Ok i know this is to bit early to think of , but me and my husband are getting confused right now . I will enter the US as K3 visa with my 3 kids as k4 in my first marriage. When my 129F approved the 130 was approved also, and since in 129F my husband include my kids so they are in K4 visa , but we still dont apply separate I-130 for my kids only me has approved I-130. Now my question is the following :

1. Can I apply for EAD even im not applying for AOS ?

2. If not and will have to apply for my AOS to get EAD , will my kids lose the K4 since they are derivative in my K3 visa if my AOS is approved ?

3. If my kids will lose the K4 in my approved AOS does it mean i have to apply for my kids 130 before I applied for my AOS ?

4. If my AOS approved first than my kids 130 are they going to be unlawful resident ?

5. When exactly should i file the 130 for my kids since mine was approved already and if their 130 is approved when exactly can we apply for their AOS ?

everyone opinion and info is welcome and i will appreciate it very much tnx.

1. Yes - I applied for EAD immediately and applied for AOS over a year later.

3. You file an I-130 & I-485 for each child at the same time that you file your I-485 (put it all in the the same envelope, separate check for each application). I did this for our child, and her I-130 was approved at the same time that the I-485 was approved.

4. You will be approved together. If you do not file AOS for a dependant child that is named in your I-485, you can do so at a later date - they tell you that in the AOS interview - I DO NOT KNOW WHAT HAPPENS IF YOU DO NOT FILE FOR THEM AT THE SAME TIME AS YOUR AOS.

5. Answer above in #3. (I-130 & AOS for your kids are done at the same time as you file for AOS)

so u paid separate fee for EAD since its not with the AOS file , and do u mean separate check for I-485 for each kids will be 600$ each since they are applying the same time with my AOS and 355$ each for their I-130?

Yes, that's exactly it.

Somebody please correct me if I'm wrong. We filed in July, and were terrified of being rejected and having to pay the higher fees.
