please help and explain

*sent I-129 5-28-07

*NOA1 received 6-8-07

* no touched, no request whatsoever from USCIS

*NOA2 ( approved I-129) 11-07-07, expired 3-7-08 and approved letter said that " your I-129 has been approved and forward to listed conlsulate"

My question is that : do i have to worry about NVS sending receiving, or just wait for instructon package will send to my fiance' in HM city?

You don't have to worry about it as your case will be forwarded to the NVC first, where it will be assigned a case # and then mailed to HCMC.

For me, I'd like to know the status of my case so I called at each stage of the process just for peace of mind. Good Luck! :thumbs:

For me I'm not taking any chances. Waiting is no fun. The NVC is suppose to get your petition from USCIS but the USCIS doesn't always send it right away. My petiton got approved on Oct 26 but as of Friday (Nov 16) according to the automated system, they have no record of it yet. The USCIS website show a "touch" on Nov 2 which I'm assuming is when they sent it but......... I"m still going to check again this week. I don't want to wait and find out that 2 months have gone by and it's been "lost" at USCIS or NVC. They say to wait 4 weeks before contacting them by phone so I will if I haven't heard anything.

Peter and Thi, which automated system did you used to find out that they have no record of your file? If you use the NVC's automated system it will always tell you that they have no record of your file even if your file was received and sent out to the Consulate. Many VJ Members have confirmed the same.

Yes, there's a waiting period (3-5 weeks) to get the NOA2 from CSC to NVC. Our case took 5 weeks.

It's better if you speak to a live NVC operator.

Well guess what showed up today!!! :dance: A notice from NVC!. They have recieved the petition and within a week will be sending it to HCMC!!!!! I read somewhere about the automated system so I assumed it worked for K1 visas too! Oh well, I was going to call and speak to a live operator on Wednesday if it didn't arrive by then. The notice was dated Nov 16th, so that's 3 weeks. Now the wait to see when HCMC sends Thi her packet 3. Ohhhh I better get my I-134, etc together tooo!!! Now I have stuff to do......

Tungchau, you should be getting your notice from NVC soon! Hang in there. It is coming!

Tungchau,

You should soon receive a letter from NVC stating they have receive your file on such and such and will be forwarding it to the USCG in HCMC. In my case, after this point I did not check with NVC or the consulate, and packet 3 just arrived 1.5 months after NOA2. You may choose to call NVC and the consulate for a status update, and definitely should do so if you don't hear from them in 1.5-2 months.

How did you find out your case was rec'd at HCMC consulate? Is your fiancee from Saigon? And did she pick up Package 3 at the office or was mailed to her? Your case was fast: they rec'd it and sent out the next day? They said it may take 8 weeks from date they rec'd file to process and send out Package 3? But yours went very fast. NVC forwarded my case to embassy on Oct 17, but my fiancee has not rec'd Package 3 yet. She's not from HCMC, from central VN. Thanks in advance for reading and reply.

11-19-12: Priority date/rec'd date.
02-06-13: Case approved, NOA2.
02-19-13: NVC received case.
03-08-13: Case # assigned--HCM2013******.
03-09-13: Paid AOS Fee $88.00.
03-09-13: Emailed DS-3032 from Beneficiary's email address.
03-13-13: AOS Fee showed as PAID & sent AOS package certified mail.
03-18-13: AOS package delivered @ 10:50 A.M.
03-18-13: DS-3032 accepted.
03-20-13: IV Bill Invoice.
03-21-13: Paid IV Fee $230.00.

Hi visao,

My fiancee lives in Saigon. She made the first call to them and a lady told my fiancee that they only received our case via electronic (11/8) and ask her not to call back until 3 weeks later. A week later I decided to give them a call myself. The day that I called (11/16), they said they received our case early that morning and said they will mail packet 3 to my fiancee in 4-6 weeks. 2 days later I received an email from them that packet 3 was sent out on 11/17. From the email, it stated that my fiancee needs to return the DS-230 Part I asap so that an interview date can be issue. The DS-230 form was already filled out in advance so I wanted my fiancee to drop it off. But they wouldn't allow it and told her to mail it in. I know it takes 2 weeks or more just for the mail to travel within Saigon. She hasn't receive the packet 3 that they've mailed, but we've already mailed back what they asked for. Here's the email from them if you like to see how they process:

We have received your fiancee's case from the National Visa Center. Her case number is HCM2007xxxxxx.

We sent your fiancee an Instruction Package (Packet 3) on November 17. The packet was sent to the following address:

xxxxxxxx

Your fiancee is requested to return the completed DS-230 Part I to us as soon as possible. We cannot schedule your fiancee for a visa interview

until we receive this form. If your fiancee has not yet received the packet after one month of the mailing date, she can come to our office

to pick-up a packet in-person or contact us to request that we mail another packet.

If you have further inquiries, please do not delete your original email with all correspondence.
