ladyg got a reaction from TexasVAWA in VAWA based on emotional, mental, economic abuse
I agree with Mulanjohns I was in the same situation as you and her.The first time I went to see a lawyer she told me that I had a weak case as I didnt have physical abuse and any evidence from the police ,she told me I have all the documents to prove my marriage ,good moral conduct and good faith but weak evidence on abuse.Went back home discouraged but I told myself I am the one that knows what I have gone through.I gather all the required documents and I sat typing my story which took me 5 days as I had a lot to write.Typed a 12 paged testmony ,then had my sister write me a letter to USCIS and my friend here in the USA who witnessed the abuse.I sent that gat approved in 7 months and one more thing had 2 kids I came with and the laywer wanted huge sums of money ,thank God I did it myself ,no police report ,no counsolor report thought I expelained in my letter how I ended up in emergency room due to severe panic attack and had the letter from the hosiptal. So you can do and be your on lawyer gather whatever eveidence and documents you ,write your own testmony like many have said .I wrote how we met and where ,how he came to my country and married me ,when problems starts, how I responded and i was affected and why I think I should be granted legal stay in the USA I mentioned my child as I have a child him ,that I wanted to see him and be part of my daily life.

ladyg got a reaction from user19000 in Starting VAWA process in 2012..help and suggestions!
Sorry for late reply just saw your question today. They asked my witness how they know me and how long they have known me and a little of what they witnessed. My witness told me it was a less than 5 minutes conversation. The witness does not have to ponda so much on good moral character but on what they have witnessed. The police clearance will be your good report.

ladyg got a reaction from user19000 in VAWA CASE
I am sorry to hear about your situation and also the condition of your son.Like CASE2011 has said we all here to help one another with our walk in vawa process. You dont need a lawyer.I filed for vawa myself as a spouse of a USC for me and my 2 children that I came with from my country to come and marry my husband here in the USA.We been married for 5 years and we have a child together ,went through all kind of abuse.Never called the police was scared as I was threatend of being deported because he used that on me even though I came on a k1 visa and married him within 90 days and never filed for AOS.I went to see a lawyer who told me ,I wouldnt be approved because I didnt have police report though he said I have all documents to prove marriage and good moral character.Wend back home disappointed then I told myself i can do it.I typed a 12 paged statement which took me 5 days,my 2 friends who witnessed the abuse wrote me statements .I Started with how I met him,how we fail in love, about the plans we had for the future ,how he came to my country ,how I came to the USA,when problems started and how .I documented every detail and dates ,What he said ,how I responded ,how I was affected as a result of being abused.I ended explaining why I never left the house to seek help at the shelter because he had threatend to use that against me if we went to court for child custody he would accuse me of abandoning my child as he wouldnt allow me to take him to the shelter with me because he has his own house,he had even offered me money to surrender our child to him.I explained that I said 4 yrs because I wanted to see and be with my child thus enduring the abuse.I was approved ,if you have any questions feel free we here to help one another .Vawa forum is a forum that is on my heart becuase I understand what someone could be going through for I know exactly what they are going through becuase I experienced it .

ladyg got a reaction from user19000 in New to VAWA, need help.
First and foremost on what condition are you filing your vawa? You will have to send your vawa i360 to Vermont service center thats the only center that deals with vawa based on marriage. If you are filing based on emotional, mental or physical abuse you need to enclose your proof of that ,you need to enlcose the following too, marriage certificate,if divorced your divorce should be no more that 2 yrs ago, proof of your spouse being US citizen could be copy of there passport, birth certificate or drivers licence, you need proof that you entered marriage in good faith, police clearance that you are a person of good moral conduct, proof of address where you live.Copies of joint account and thing that has both your names. You also need to write a letter explaining how you have been abused, how you met and how you been affected by the abuse and what you have dont to seek help.I suggest counseling if its emotional abuse,if its physical they need police report and pictures of injuries, letter from the doctor. Also you can ask friends or relatives that have witnessed the abuse to write you letters to sent to immigration together with your application. You dont need a lawyer if you have everything .As children are concerned you dont include them in the petition only if thy were born outside the USA you came with them from your country then yes as they will need to adujust status, but if you have kids with your wife/husband together then you can include them in your story(testmony) enclose copies of your birth certificate and also the children born in marriage or ouside the USA,your spouse children no need to as they are hers/hers but can be mentioned in the testmony. Also try to go to local shelters in your area they help with VAWA .I didnt have a lawyer and my case was approved and have interview to adjust statues in a few days and my kids I came with from my country where in my petition and included in the approval .All the best and by the way its a long process dont mean to scare you but you have to be strong and patient.

ladyg got a reaction from Ontarkie in Crazy ex wife.
I heard that even if we might get sole custody of the kids she still does have visitation rights???!
ofcourse she has the rights as the mother as long as she is not abusive to the kids.
We want to get rid of her. My fiance hates her, I hate her and even the kids hate her (because of what she has done to them). Everytime we drop them off they cry and hold on to us... It breaks our hearts having to let them spend the weekend with her even though they don't want to... When we pick them up on Sunday the kids seem traumatized. They get in the car without sayin anything, just sitting there staring out the window until we're back home. Overall she is just crazy and I think even bipolar. She doesn't pay any child support, she tries to brainwash the kids, always texting my fiance about some stupid stuff, insulting him and me. Our life would be so much better without her...
How do you want to get rid of her? of course you and your fiance hate her iam sure whatever she tries to do even when she changes you will never see anything good from her side becuase you will be blind folded with the hatrage you have for her.She may be whatever she is at the end of the day those are her children .Honestly look at what you have written and how would you feel if someone wrote that about you conerning your own kids ?

ladyg got a reaction from Josie-Be-Happy in my wife threatening me with immigration / deportation
Sorry to hear this.I feel your pain have gone through it too.Its sad be strong and of good courage .She cant have you deported you have your gc for 10 years .She will have to prove so ICE that you entered in marriage for the sake of GC.My advise keep all documents that you have with her ( i mean documents in both your names) so that if it came to that you will prove bonafide marriage ,My own opinion a lawyer isnt needed now unless otherwise.I dont know why some USC spouse like threatening deportation.People should know that for someone to have someone deported its a long process and people need to have hard evidense, once you move avoid contact with her she may accuse you of abuse and have you arrested to make you look a bad person. All the best .
