I've looked all over for information on this topic but I haven't seen anyone with a similar situation. My fiancee was previously married to an American citizen while he was stationed as military in Japan. Shortly before they divorced, she completed the process of obtaining an IR1 immigrant visa as a spouse of an american citizen and was granted lawful permanent residency (i.e. green card). However, due to the divorce and the difficulties posed by raising their son by herself, she did not immigrate to the US. The IR1 was granted in September, 2005. She did not come to the US until May, 2007, when she visited me for the first time. Her intention was not to stay permanently, but was to return to Japan. The immigration officer interviewed her and explained she had abandoned her permanent residency since she had not been to the US since 2005 and confiscated her green card. She was then admitted to the country as a tourist under the terms of the US-japan visa waiver program. We disclosed all of this information in our K-1 packet. Does anyone think that this will affect the processing of the K-1 visa? As far as we know, she did not break any sort of law in the course of these events.

2008/03/18 - Interview
