  1. Hello everyone,

    We applied for AOS/EAD/AP in November. We received the combo EAD/AP, but the AOS got transferred to California and we're still waiting.

    Next week I will visit my parents and I'll use my AP card, so I just wanted to know how it works and if I have to do anything particular before departure? My trip will be a short one, 12 days.

    Will I have to give the I-94 at the airport when I leave or I have to keep it?

  2. Hi everybody!

    My wife and I are filling the documents for AOS but we have a doubt regarding the affidavit. My wife doesn't actually meet the sufficient income so my mother-in-law is going to be my sponsor. We didn't fully understand if we just need an I-864 for my MIL, if we need one for her and one for my wife or if we need another form (I864A?). My wife is not part of my MIL household because we moved out.

    Any help would be greatly appreciated, thank you!

    I have a question before POE :) The day at the interview at the consulate I was given my medical interview results + chest xrays and after of course the usual envelope to give at POE officers.

    Will I be asked for the medical results at POE? I would like to keep a copy of my DS-3025 with vaccines records for AOS. You think I can make a photocopy?

  4. Your mom to sponsor you should make 125% over the poverty guideline for 5 people: herself, you, your husband and your 2 sons. If she doesn't you can use assets to reach that amount, but remember that the value of the assets must be at least six times the difference between the requested amount and your mother's income (if i'm not mistaken, i hope other vj members will confirm this).

    I'm not sure how it would work out if you and your sons moved out now; theorically if you were able to prove that your sons are totally dependent on you and you only, your mother would have to reach the 125% limit for just 2 people: herself and your husband. Again, I hope some other member will help with this :)

  5. Thanks guys! And do you think is ok if we present documents with both their names on? Like bank statements. Her mom just with her salary is above 125% of the poverty limit, but we were thinking about using assets too, just to be sure? Do you think that is a good idea? Because most of their assets, like the house, is on the name of both; having another affidavit by her father wouldn't be a problem!

  6. Hi all, we received Packet 3 two days ago and we're a little puzzled on what to do next.

    In the packet it says to send to the consulate the form DS-230 part 1 and the applicant statement. What we didn't understand is: should I (the applicant) send the DS-230 right away and the statement after i have all the required documents or should i send them both only when we have all the documents ready? My fiancee is still filling the affidavit (will be ready next week) so i was wondering what to do. Should i send DS-230 part 1 tomorrow morning without the statement?

    I have 2 questions about the I-134 form (Affidavit of support):

    My fiancee must use her mom as cosponsor since she just started working. Her mom makes well above 125% of the poverty line. Although, her mom and her dad file taxes jointly. Her dad is retired and doesn't earn above 125% of the poverty line. Should her dad be a cosponsor too or can we just have her mom as a cosponsor? And if we just have her mom, how should she present her taxes return form since she files taxes jointly?

    Also, my fiancee has her last 3 years of tax returns but they all are from small jobs she did during school. Should we present them even if now she has a new job?

  8. Because we had a lawyer representation form within our K1 application. But now the lawyer is not following us at the consular level (cause it would be more money) so we were told to get him out of our case with such a letter. This is not an official form though so we would like some help in case anybody went through this particular thing.

    Oh and to answer your question, no :) not any request from them, everything smooth so far!

    Our K1 petition is right now going to the assigned consulate in Italy; when we called NVC though we were told that if we payed the lawyer just for the USCIS part of the petition (which we did) now we should send NVC a letter with petitioner name and date of birth, beneficiary name and date of birth and lawyer's name to ask him out of our case.

    Is this correct? Is there a precise form to do this or should we just write a normal letter? Does it need to be signed by both?

  10. Hello everyone! We just recently got approved and received our NOA2 in the mail. We used a lawyer for the first step of the process and when we talked about this step to him he wanted more money so we have decided to go ahead and do this part on our own. We are a little nervous about doing this, but feel we will have no problems in the end, we just want to make sure we are doing things the way we are suppose to be and looking for help from fellow VJ'ers! I have used the VJ site and looked up what we are suppose to do next, but we still have some questions. I am starting to gather new evidence to be sent, we have plenty of pictures and a couple emails, a ####### load of messages sent via skype and messenger services, I printed out our facebook history and also have my airline boarding passes from my trip there feb-may. I will write my letter of continuing support of the k1 closer to the date of the interview once we get that. I am in the process of gathering things for the i134 and have come across some questions in regards to that.

    1) I was told that a week after receiving the NOA2 I could call NVC and receive our new case number and check to make sure they received our file and ask if and when it will be sent to the consulate in Naples. When I called they told me that since it had only been a week we are not in the system yet and that USCIS gives them approximately 90 days to get everything so I should try calling back in 2-4 weeks. Is this the same experience others have had? Or is this just a pre-written response to that question so people aren't calling all the time? Should I keep nagging every few days or next week?

    2) We will be using a co-sponsor since I am recently graduated and just got a full time job so I currently do not have the financial means of supporting us both via the national poverty guidelines. We are going to be using my mother who is well above the poverty guidelines. We are a little worried that this could hinder our approval at the interview at the consulate, but we were told many others have done this without problems. When looking on VJ about what goes with the affidavit it says; pay stubs, letter from employer and the i134 form. All of these will be no problem for my mother to get, however we were told that tax returns were also needed and that they had to be tax returns from the last 3 years. Do we need them for the i134? If we do again, it will be no problem for my mom to get hers, however for me it may be more difficult. Assuming we will need 2 i134, one for me and one for my mom the problem comes for the things I need. I just started my job and have not received any pay stubs yet. Also I have had part time jobs in the past and have filed taxes for the last 3 years, but I did not save my old old tax returns. I only have the return from this year. My income doesnt even come close to the poverty guideline, but if I am filing out the i134 I am assuming I still need all the same things my mom has to send? Is there a way for me to contact the IRS and ask for copies of previous tax returns?

    3) Also with tax returns. My parents file their tax returns jointly. We were wondering if my dad would have to fill out an i134 also since he jointly filed taxes with my mom and she will be sending in tax returns for her i134 with his name on them as well?

    4) For additional evidence, should I re-copy my passport since it has a new stamp from my trip to Italy in Feb? Or will the boarding passes be sufficient?

    I am sure we will come across more questions in the future, but we will just start with these and continue gathering everything we need, especially what I need to gather to send to my fiance before his interview.
