Timeline

I have a question, I searched for the answer but couldn't find it.

I sent in a 765 with my 485. In order for my 485 to get approved does my 765 need to get approved? If the 765 is denied is my 485 auto denied?

If my 765 is approved, when does the 485 go into processing?

I am confused I guess on what paths the 485 goes on and what it depends on in order to get approved. IE if my 130 is gold, is the 485 a shoe in? Sorry getting neurotic as every hour passes.

Hey Bradcanuck. I am on a very similar timelaine as you, so I thought I'd respond. I think that your 765 does not HAVE to be approved for your 485 to go forward, but I am curious if you have gotten a biometrics appointment yet. I received one about 2 weeks following the NOA1 date. If no, I would make an appointment for exactly 90 days following your NOA1 date (no earlier, as I have heard they will turn you away). I think that there you may be able to request your EAD on the spot. Most poeple around our timeline have been getting them, but I think it needs to be preceeded by a biometrics appointment.

Sent in AOS/I-130/EAD package

July 2007

July 14: DOA1 - delay in processing because CIS told me to send package to the wrong center.

Late July: Received Biometrics notice

Aug 2007:

Aug 2: Biometrics Appointment

Aug 8: Received RFE for missing medical forms which CIS told me originally not to send in!!

Aug 16: Medical Forms Received at CIS

Aug 24: Received e-notice that EAD card was ordered (No more TN! yay!)

Aug 30: Last day of work on TN. Laid off from job. :(

September 2007

September 5: Received Card! Just in time. Started part-time grad school today.

October 2007

Oct 2: Received Interview Notice: Whoo-hoooo!

November 27 2007

Had GC interview, which went smooth as silk. Received passport stamp, too.

All three (I-130/I-485/I-765) are somewhat independent of each other except that if your I-485 is denied your I-765 will be as well since the EAD was applied for on the basis of you being an adjustment applicant. So... when you get an RFE for the I-485, it stops processing on the I-765 until the RFE is satisfied and processing resumed.

The I-130 is used to establish family relationship (independent of the I-485).

The I-485 needs the I-130 to be approved in your case. No I-130 approval, no PR status. With those filing the I-130 and I-485 at the same time (or with the I-130 pending), they usually get approved at the same time. An approved I-130 is not a guarantee for the I-485 to be approved though (but brad, try not to worry!).

I know it's stressful but BREATHE! :) Trust me I know how stressful it is... I'm totally neurotic about all this and went through 2 USCIS processes and 2 interviews. One to get here on a K3 and one to get my GC. I ended up channelling my neurotic tendancies into preparing documents.

Take the time now to prepare and gather documents for an interview... you can use my checklist linked in my signature ("documents") to see what I brought to my interview but you will also get a interview letter and checklist in the mail. 2007-04-16: I-485 and I-765 sent to Chicago (My AOS/EAD checklist)

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!
