IR2, Petitioner is the stepfather, Filipino USC Citizen

Hello. Badly need your help. We have an upcoming interview for my kids. I am the biological mom, married to my husband who is the petitioner, a Filipino USC citizen. My question is, he had a previous marriage in Ph and filed for divorce here in US. We have the divorce decree and our marriage certificate. His CENOMAR shows advisory on his previous marriage in Ph. Will this be a problem?

It should be fine.  Are you already in the US and now your husband is petitioning your kids?  A CENOMAR or Advisory on Marriages for the petitioner should not be required at all in standalone IR-2 cases.  If the petitioner is a dual citizen it might be a good idea to bring one to the interview anyways, but even if that incorrectly shows married to the former spouse, the embassy would just want to see a valid divorce decree to explain the discrepancy.  So it's no problem

Thank you for your response. Yes, I am in US already. Here’s a summary. Petitioner got married in Ph 2008. Became a USC 2015. Filed for divorce 2021. And we got married here in US 2022. My kids were supposed to have their interview last July. But during the prescreening, we were given a yellow slip asking for a cenomar. I am just worried on my husband’s cenomar showing his previous marriage. We didn’t do the judicial recognition of divorce decree. That’s why his previous marriage still shows in his cenomar/AOM.
