Hey Guys! Can an american citizen file application for green card for her deported husband in order to return to the states to live and work? They presently live in Canada. I assume she has some sort of work visa to live and work in Canada while they wait for a 2 year residency requirement to be fulfilled. The deportation happened because he reniged on his J1 visa residency requirement in the 1st place. Lynnie

An US citizen spouse can petition for a waiver of the inadmissibility, but in order to do so he/she would be required to demonstrate that there is significant hardship. You might want to cruise through http://www.immigrate2us.net and have a good long read of the waiver section to get an idea of what odds you would be up against.
