believe you have to do an infopass and bring your proof.

    Someone else can chime in about that.

  9. Usually they advise you to wait for that long because if you come in on Visitor Visa, and get married right away or adjust right away then

    it might cause a red flag, and that would also mean that you came in the US with an intent to marry and not visit.

    Others have adjusted successfully adjusting their status right away or within the 30-60 day rule.

    So, it's up to you if you want to wait or adjust right away.
