Hi, I would appreciate some inputs from members here. We originally plan for a K3. But we got delayed submitting them and got an RFE too on I-129f and we just resubmitted our I-129f again last end of october, so it's already behind on like 3-4 months from our I-130. We received our first notice for I-130 last august already . With the delay, I'm thinking of pursuing a CR1 now cos I think it's a much better visa too.

Will we need to cancel our K3? Write a letter to go on CR1 only? I hope USCIS will not wait for our K3 approval before they will approve our I-130 too. I have read here that they usually process the K3 and CR1 together now. That would certainly be a nightmare of waiting.

Just apply for the CR1. K3's a waste of time.

For the K3 - leave it hanging. It'll void itself out after some time.


The moral of my story: Stick with someone who matches your own culture.

( This coming from an Arab who married an Arab from overseas... go figure. )

I completely agree with this thought. I filed a I130 in June and it was received June 25th with a receipt date of July 2nd. I immediately sent off the 129f but the attorney forgot to send in the 170 with it and it was kicked back to me. We then sent off a letter nullyfying the 129f. I now have recently called the USCIS ( rfe trick) and found out that my file is still on the shelf and wont even be looked at until December because they have not gotten that far into the files. It managed to trigger a touch. Now imagine if I would have a 129f in play, sent off in August, going quickly that would not be approved until January. So now all I have to deal with is the CR1 and if it gets approved at Christmas time, it will head on over to NVC in January. I fail to see how much time a 129 f would really have saved me at this point and then when I got him here, he would have to wait 5 months to get a work permit and this and that and bla bla bla. I think sometimes the K3 really helps but in my case with this horrific wait, I dont think it would. I had a returned 129f returned in August and frankly it would make things even worse for me because they would hold the I130. They have not even gotten to my file yet, not even blown the dust off it to even look at it to tear it apart so OH WELL. It really did not matter if I had my 129f in play anyway.

Hello! Since you mentioned there has been a delay on your I-129F, your best option from the very start really is to go for CR1. Less problems et all...trust me!

There is nothing that you have to do at this time but to let your K3 ride and just do what you need to do with I-130. My suggestion, start reading informations from NVC and Philippines forums. When my case reached NVC, I did the James Shortcut v2.0 all throughout the whole process and it really benefitted me. PM me if you need any help at all.

Wahrania, Could I still nullify our I-129f?? if so how did you nullify it?? our I-129f was sent end of october, no NOA1 yet. I'm dreading thinking of another long wait for a NOA2 on I-129f. We don't even have NOA1 yet.

Hello Rina, when both your petition got approved, did you sent an I-824 saying you'll follow CR1 route instead?? How long did it take?

Hello Rina, It's I-824 (Follow-up action on an approved application), costing $340. That's when you have filed both the I-130 and I-129F and chose to proceed with the CR1 after approval.I've just learned about that too.

Yes James Shortcut looks really good, I can see yours took less than 3 months, I'll look in on that too to save time. Thanks a lot Rina:)

Doesn't cost anything and is a back up for the CR-1 in case you have problems with the NVC.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Yes but we are already 4 months behind on K3 and I've read here that USCIS let the 2 application meet at some point, am I right on that? if that's the case that would mean another long wait for K3 NOA2, as we have no NOA1 yet for K3. But having a back up is a good thought too.

:thumbs: Let it sit there. Nothing will happen to it and there is no consequences if you just let it sit there since you already have the CR1 way ahead of the race. K3 is only an expedited alternative for spousal visa. IN this case, it works for your best interest.
