Household size is 2. Him and you!

If he pays child support or declares them on his ITR them he may have more problems.

Best to get a co sponsor.

His household size is not 2. He must include dependent children under the age of 18 whether or not they are on his income tax return.

He must include the children in the household size even if they do not live with him.

correct me if im wrong ... they said counting household when your children or relatives live with you within 6 mons. thus his children didnt live with him.

One of the causes of any visas placed in AR is the income not meeting the 125% poverty guidelines. This is not just from USEM, but a requirement set by the government that the intending applicant will not be a public charge. I suggest that your fiance will use a co-sponsor and/ or include what other assets such as properties, bank statements, etc. to meet the poverty guidelines

I would like some insights about my fiance's ITR it shows very low income, does any one experienced during USEM interview bout fiance's low income??? I'm a bit worried my fiance's self employed and he fixed his income ever since before he met me as low income. do I get deny because of his low income??? do we need co sponsor?? actually his making a lot of money, do u think money in his bank will be a help to back up his low income?? i need some advise and I'm so worried for my upcoming interview...

correct me if im wrong K-1 is 100% and 125% is for AOS or immigrant visa right? im still processinf K-1 so i have to meet the 100% right???

The household size is most clearly defined in the instructions for the I-485 which will eventually need to be addressed. Nowhere in any instruction or rule is it mentioned that children only count if they live with you 6 months. On the contrary, the I-485 instruction specifically state that they count even if they don't live with you.

Although the percentages apply when adjusting status and for immigrant visas (100% for military, 125% for others), no specific percentage of the poverty level is ascribed to the consulate evaluation of the support requirement for a non-immigrant visa.

Read on page 2 of the I-864 instructions: How Do I Count Household Size?

Your household size includes yourself and the following individuals, no matter where they live:

any spouse,

any dependent children under the age of 21,

any other dependents listed on your most recent Federal income tax return,

all persons being sponsored in this affidavit of support,

and any immigrants previously sponsored with a Form I-864 or Form I-864EZ affidavit of support whom you are still obligated to support.

dependent children and any other dependents listed on the ITR are separate items.
