Both my applications got transferred...

someone just left a voicemail on my work phone stating to call them back.. I just call them back, and he was with the White House Homeland Security responsible for USCIS... they said my applications have been transferred to my local office (Los Angeles) and based on my inquiry has talked with the USCIS about looking at my case... This morning I received two emails stating they have been transferred.. :crying: I just want an approval, how hard can that be? I asked them if he knows anything about my security checks.. he said he can't estimate a timeframe of completion.. but that the FBI just checks the name (because my name is similar to another person).. basically, still nothing.. :angry:

Strange why transfer to Local Office in LA? Your profile shows K-3 case, I would assume the petitions would be transfered to CSC, and then on to NVC to be transfered to Guangzhou.

Once at Guangzhou, it takes 3-4 months before the consulate "Receive" the case.

You may want to Join and participate on "A Candle For Love" That site will prepare you for the tough visa interview at Guangzhou.

now it has been transferred to a LOCAL office.. so it means it will be stuffed into the dungeon and left there to rot? :crying: both I-130 and I-129F just got transferred this morning.. about 10AM PST.. I'm not scared of the final interview, because I still haven't gotten that far yet... no need to be scared of something you can't get to.. there still are plenty of problems beforehand..

I really don't like America anymore.. their treatment of my case as well as treatment of China in general... not letting them into the international space station "over US Concerns"... they didn't finish the sentence.. "because they fear China will overpower them soon".. I'm going to use this as my jury duty excuse next time I get picked.. I'm just going to choose "Gulity" regardless who.. make all the Americans pay..

Gogo, you have had security checks with your employment. I think you need to set up a personal interview and speak to these people directly! Take all of your documents with the previous security checks and talk to them one on one. Best of luck my friend!!

"security checks against my employment"? but I work for public safety (Fire Dept) already.. do I have to work for the White House? :crying: I seen how at least a government office works... no security, and can't even make a decent backup.. even worse than private sectors.. so it's too easy to penetrate..

gogo has not been approved on either petition, so he is not worried about getting to NVC yet or to Guangzhou. His petition was assigned to an adjudicator, then held for additional name checks. I remember seeing at least 1 other VJer get sent to a local office for further processing, then was called in for an interview with spouse.

My Honey, yes, they did security checks (background checks + credit checks too) when I got hired .. so I don't get it why they have to do it again so soon... I got hired last September... so half a year's time... also, they can just look at my SSN and look in the system for it.. not too hard

Inter-Agency Border Inspection System (IBIS) Name Check – IBIS is database of lookouts, warrants, arrests, and convictions consolidated from over 20 agencies.USCIS can quickly check information from these multiple government agencies to determine if the information system affects the adjudication of the case. Results of an IBIS are usually available immediately. In some instance, information found during an IBIS check will require further investigation.

FBI Fingerprinting Check – The FBI’s Automated Fingerprint Identification System (IAFIS) matches criminal history records from federal, military, and most state apprehensions.It provides information relating to criminal background within the United States. Generally, the FBI forwards responses to USCIS within 24 to 48 hours. If there is a record match, the FBI forwards an electronic copy of the criminal history to USCIS.At that point, a USCIS adjudicator reviews the information to determine what effect it may have on eligibility benefit. About ten percent of the inquiries submitted by USCIS uncover criminal history, including immigration violations.

FBI Name Checks –The FBI name check is totally different from the FBI fingerprint check. USCIS electronically submits the applicant’s name to the FBI National Check Program.The records maintained in the FBI name check process consist of administrative, applicant, criminal, personnel and other files compiled by law enforcement. Initial responses to this check generally take about two weeks. In about 80 percent of the no match is found. Of the remaining 20 percent, most are resolved within six months. Less than one percent of cases remain pending longer than six months.

For petitions and application filed in consulates, there are other security checks involved.These are: (1) Visa Condor checks which arise from information disclosed on a Form DS 157 or because a person is from designated terrorist countries like of Iran, Cuba, Syria, Sudan, North Korea or Libya; (2) Visa Mantis checks relating to an applicant, who because of his actions or background, may be involved in the transfer of sensitive technology; and (3) criminal background checks which arise from a hit in the National Crime Information Center (NCIC) database or from other sources.

I think whoever you spoke to on phone may have misspoke, If I-130 and I-129F were approved, the I-129F (K-3) should be on it's way to NVC, USCIS holds the I-130 pending eventual adjustment of status from the K-3 Visa. If you want the I-130 be sent to NVC for CR-1 visa you need to file I-824 and pay a fee to keep both cases moving.

Give it a couple of days, and then check your case status on-line, and then check with NVC in a few weeks.
