My wife passed her interview in September 2007 and now wants to bring her 18 year old daughter to the US. I have read most of the material which says that her daughter has 1 year to come to the US from the date my wife’s Visa was issued. Her daughter’s name was on all the paperwork with the status that she would travel later (follow-to-join) at a later time.

Q1. How do I initiate the action to bring her daughter to the US?

a. I-824 form along with $340 filing fee?

From the State Department website I read that (http://travel.state.gov/visa/immigrants/types/types_2994.html) “A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa”.

b. Write the consular section at the consulate where the Visa was issued (Guangzhou) and ??????

How do I initiate the action?

I just did this for Rin's children in Thailand (Rin got her visa in April, children got their visa this month). I simply contacted the embassy and requested they send packet 3 materials for the children (provided the local address in Thailand). They also e-mailed them to me. So basically you start at the same point as your K-1 visa once it has reached the foreign embassy.

The only thing we paid was the $100 for the visa fee (and of course for the children's medical exams). We were fortunate in that we were returning to Thailand on holiday and was able to take care of all the paperwork locally.

The consulate should have the K-2 visa application all ready. Contact DOS about the K-2 by calling DOS at 202.663.1225 then press 1, then press 5, then press 0

Also you may want to visit and join the China immigrations specific board, "A Candle for Love" http://candleforlove.com

Also there is no filing of I-824, that is for action on an approved petition, typicaly to move an I-130 on to the consulate for IR/CR visa interview in a K-3 visa case.

K-2 is based on your I-129F petition and the consulate should have the K-2 case on hold pending orders from DOS.
