This is our story. We met and married in 2002. My husband is from the Fiji Islands and I am a US citizen. We did not go to Immigration to file our paperwork right away due to working so much. (very bad excuse) By the time we decided to, my husband had a assault 4 on his record. First offense for him. Then as life goes, we both lost our jobs after Sept. 11 due to a family business going under. (could not pay fine for assault. It became a warrant) We moved to Oregon and started over. I was then in a severe car accident requiring major surgery and unemployed for that year. So here it is now 2005 and we desperately need to file. (after paying thousands to clear warrant) But in the process his visa expired. We have now been married just about 4 years. But with his assault charge and expired visa i am terrified of what will happen if we file and what will happen if we dont. He wants to see his family again and be legal. So long story short i am thinking of filing without an attorney because i have heard that their are some very knowledable people here that can maybe give me some very sound advice and walk with me through this mess.
