Hello! I'm preparing to file Form I-751 to remove conditions on my wife's residence. We initially used a New Jersey address, my brother's residence, when filing the spouse petition. However, we've since relocated to Pennsylvania, where we currently reside together. Although our Pennsylvania address might change due to potential apartment relocations, I'm wondering if I should use our current Pennsylvania address or the original New Jersey address (brother's permanent address) for the I-751 process. Could you advise on the best approach?

1) Immigrant has to file AR-11 within 10 days of moving addresses. Failure to file is a deportable offence. You can update it late, people don't have issue with that

2) Sponsor (US citizen spouse) must file I-865 within 30 days of moving addresses.

3) There's physical and mail address on I-751. Always use true physical address where you're staying currently when filing I-751 and other forms with USCIS.

You can use brother's address for mailing address if this is a stable address.

 

If you're moving soon and will be still within 90 day window, file from new address. Issues happen if you file and move shortly after. If you can, it's best NOT to move until you're done with I-751 and have GC in hand.

Thanks for the prompt response. 

 

It's been well over 10 days and 30 days for each of those forms.  Is there a risk to this?  I plan to put down the first day of my apt lease (July 2023) for I-865 and my wife's US arrival date (August 2023) for AR-11.  Should I consider anything else?

Historically, no risk. Updating late is better than never updating addresses. Plus you'll have to disclose all addresses in I-751 and N-400 anyways.

Sounds like a plan.

And once you move again, file another AR-11 and I-865.

Thank you for your help! I have one more question. Should I expect to receive confirmation of receipt for both of these forms before submitting the I-751? I need to start the I-751 process soon, as I recently received a letter from USCIS requesting initiation of this process.

AR-11 can be filed online with instant confirmation. Make sure to save it to PDF for your records.

 

I-865 takes 3-4 weeks by mail.

 

But either way, you don't have to wait for confirmation before filing I-751. The key is using correct addresses on I-751 and minimizing moving during this process.

 

I was super lucky. My GC came on the day I was moving. I set everything to new address (USPS mail forwarding etc). But GC still showed up to old address. Many people lose GC or miss the interview /approval notice because of moving during I-751.
